Design Requirements for Properties Within the Entryway Corridor or the Gateway District
1.
Procedure. For all development or redevelopment within the Entryway Corridor or Gateway District of multi-family, commercial or industrial projects meeting the definition of substantial improvement (as defined in Appendix A section 2), the following procedure shall apply for building and site design approval prior to issuance of a building permit.
a.
The applicant shall submit the following to the Planning Division office:
(1)
Description of proposed uses.
(2)
Site Plan (24″ x 36″) showing:
(A)
Location of buildings with the entries noted.
(B)
Dimensions of all setbacks, property lines, building footprints.
(C)
Location and dimensions of all driveways, parking areas, loading/service areas and walkways.
(D)
Site and building entry areas.
(E)
Location and type of outdoor storage or trash facilities.
(F)
Location and size of utilities and utility easements.
(G)
Any accessory appurtenances such as scales, satellite dishes, antenna, gas pumps, trash enclosures, etc.
(H)
Gross floor area of the development by use.
(3)
Grading Plan (24″ x 36″) showing:
(A)
Existing and proposed contours at one-foot intervals.
(B)
Finished floor elevations at all building entries.
(C)
Flow arrows indicating drainage directions along all swales and paved areas.
(4)
Landscape Plan (24″ x 36″) showing:
(A)
Proposed planting including a tabular breakdown of planting beds, lawn area and other proposed ground covers.
(B)
Existing and proposed utilities and utility easements.
(C)
Irrigation strategy narrative describing system.
(5)
Building Floor Plans.
(6)
Color Rendered Building Elevations.
(7)
Notations on the types of materials to be used, mechanical systems, electrical systems, structural type and exterior colors.
b.
Determination of Complete Application. Upon verifying that the design review submittal materials are complete, the Planning Division shall review the project for compliance with the building and site design requirements found in section 15.2 below. If the Planning Division determines that an applicant's design review submittal materials are incomplete, or not compliant with building and site design requirements, it shall notify the applicant of any deficiencies, which the applicant must correct prior to approval. Upon determining that the project meets building and site design requirements, Planning Division shall notify the Building Official, who may issue a building permit once all other necessary requirements have been met.
2.
Building and Site Design Requirements.
a.
Entryway Standards. The building and site design requirements for Entryway Corridor and/or Gateway Districts are as set forth in the Sheridan Entryway Design Standards, as now adopted by the City or as may be amended by the Planning Division from time to time hereafter (referred to herein as the "Entryway Standards").
b.
Applicants may propose alternative methods of compliance with building and site design requirements as provided below in section 15.3. Likewise, applicants may appeal Planning Division determinations as provided for in section 15.4 below.
3.
Building Massing and Form.
a.
Purpose and Intent. The Building Massing and Form standards are set forth to:
(1)
Promote building massing and form along the I-90 corridor and primary entry roads from I-90 that contributes to the community architectural identity, streetscape quality, and human scale of the entryway experience.
(2)
Provide a basic direction for the design of buildings and appurtenances to ensure that structures built without the assistance of an Architect or design professional achieve the objectives outlined above.
(3)
Promote architectural design that clearly defines and differentiates roof planes from wall planes, creates clear fenestration patterns, projections and shadow lines at intersection of roof/wall planes while providing a basic level of variety and interest and avoiding large, monotonous buildings.
b.
Applicability. This section shall apply to Industrial, Light Industrial and Commercial buildings within the Entryway.
All Industrial, Light Industrial, Commercial and Multi-family buildings and sites located within the Entryway Corridor or a Gateway District shall demonstrate compliance with the Entryway Standards on file in the Planning Division Office, or receive approval for alternative compliance as detailed in section 15.4 below.
c.
Gateway Districts. The City's adoption of the Entryway Standards, as may hereafter be amended, supersedes the design criteria of all previously adopted master plans approved in conjunction with a Gateway District. Projects within Gateway Districts shall meet requirements of the Entryway Corridor, although the master plan may require a higher standard. In any case where the master plan is silent on a requirement, the requirement of the Entryway Standards shall apply and control.
4.
Alternatives Methods of Compliance to Standards. An applicant shall have two (2) methods by which compliance with the intent and purpose of the Entryway Standards can be satisfied without strictly adhering to the Entryway Standards now adopted or hereafter amended by the City, as follows:
a.
Covenants. If there are architectural, building and/or site design standards that are part of enforceable covenants placed of record against the property otherwise subject to the Entryway Standards that meet or exceed the Entryway Standards, then those covenants may provide the sole standard for that project if:
(1)
Approval by Planning Division. Applicant will submit a copy of the covenants which include the standards proposed to be equal to or greater than the Entryway Standards. If the Planning Division approves the terms and conditions of the covenants as being equal to or greater than the effectiveness of the Entryway Standards and the same are properly recorded and enforceable.
(2)
If the proposed covenants are approved pursuant to (A)(1), above, then those covenants shall be recorded and a recorded copy provided to the Planning Division. Thereafter, the covenants shall be the document by which the building and/or site improvements shall be reviewed in lieu of the City's Entryway Standards. The design standards as contained within the approved covenants shall not be amended thereafter without submission to the Planning Division for approval.
b.
Alternative Plan Method. Upon request by an applicant, the Planning Division may administratively approve building and site plans for properties within the Entryway Corridor or Gateway District that may be substituted in whole or in part for a plan meeting the specific conditions of the Entryway Standards.
(1)
Procedure. Alternative plans shall be prepared and submitted in accordance with submittal requirements. Each such plan shall clearly identify and discuss the modifications and alternatives proposed and the ways in which the plan will better accomplish the purposes of this section than would a plan which otherwise complies with the Entryway Standards.
(2)
Review Criteria. To approve an alternative plan, the Planning Division must first find that the proposed alternative plan accomplishes the intent and purposes of this section and the Entryway Standards equally well or better than would a plan which complies with the specific conditions thereof.
5.
Appeal. Any person aggrieved by Planning Division in the interpretation or enforcement of the requirements contained in this section may appeal to the Planning Commission by providing a written request to the Planning Division office within thirty (30) days of receiving written notice of staff determination. The written appeal shall contain the staff determination, and indicate what relief is sought by the applicant. The Planning Commission shall hear the appeal at the next regularly scheduled meeting. The Planning Commission may affirm, affirm in part, reverse, or reverse in part any staff determination pertaining to the design requirements. Any person aggrieved of a determination of the Planning Commission may appeal to the City Council by providing written notice to the City Clerk within thirty (30) days of the final determination by the Planning Commission.

