7 Pedestrian, Transit and Decorative Amenities in Commercial Developments

§ 9-2.1370 Intent and Purpose.

The standards set forth in this article are intended to require pedestrian, transit and decorative amenities in new commercial developments. The design and layout of these amenities should be architecturally compatible and harmonious with the proposed commercial developments and any uses and structures on adjacent properties. Creativity, functionality and quality is also encouraged in the design, layout, use and placement of the pedestrian, transit and decorative amenities required by this article.

§ 9-2.1371 Applicable Developments and Zones.

The provisions of this article shall apply to commercial developments in the Commercial General (C-G), Commercial Planned Development (C-P-D), Commercial Transition (C-T) and Mixed Commercial/Low Density Residential (M-C-R) Zones.

§ 9-2.1372 Definitions.

Unless specifically defined below, words or phrases used in this article shall be interpreted so as to give them the meaning they have in common usage and to give this article its most reasonable application.
"Commercial development"
means any manmade change to improved or unimproved private commercial real property, including, without limitation, buildings or other structures.

§ 9-2.1373 Small Commercial Developments.

(a) 
The following outdoor and publicly accessible pedestrian and transit amenities shall be provided in any new commercial development with a gross building size of 20,000 square feet of floor area or less:
(1) 
Bicycle rack; and
(2) 
Trash receptacle, with or without a built-in ashtray.
(b) 
A new commercial development with a gross building size of 20,000 square feet of floor area or less is encouraged, but not required, to provide one or more of the following outdoor and publicly accessible pedestrian and decorative amenities:
(1) 
Drinking fountain;
(2) 
Public seating area, which may include benches, tables and chairs, and may be screened or covered;
(3) 
Water feature or fountain; or
(4) 
Art work or feature, which may be placed in or made a part of a water feature or fountain.
(c) 
Pedestrian, transit and decorative amenities provided as required or encouraged under Subsections (a) and (b) of this section shall be maintained, free from deterioration, blight, disrepair and vandalism.

§ 9-2.1374 Large Commercial Developments.

(a) 
The following pedestrian, transit and decorative amenities shall be provided in any new commercial development with a gross building size of more than 20,000 square feet of floor area:
(1) 
Bicycle rack;
(2) 
Trash receptacle, with or without a built-in ashtray;
(3) 
Public seating area, which may include benches, tables and chairs, and may be screened or covered; and
(4) 
Art work or feature, which may be placed in or made a part of the water feature or fountain.
(b) 
A new commercial development with a gross building size of more than 20,000 square feet of floor area is encouraged, but not required, to provide one or more of the following outdoor and publicly accessible pedestrian, transit and decorative amenities:
(1) 
Drinking fountain;
(2) 
Decorative bus shelter, if a public bus stop is located along the frontage of the commercial development, and to the extent permitted by law and proportional to the demand created by the development; or
(3) 
Static or interactive digital building directory with news and announcements features, listing the names of business tenants and their locations, displaying a building map and providing the opportunity to promote other venues in the City.
(c) 
Pedestrian, transit and decorative amenities provided as required or encouraged under Subsections (a) and (b) of this section shall be maintained, free from deterioration, blight, disrepair and vandalism.
