Open Space and Recreation OS-R

§ 9-2.3101 Intent and Purpose.

The Open Space and Recreation (OS-R) Zone is established to provide for the continued availability of open space land for outdoor recreational uses and public facilities. The OS-R Zone provides areas for recreational activity and open space needs, including open space for flood control purposes, and passive recreation. This district allows for recreational development of land and necessary public facilities.

§ 9-2.3102 Principal Uses Permitted (OS-R).

The following uses are allowed in the OS-R Zone as principally permitted uses:
(a) 
Arboretums;
(b) 
Athletic fields, excluding stadiums;
(c) 
Cultural heritage sites and historic monuments;
(d) 
Existing easements for underground pipelines and utilities;
(e) 
Grading, if less than 1,000 cubic yards;
(f) 
Parking lots accessory to a principal use permitted in this zone or accessory to a principal use permitted in the Historic District (H-D) Zone. Such parking lots shall meet the requirements of Article 11 of the Zoning Ordinance;
(g) 
Parks and playgrounds including normal appurtenant facilities.

§ 9-2.3103 Accessory Uses Permitted (OS-R).

The following accessory uses and structures are permitted in the OS-R Zone, provided that such uses are established on the same lot or parcel of land as the permitted principal use, and that such accessory uses are incidental to, and do not substantially alter the character of, the principal use:
(a) 
Accessory buildings not more than 400 square feet in area, not for human occupancy;
(b) 
Antennas, for receiving, relaying and transmitting signals relative to emergency services;
(c) 
Pedestrian and vehicular safety control boxes and devices;
(d) 
Structures for the provision of public utility service to permitted principal uses.

§ 9-2.3104 Uses Permitted Subject to Conditional Use Permit (OS-R).

Premises in the OS-R Zone may be used for the following purposes, provided a conditional use permit has first been obtained, pursuant to the provisions of Article 17 (Variances and Conditional Use Permits):
(a) 
Communication equipment buildings serving other than the permitted uses listed in this article;
(b) 
Community centers, its primary function being recreational use;
(c) 
Electric distribution and transmission substations;
(d) 
Governmental offices;
(e) 
Grading of 1,000 cubic yards or more;
(f) 
Public libraries;
(g) 
Public museums;
(h) 
Water storage tanks;
(i) 
Wireless telecommunication facility sites, antennas and monopoles, in accordance with the development standards contained in Article 42 of this chapter.

§ 9-2.3105 Development Standards.

Premises in the OS-R Zone shall be subject to the development standards prescribed in this section and those standards contained in Articles 6 through 15 of this chapter, to the extent not inconsistent with the provisions herein:
(a) 
Lot Area. Each lot or parcel of land created after the adoption of this article (March 8, 1999), shall have a minimum lot area of not less than 6,000 square feet.
(b) 
Lot Width and Frontage. Each lot or parcel of land created after the adoption of this article (March 8, 1999), shall have a lot width and street frontage that is adequate for the proposed use, will allow the proposed use to comply with the required yard setbacks as specified in Subsection (c) below, provides sufficient access to the street, and is of sufficient dimensions to allow for its conversion to other uses.
(c) 
Required Yards.
(1) 
Front Yard. Each lot or parcel of land in the OS-R Zone shall have a front yard of not less than 20 feet in depth.
(2) 
Side Yard. Each lot or parcel of land in the OS-R Zone shall have a side yard of not less than 10 feet in depth, except that where a public facility abuts single-family residentially zoned property, a minimum of 15 foot building setback shall be required from the property line.
(3) 
Rear Yard. Each lot or parcel of land in the OS-R Zone shall have a rear yard of not less than 20 feet in depth, except where a public facility abuts single-family residentially zoned property, a minimum 25 foot building setback shall be required from the property line.
(d) 
Height. No primary structures in Zone OS-R shall exceed 20 feet in height. Accessory structures shall be limited to one story and 12 feet in height.
(e) 
Signs. Each lot or parcel of land may have signs pursuant to and in accordance with the provisions relating to signage in commercial zones as provided in Article 12 (Signs) of this chapter.
(f) 
Air Conditioner Unit(s). The installation, placement and location of air conditioner unit(s), including window, wall and rooftop units, shall comply with the following standards:
(1) 
Window and wall air conditioning units shall not be located: (i) in or facing the front yard; or (ii) in or facing a side yard of a corner lot that is adjacent to a street.
(2) 
Rooftop air conditioner units shall be screened from public view with a parapet wall or other screening structure and which is designed to match the existing roof architecture, color and materials to the maximum extent practicable.

§ 9-2.3106 Uses Exempt From Regulation.

Capital improvement projects, park improvement projects, and open space trails are not required to adhere to the regulations of this chapter. Capital improvement projects, park improvements, and open space trails are exempt if it is consistent with an approved park general development plan or general plan land use designation.
