The City Council shall have the authority to vary the application and terms of this title when, by reason of exceptional conditions, strict application of any regulation enacted in this title would result in difficulty or undue or unnecessary hardship and would deprive the owner of reasonable use of land or buildings involved. Such relief may be granted provided only that such action does not substantially impair the intent and purposes of this title, and is consistent with Idaho Code 67-6516. (Ord. 202, 5-10-2018)

   A.   Upon application for variance, the City Council shall conduct a public hearing on the application and shall notify in writing all adjoining property owners of the property in question at least fifteen (15) days prior to the hearing.

   B.   The applicant for variance shall be charged a sufficient fee to cover all costs of publishing and mailing the notice of the public hearing. (Ord. 44, 1977)
