15.22.01 Purpose

The purpose of this zone is to provide for a broad range of retail, service and entertainment functions.

15.22.02 Permitted Uses

The following uses are permitted by right provided the parcel and building meets all other provisions of this ordinance or any other applicable ordinances of Rocky Ridge Town and are granted site plan approval as provided in this Ordinance.

  1. Business Services and Professional Offices
  2. Medical Facilities
  3. Hotels and Motels
  4. Public Parks
  5. Restaurants and fast food services
  6. Retail Trade
  7. Community or Civic Services
  8. Accessory Uses and Buildings
  9. Agriculture
  10. Amusement and Recreational Activities.
  11. Dwellings which were completed or under construction at the time of adoption of this ordinance. Such dwellings, if converted to any other permitted or conditional use allowed in section 15.22.020 or 15.22.030, may not thereafter be converted back to residential use without first  obtaining a conditional use permit.

15.22.03 Conditional Uses

The following uses may be permitted as conditional uses after application and approval as specified in Chapter 15.10 of this ordinance.

  1. Churches, Synagogues & Temples
  2. Public and Quasi-Public Buildings
  3. Temporary Retail Uses
  4. Day Care Services
  5. Repair Services
  6. Wholesale Trade

15.22.04 Minimum Lot Standards

All lots shall be developed and all structures and uses shall be placed on lots in accordance with the following lot standards:

  1. Lot Area: No minimum required
  2. Lot Width: As required by site plan review
  3. Front Yard: 1 S feet
  4. Side Yards: As required by site plan review
  5. Rear Yard: 10 feet
  6. Building Height: The height of buildings over 45 feet high may be equal to the horizontal distance from the nearest zone boundary line. Buildings 35 feet high or less may be permitted within 10 feet of the zone boundary line.
  7. Structural Offset
    1. Minimum of thirty feet (30') from road right of way.
    2. Minimum of ten feet (10') from all other lot lines.
  8. Utility Offsets
    1. Ten Feet (10') utility easement from road right of way with ten feet (10') minimum from actual utility locations.

15.22.05 Off-Street Parking And Loading

Off-street parking and loading shall be provided as required by site plan review.

15.22.06 Signs

The signs permitted in this zone shall be those for the commercial establishment only and as required by site plan review.

15.22.07 Special Provisions

  1. All lots, parcels or sites shall have a minimum of 100.4 of the total area landscaped and all required front yards shall be part of the landscaped area. All required landscaping shall be installed within four months of occupancy and permanently maintained in good condition.
  2. Temporary Retail Uses may be allowed for a maximum of six (6) months. Renewals may be granted by the Planning and Zoning Commission provided there have been no adverse affects of the use. Temporary buildings must meet the provisions of the currently adopted edition of the Uniform Building Code.
