§ 9-2.901 Front Yards: Special Requirements.

(a) 
Partially Developed Blocks. Where some lots or parcels of land in a block are improved or partially improved with buildings, each lot or parcel of land in such block shall have a front yard depth of not less than the average depth of the front yards of land adjoining on either side. A vacant lot or parcel of land, or a lot or parcel of land having more than the front yard depth required in the zone, shall be considered for this purpose as having a front yard of the required depth.
(b) 
Key Lots. The depth of the required front yard for a key lot or parcel of land shall not be less than the average depth of the required front yard of the adjoining interior lot or parcel of land and the required side yard of the adjoining reversed corner lot or parcel of land.

§ 9-2.902 Side Yards: Special Requirements.

(a) 
Width. Each interior lot or parcel of land with a lot width of 50 feet or less in zones having required side yards shall have side yards as required by the zone, but in no event shall the width of such required side yards be less than three feet.
(b) 
Corner or Reversed Corner Lots. Corner or reversed corner lots and parcels of land shall have side yards as required by the zone; provided, however, in all residential zones and in the C-S-P Zone a required side yard on the street or highway side of the property shall not be less than 10 feet in width.

§ 9-2.903 Accessory Buildings and Structures.

(a) 
Notwithstanding the provisions of this section, any accessory building having an opening more than six feet wide facing an existing or proposed alley shall be located not less than six feet from the property line of such alley.
(b) 
Satellite Antennas and Other Exterior Devices, Equipment and Fixtures.
(1) 
Purpose. The regulations set forth in this paragraph are intended to establish development standards for satellite antennas, roof-mounted air conditioners, heaters or coolers and other similar accessory devices, equipment and fixtures in order to protect the safety of persons from injury caused by the collapse or fall of such equipment and from the interference of such equipment with pedestrians or occupants of the structure. These regulations are not intended to unreasonably delay or prevent the installation, maintenance or use of such equipment, increase the installation cost of such equipment or to preclude reception of an acceptable quality telecommunications signal.
(2) 
A satellite antenna (a circular dish-type antenna or other instrument designed or used for the reception of television or radio communications relayed from earth-orbiting satellites or other transmitting media), roof mounted air conditioning, heating or cooling units, and other similar devices, equipment or fixtures, are an accessory structure in all zones and shall be permitted only if all of the following standards are met:
(i) 
General Development Standards. All satellite antennas, and roof-mounted air conditioning, heating, cooling and other equipment, whether located in residential, commercial, industrial or other zones of the City shall comply with the following general development standards:
(aa) 
Size. The maximum diameter of the structure or equipment shall be 12 feet.
(bb) 
No satellite antenna, air conditioning, heating, cooling or other similar equipment shall be located within the front yard nor located within a required street side landscape area.
(cc) 
Visibility and Screening. The proposed antenna or roof-mounted air conditioning, heating, cooling or other similar equipment shall be located, designed, and installed to minimize visibility from adjoining rights-of-way and properties. In addition, satellite antennas shall be screened from view from any public street.
(dd) 
Wiring. All wiring and cables to or from a satellite antenna or other roof-mounted equipment shall be installed underground in compliance with applicable installation requirements of the Artesia Municipal Code.
(ee) 
Permits. A building or electrical permit, as applicable, shall be obtained prior to installation.
(ii) 
Additional Development Standards for Satellite Antennas in Residential Zones. If the satellite antenna is located in the Agriculture-Single Family Residential (A-1) Zone, Single-Family Residential (R-1) Zone, or the Multiple Residential (M-R) Zone, it shall comply with the following development standards in addition to those standards specified in subparagraph (i) above:
(aa) 
Number. A maximum number of one dish-type satellite antenna shall be permitted per residential or commercial unit.
(bb) 
Height. For a satellite antenna that is greater than one meter (approximately 39 inches) in diameter, it shall be ground mounted, not be located on the roof of the principal structure or accessory residential structure, and shall not exceed a total height of 10 feet. For a satellite antenna, that does not exceed one meter in diameter or any one dimension, it may be affixed to the roof or side of the structure provided it does not extend above the roof-line of the structure and is not visible from any public or private street.
(cc) 
Setbacks. The following setbacks shall be required and shall be measured from the property line to the center of the satellite dish:
(A) 
Minimum rear yard setback shall be 10 feet;
(B) 
Minimum interior side yard setback shall be 10 feet;
(C) 
Minimum street side yard setback shall be 15 feet; and
(D) 
No satellite dish antenna shall be located within the front yard.
(iii) 
Additional Development Standards for Air Conditioning, Heating, Cooling and Other Roof-Mounted Equipment in Residential Zones. If the air conditioning, heating, cooling or other equipment is located in the Agriculture-Single Family Residential (A-1) Zone, Single-Family Residential (R-1) Zone, or the Multiple Residential (M-R) Zone, it shall not be roof-mounted as part of any new construction of a residential structure. Such equipment may be roof-mounted on a pre-existing residential structure if it is located, designed and installed so as to minimize its visibility from any public or private street or adjoining property.
(3) 
Administrative Variances. A variance to the requirements of this subsection (b) may be granted by the Planning Director for the location and dimensions of a satellite antenna if he or she determines that the variance is required in order for the applicant to attain reasonable television or radio reception at that location and the procedures and criteria for the grant of administrative variances set forth in Section 9-2.1705 of this chapter have been satisfied. All other variances to the requirements of this section shall be applied for as provided in Article 17 of this chapter.

§ 9-2.904 Fences, Walls, Signs, and Landscape Elements.

In addition to the accessory buildings permitted by the provisions of Section 9-2.903 in this article, the following structures may be erected or projected into any required yard:
(a) 
Fences and walls, as set forth in Article 14 of this chapter;
(b) 
Signs, as set forth in Article 12 of this chapter; and
(c) 
Landscape elements, including trees, shrubs, and other plants.

§ 9-2.905 Projections.

The following projects may extend into a required front or rear yard a distance not to exceed six feet provided such projects do not approach within two and one-half (2 1/2) feet of any front, side, or rear property lines:
(a) 
Cornices, eaves, belt courses, sills, buttresses, and other similar architectural features;
(b) 
Fireplace structures and bays, not wider than eight feet measured in the general direction of the wall of which it is a part, provided such fireplace or bay does not project more than three feet into any required front or rear yard setback;
(c) 
Open and unenclosed fire escapes, balconies, stairways, and door stops;
(d) 
Awnings; and
(e) 
Planting boxes and masonry planters not to exceed a height of 42 inches.

§ 9-2.906 Distances Between Buildings.

A minimum distance of six feet shall be required between all main residential buildings established on the same lot or parcel of land.

§ 9-2.907 Building Lines.

In all zones, building lines are hereby established parallel to the center line of every major and secondary highway, parkway, and street equal to the setback, if any, otherwise required by the provisions of this chapter or any other law of the City, plus:
(a) 
Fifty feet from the center line of every major highway;
(b) 
Forty feet from the center line of every secondary highway;
(c) 
The distance required for local streets as provided in this chapter; and
(d) 
One half the planned ultimate width of all streets pursuant to the standards set forth in Chapter 3 of this title relating to subdivisions. The Commission shall designate the distance from the center line in the event such ultimate width is not specified.
