Higher Education District

A.

Purpose. It is the purpose of this section to establish and maintain a Higher Education HE District for colleges universities postsecondary trade schools and other postsecondary education institutions public or private free from other uses except those which are compatible with this zone.

B.

Master Plan. All rezoning requests to a Higher Education HE District must provide a Master Plan to be approved as part of the rezoning process The Master Plan must consist of that which is required by the State of Wyoming to be submitted as a Master Plan for a college or university. The process for rezoning to a Higher Education District shall be the same as for rezoning to any other category except as expressly contained within this zoning regulation.

1.

Revisions to a Master Plan. Subsequent to the original rezoning of any property to Higher Education HE, a revised Master Plan and all necessary accompanying information as determined by the Planning Division must be submitted for review by Planning Division staff prior to the revision update of the Master Plan as required by state statute or if any part of the Master Plan (this includes the revision/updating or any of the documents required to accompany the Master Plan as outlined in this section of City Code for the original rezoning of the subject property) is to be revised updated Planning Division staff will determine if the revision/update is such that a public hearing process is necessary (significant in scope) to review and/or approve the proposed revisions updates.

a.

Public Hearing Needed. If the Planning Division determines that a public hearing process is necessary (significant in scope), the standard process for a minor subdivision (staff review and recommendation to Planning Commission, Planning Commission review and recommendation to City Council, City Council decision) will need to be completed per City Code Appendix B, Subdivision Regulations, Section 112 et seq.

b.

Public Hearing Not Needed. If it is determined by the Planning Division that the revision/update is minor in nature and no public hearing process is necessary then the proposed revision/update may be reviewed, and administratively approved by Planning staff and filed (recorded if necessary) with the original rezoning document for the subject property.

C.

Permitted Uses. Except as otherwise permitted/provided, no use, building or structure shall be permitted in a Higher Education District, except those outlined within this section:

1.

Colleges, universities other postsecondary education institutions and or campuses along with associated buildings (i.e., class rooms, laboratories, observatories, staff and student offices, student centers, etc.);

2.

Dormitories;

3.

Single-family and multi-family housing;

4.

Child day care/child caring facility/child care center;

5.

Parks, playgrounds, athletic fields (i.e., football, baseball, tennis, etc.), golf courses, stadiums, equestrian arenas, and other similar recreational facilities operated primarily during daylight hours;

6.

Parking as required;

7.

Towers (telecommunication and otherwise not exceeding thirty feet (30′) in height;

8.

Facilities for housing and/or caring for agricultural livestock as well as the facilities and buildings in support thereof if involved with or part of an educational program at a permitted postsecondary institution;

9.

Businesses, general retail (only if integrated into another building offering other permitted uses);

10.

Restaurants, cafés, and coffee shops (only if integrated into another building offering other permitted uses);

11.

Convenience establishments (not food and gasoline and only if integrated into another building offering permitted uses);

12.

Sundry stores (only if integrated into another building offering permitted uses);

D.

Conditional Uses/Special Exemptions. Conditional uses/special exemptions shall be reviewed on an individual basis as outlined in City Code Appendix A, Section 14, Board of Adjustments, and shall include the following:

1.

Bed and breakfast;

2.

Stand-alone businesses, general retail;

3.

Stand-alone restaurants, cafés, and coffee shops;

4.

Office buildings, and offices not for use by institutional staff or students;

5.

Outdoor lighted recreational facilities used during evening hours;

6.

Public utility and public service installation and facilities, including business offices, repair, and storage facilities;

7.

Stand-alone convenience establishments (i.e., food and gasoline);

8.

Stand-alone sundry stores;

9.

Other compatible uses as described in a Master Plan for the institution in question.

E.

Satellite Campus. Satellite campuses (campuses other than a main campus that has been zoned Higher Education) shall follow the existing City Code requirements for the zone in which they are located.

F.

Standards.

1.

Lot Area.

a.

College/university campus: a minimum of forty (40) acres;

b.

