30 C-1 NEIGHBORHOOD COMMERCIAL DISTRICT

§ 18.30.010 Purpose of district.

The purpose of the C-1 district is to provide locations for convenience shopping facilities serving the residential neighborhoods of Wheatland. The C-1 neighborhood commercial district shall be established in accordance with the commercial designations of the Wheatland comprehensive general plan or any applicable area plan, where analysis of residential population demonstrates that such facilities are required, it is the purpose of the C-1 district to provide for retail and service uses adequate to supply the daily needs of neighborhood residents.

§ 18.30.020 Permitted principal uses.

The following are principal permitted uses in the C-1 district, subject to site plan review as per Chapter 18.67:
A. 
Professional offices;
B. 
Antique, art, music, and hobby stores;
C. 
Cleaning and dyeing establishments;
D. 
Dry goods stores;
E. 
Foodstores;
F. 
Household appliance, radio and TV repair establishments (small scale);
G. 
Restaurants seating less than one hundred persons, including service of alcoholic beverages at tables and a bar;
H. 
Sporting goods stores;
I. 
Barber and beauty shops.

§ 18.30.030 Permitted accessory uses.

The following are the accessory uses permitted in the C-1 district: accessory uses and buildings customarily appurtenant to a permitted use, such as incidental storage facilities subject to Sections 18.60.010 and 18.60.020.

§ 18.30.040 Conditional uses.

The following are conditional uses in the C-1 district, subject to site plan review as per Chapter 18.67:
A. 
Residential uses with the density and setback requirements of the R-3 zone;
B. 
Public and quasi-public buildings and uses, not to include service centers, storage or repair yards, warehouses or similar uses;
C. 
Service stations;
D. 
Social halls, and nonprofit clubs subject to the requirements of Section 18.60.300;
E. 
Plant nurseries;
F. 
Shopping centers, which are subject to all of the following:
1. 
Minimum size of one acre, and
2. 
Placement of the planned development combining district PD zone on the entire project site, and
3. 
Approval of the final site plan by the city council, after review by the planning commission;
G. 
Special schools.
H. 
Massage establishments, provided they meet all of the following criteria:
1. 
Owned by a California Massage Therapy Council certified massage practitioner;
2. 
Employ only persons who are certified by California Massage Therapy Council;
3. 
Will not serve alcoholic beverages on the premises; and
4. 
Will not be open before 8:00 a.m. or after 9:00 p.m.

§ 18.30.050 Height regulation.

The maximum building height shall be thirty-five feet.

§ 18.30.060 Area, lot width, and yards.

The following minimum requirements shall be observed, except where increased for conditional uses and subject to the provisions of Chapter 18.60:
A. 
Minimum lot area: two thousand square feet;
B. 
Minimum lot width: twenty-five feet;
C. 
Depth or Width in Feet of Required Yards.
1. 
Front: none, except that where frontage is in a block which is partially in an R zone, the front yard shall be the same as that required in such R zone;
2. 
Side: none, except that a side yard of an interior lot abutting on an R zone shall be not less than the side yard required in such R zone;
3. 
Rear: fifteen feet, except where a rear yard abuts on an alley, such rear yard may be not less than five feet.

§ 18.30.070 Other conditions.

A. 
Off-Street Parking. Off-street parking is required for uses, as provided in Chapter 18.63.
B. 
Landscaping. All parts of the required front yard except the area used for walks and driveways shall be landscaped as prescribed in Sections 18.60.130, 18.63.100, and 18.63.110.
C. 
Indoor Uses. All uses shall be conducted wholly within a completely enclosed building, except for service stations, off-street parking and loading facilities, plant nurseries, newspaper stands, ice machines and kindred uses. Except for nursery stock, all merchandise shall be stocked indoors. Goods for sale shall consist primarily of new merchandise, and shall be sold at retail on the premises, except for occasional sidewalk or parking lot sales.
