82 APPEALS

§ 18.82.010 Filing time.

Any person aggrieved by an action of the planning commission may take an appeal to the city council by filing a notice of appeal with the city clerk, and the planning commission, within ten days of the planning commission action.

§ 18.82.020 Filing fee.

The notice of appeal filed with the city clerk shall be accompanied by a filing fee, which shall be set by resolution of the city council, and may be amended from time to time.

§ 18.82.030 Record transmittal to council.

Upon receipt of the notice of appeal, the planning commission shall forthwith transmit to the city council all the materials constituting the record upon which the action being appealed was taken.

§ 18.82.040 Public hearing.

A. 
The city council shall cause the matter to be set for a public hearing. At the public hearing the council shall consider the appeal, and the record upon which the appealed action was taken.
B. 
Notice shall be as set forth in Section 18.70.030.

§ 18.82.050 Decisions.

Within forty-five days of the filing of the notice of appeal, the city council shall render its decision on the matter. Failure of the council to render its decision on the matter within forty-five days of the filing of the notice of appeal shall be deemed to be a denial of the appeal, and an affirmation of the action of the planning commission.

§ 18.82.060 Council decision final.

The decision of the city council upon an appeal is final and conclusive as to all things involved in the matter.