Trade school: a minimum of two (2) acres.

2.

Lot Width.

a.

College/university campus: a minimum of five hundred feet (500′);

b.

Trade school: a minimum of one hundred feet (100′).

3.

Lot Depth. No minimum.

4.

Setbacks.

a.

College/university campus:

(1)

Front yard: a minimum of twenty-five feet (25′),

(2)

Side yard: a minimum of twenty feet (20′),

(3)

Rear yard: a minimum of twenty feet (20′);

b.

Trade school (except in downtown Sheridan where the existing zoning of the subject property would be followed):

(1)

Front yard: a minimum of the average setback for the street,

(2)

Side yard: a minimum of ten feet (10′),

(3)

Rear yard: a minimum of ten feet (10′).

5.

Height.

a.

College/university campus: a maximum of forty feet (40′) or four (4) stories which may be exceeded if for every additional foot in height an additional foot in setback is provided to a maximum of one hundred feet (100′) or ten (10) stories. This maximum height excludes towers greater than thirty feet (30′) in height which will be reviewed on an individual basis per conditional uses outlined above.

b.

Trade school: a maximum of forty feet (40′) or four (4) stories which may be exceeded if for every additional foot in height an additional foot in setback is provided to a maximum of sixty feet (60′) or six (6) stories This maximum height excludes towers greater than thirty feet (30′) in height which will be reviewed on an individual basis per conditional uses outlined above.

6.

Campus Parking. Campus parking shall be provided as detailed on the Master Plan Site Plan (as approved by the City) for the higher education institution in question.

7.

Signage.

a.

Entrances. All entrance signs must be approved as part of the Master Plan approval during rezoning review.

(1)

Main entrance: If a property has more than one (1) entrance, one (1) entrance will be designated as the main entrance within the Master Plan and shall meet the following requirements:

(A)

Height: A maximum of twenty-five feet (25′) high;

(B)

Area: A maximum of fifty (50) square feet in area.

(2)

Other Entrances.

(A)

Height: A maximum of six feet (6′) high;

(B)

Area: A maximum of twenty-five (25) square feet.

b.

Way Finding/Directional Signs. All way finding/directional signs must be approved as part of the rezoning review to be submitted as a sign plan.

c.

Buildings.

(1)

Building identification signs shall be a maximum of two (2) square feet per one (1) linear foot of building frontage.

(2)

Other building signs (i.e., room numbers) will not be regulated.

d.

Temporary Signs. Temporary signs which display events are permitted by right for no longer than thirty (30) days. No application or fee needs to be submitted for these signs. These signs may only display events specific to the property zoned Higher Education and may not advertise any products or services. These signs must be placed in such a way as to not create a hazard to the residents or visitors of the City of Sheridan (i.e., they may not be placed within any road right-of-ways or block any road signs).

8.

Mitigation of Potential Off-site Impacts. Mitigation of potential off-site impacts (impacts to properties not included within the college campus (Higher Education District)) shall be provided in the form of landscaping or other design mitigation as part of a mitigation plan approved as part of the initial rezoning to a Higher Education zone or revision update of the initial rezoning (i.e., Master Plan and other accompanying documents).

9.

Summary of Required Documents for Rezoning to Higher Education District.

a.

Master Plan (to include all information required by State of Wyoming);

b.

Master Plan Site Plan (to include a complete site plan view of the entire property being rezoned to Higher Education (including but not limited to buildings, parking, and roadways). This may be included as part or the required Master Plan above);

c.

Sign Plan (a detail of an existing and proposed entrance signs and way finding/directional signs including their design features (graphic representation), dimensions and locations);

d.

Mitigation Plan (to include all necessary information as detailed in subsection H of this section);

e.

Survey which accurately describes the entire parcel to be rezoned;

f.

Plat with all necessary language and signature blocks to be recorded for the rezone.

G.

General Provisions and Exceptions. General provisions of the City of Sheridan Municipal Code shall be followed for any use function or appurtenance not covered or noted in the above sections.
