15.20 Cluster

Subdivision

15.20.01 Purpose

Cluster subdivisions may be allowed in zones which identify them as conditional uses. The purpose of the cluster subdivision is to allow diversification in the relationship of residential uses to their sites and permit more flexibility of site design. This will allow the developer to more closely tailor a development project to a specific user group, such as retired persons. The application of cluster concepts is intended to encourage good neighborhood design while insuring substantial compliance with the intent of the Subdivision and Zoning Ordinances.

15.20.02 Development Requirements

  1. A minimum of two (2) acres of land area is required for development of a cluster subdivision.
  2. The development shall the subject of an application filed jointly by all owners of the property.
  3. The Planning Commission shall require that the arrangement of structures and open spaces are developed in such a manner to assure that adjacent properties will not be adversely affected.
  4. Lot area, lot width, setbacks and lot coverage regulations shall be determined by approval of the development plan. The minimum distance between any main buildings shall be ten (10) feet, and the minimum side yard for any single lot shall not be less than three (3) feet.
  5. A clear area thirty (30) feet wide shall be maintained along both sides of all streets in a cluster subdivision for the location of utilities.
  6. Every Cluster subdivision shall provide open space within the development. 
  7. Due to the nature of cluster subdivisions and the fact that most of the usual dwellings have site restrictions and because the placement of dwellings and other structures on the site may produce a negative impact to surrounding land uses, the location, size and general footprint of all dwellings and other main buildings shall be shown on the plans submitted for review.
  8. It shall be shown that under the circumstances of the particular case, the proposed development will not be detrimental to the health, safety, or general welfare of persons residing in the vicinity.

15.20.03 Permitted Uses

Uses permitted in the cluster subdivision shall be those uses that are permitted in the zoning district in which it is located; provided that for the purposes of this section, single family attached dwellings such as town houses and row houses or zero lot-line dwellings, shall be considered single family dwellings.

15.20.04 Minimum Lot Standards

1. Structural Offset

  1. Minimum of thirty feet (30') from road right of way.
  2. Minimum of ten feet (10') from all other lot lines.

2. Utility Offsets

  1. Ten Feet (10') feet utility easement from road right of way with ten feet (10') minimum from actual utility locations.
