CHAPTER 17

27 LIMITED COMMERCIAL DISTRICT

17.27.010: PERMITTED USES:

Permitted uses in the Limited Commercial District are:
   Churches.
   Home occupations.
   One-family dwellings.
   Short-term vacation rentals of one-family dwellings. (Ord. 229, 7-31-2025: Ord. 202, 5-10-2018)

17.27.020: CONDITIONAL USES:

   A.   Conditional use permits shall be applied for according to the provisions as set forth in chapter 17.62 of this title.
   B.   In addition to the requirements and limitations as set forth in chapter 17.62 of this title, conditional uses in this district are limited to the following:
      1.   Overnight lodging, with the exception of short-term vacation rentals of one-family dwellings, providing that it be limited to a maximum total of eight (8) overnight units, and requiring a plan to provide for permanently maintained off-street parking, which shall include the following:
         a.   A plan which will allow for an off street parking area that will provide a minimum of one parking space for each overnight unit proposed, and which will use a formula that will allow for seventy percent (70%) of the parking lot to be used for parking and circulation, with the remaining thirty percent (30%) of the parking lot space to be used for snow storage.
         b.   A site plan drawn to appropriate scale showing all existing and proposed buildings and outbuildings, as well as the proposed number of parking spaces to be constructed, showing snow storage areas, and showing entrances and exits to public streets.
      2.   Restaurants, bars, prepared food establishments, carryout establishments, and other eating and drinking establishments, requiring a plan to provide for permanently maintained off street parking which shall include the following information:
         a.   A plan which will allow for off street parking that will provide for a minimum of one parking space for each twenty five (25) square feet of customer area, and which will use a formula that will allow for seventy percent (70%) of the parking lot to be used for parking and circulation, with the remaining thirty percent (30%) of the parking lot space to be used for snow storage.
         b.   A site plan drawn to appropriate scale showing all existing and proposed buildings and outbuildings, as well as the proposed number of parking spaces to be constructed, showing snow storage areas, and showing entrances and exits to public streets.
      3.   Doctor, dentist, medical clinics, beauty and barber shops, offices and retail shops requiring a plan to provide for permanently maintained off street parking, which shall include the following information:
         a.   A plan which will allow for off street parking that will provide for a minimum of one parking space for each unit of up to five hundred (500) square feet of total building square footage area, and which will use a formula that will allow for seventy percent (70%) of the parking lot to be used for parking and circulation, with the remaining thirty percent (30%) of the parking lot space to be used for snow storage.
         b.   A site plan drawn to appropriate scale showing all existing and proposed buildings and outbuildings, as well as the proposed number of parking spaces to be constructed, showing snow storage areas, and showing entrances and exits to public streets.
      4.   Daycare centers requiring a plan to provide for permanently maintained off street parking, which shall include the following information:
         a.   A plan which will allow for off street parking that will provide for a minimum of one parking space for each unit of up to five hundred (500) square feet of customer area, and which will use a formula that will allow for seventy percent (70%) of the parking lot to be used for parking and circulation, with the remaining thirty percent (30%) of the parking lot space to be used for snow storage.
         b.   A site plan drawn to appropriate scale showing all existing and proposed buildings and outbuildings, as well as the proposed number of parking spaces to be constructed, showing snow storage areas, and showing entrances and exits to public streets.
         c.   Copies of all required Federal, State, County or City licenses or permits required for operation of a daycare center.
      5.   Multiplex units, limited to a maximum of four (4) living units per lot requiring a plan for permanently maintained off street parking, which shall include the following:
         a.   A plan which will allow for off street parking that will provide for a minimum of one parking space for each living unit, and which will use a formula that will allow for seventy percent (70%) of the parking lot to be used for parking and circulation, with the remaining thirty percent (30%) of the parking lot space to be used for snow storage.
         b.   A site plan drawn to appropriate scale showing all existing and proposed buildings and outbuildings, as well as the proposed number of parking spaces to be constructed, showing snow storage areas, and showing entrances and exits to public streets.
      6.   Commercial river outfitters, providing that warehouse space footprint shall be limited to no larger than one thousand five hundred (1,500) square feet, and requiring a plan for off street parking which shall be maintained during all periods of operation and shall include the following:
         a.   A plan which will allow for off street parking that will provide for a minimum of one parking space for each seven hundred fifty (750) square feet of warehouse space, and which will use a formula that will allow for seventy percent (70%) of the parking lot to be used for parking and circulation, with the remaining thirty percent (30%) of the parking lot space to be used for snow storage, and with the understanding that snow storage shall not be required during nonoperational seasons.
         b.   A site plan drawn to appropriate scale showing all existing and proposed buildings and outbuildings, as well as the proposed number of parking spaces to be constructed, showing snow storage areas, and showing entrances and exits to public streets. 17.27.030: PROHIBITED USES:

   A.   Prohibited uses in the Limited Commercial District are all uses which are not permitted uses or conditional uses, and expressly include, but are not limited to, the following:
All business, commercial or industrial uses not expressly allowed or listed as conditional uses.
Convenience stores.
Gas stations, service stations, repair shops and new and used car sales lots.
Grocery stores.
Hotels, motels and lodges with more than eight (8) overnight units.
Manufacturing not specifically defined as home occupation.
Structures with more than four (4) residential units.
Vehicle repair, welding and construction not specifically defined as home occupation.
Warehouses used to store goods, supplies and equipment to retailers or other businessmen. (Ord. 129, 3-4-1998)

17.27.040: MINIMUM LOT AREA:

Minimum lot or tax parcel area shall be four thousand eight hundred (4,800) square feet. (Ord. 201, 1-11-2018)

17.27.050: MINIMUM LOT WIDTH:

The minimum width of any lot or tax parcel shall be forty eight feet (48'). No lot or tax parcel shall be divided or segregated in such a way as to result in any lot or tax parcel falling below either the minimum width or the minimum area. (Ord. 201, 1-11-2018)

17.27.060: MINIMUM SETBACKS:

The minimum setback of main buildings, dwellings and accessory buildings from front and side streets shall be six feet (6'), from adjoining lot boundaries shall be two feet (2'), and from the alley or back boundary of the lot shall be two feet (2'). (Ord. 129, 3-4-1998)