b.

2.

The building and site design requirements for Entryway Corridor and/or Gateway Districts are as set forth in the Sheridan Entryway Design Standards, as now adopted by the City or as may be amended by the Planning Division from time to time hereafter (referred to herein as the "Entryway Standards").
b.
Applicants may propose alternative methods of compliance with building and site design requirements as provided below in section 15.3. Likewise, applicants may appeal Planning Division determinations as provided for in section 15.4 below.
3.
Building Massing and Form.
a.
Purpose and Intent. The Building Massing and Form standards are set forth to:
(1)

Applicability. This section shall apply to Industrial, Light Industrial and Commercial buildings within the Entryway.
All Industrial, Light Industrial, Commercial and Multi-family buildings and sites located within the Entryway Corridor or a Gateway District shall demonstrate compliance with the Entryway Standards on file in the Planning Division Office, or receive approval for alternative compliance as detailed in section 15.4 below.
c.
Gateway Districts. The City's adoption of the Entryway Standards, as may hereafter be amended, supersedes the design criteria of all previously adopted master plans approved in conjunction with a Gateway District. Projects within Gateway Districts shall meet requirements of the Entryway Corridor, although the master plan may require a higher standard. In any case where the master plan is silent on a requirement, the requirement of the Entryway Standards shall apply and control.
4.
Alternatives Methods of Compliance to Standards. An applicant shall have two (2) methods by which compliance with the intent and purpose of the Entryway Standards can be satisfied without strictly adhering to the Entryway Standards now adopted or hereafter amended by the City, as follows:
a.
Covenants. If there are architectural, building and/or site design standards that are part of enforceable covenants placed of record against the property otherwise subject to the Entryway Standards that meet or exceed the Entryway Standards, then those covenants may provide the sole standard for that project if:
(1)

If the Planning Division approves the terms and conditions of the covenants as being equal to or greater than the effectiveness of the Entryway Standards and the same are properly recorded and enforceable.
(2)
If the proposed covenants are approved pursuant to (A)(1), above, then those covenants shall be recorded and a recorded copy provided to the Planning Division. Thereafter, the covenants shall be the document by which the building and/or site improvements shall be reviewed in lieu of the City's Entryway Standards. The design standards as contained within the approved covenants shall not be amended thereafter without submission to the Planning Division for approval.
b.
Alternative Plan Method. Upon request by an applicant, the Planning Division may administratively approve building and site plans for properties within the Entryway Corridor or Gateway District that may be substituted in whole or in part for a plan meeting the specific conditions of the Entryway Standards.
(1)
Procedure. Alternative plans shall be prepared and submitted in accordance with submittal requirements. Each such plan shall clearly identify and discuss the modifications and alternatives proposed and the ways in which the plan will better accomplish the purposes of this section than would a plan which otherwise complies with the Entryway Standards.
(2)
Review Criteria. To approve an alternative plan, the Planning Division must first find that the proposed alternative plan accomplishes the intent and purposes of this section and the Entryway Standards equally well or better than would a plan which complies with the specific conditions thereof.
5.
Appeal. Any person aggrieved by Planning Division in the interpretation or enforcement of the requirements contained in this section may appeal to the Planning Commission by providing a written request to the Planning Division office within thirty (30) days of receiving written notice of staff determination. The written appeal shall contain the staff determination, and indicate what relief is sought by the applicant. The Planning Commission shall hear the appeal at the next regularly scheduled meeting. The Planning Commission may affirm, affirm in part, reverse, or reverse in part any staff determination pertaining to the design requirements.
