ARTICLE XIII

Special Exceptions

§ 450-50 Authorization to grant or deny special exceptions.

A. 
A special exception listed in this chapter may be permitted, enlarged or altered upon authorization by the Zoning Hearing Board in accordance with standards and procedures of this chapter.
B. 
In permitting a new special exception or the alteration of an existing special exception, the Zoning Hearing Board may impose, in addition to those standards and requirements expressly specified by this chapter, additional conditions which the Zoning Hearing Board considers necessary to protect the best interests of the surrounding area or the Borough as a whole. These conditions may include but are not limited to the following:
(1) 
Increasing the required lot size or yard dimension.
(2) 
Limiting the height, size or location of buildings.
(3) 
Controlling the location and number of vehicle access points.
(4) 
Increasing the street width.
(5) 
Increasing the number of required off-street parking spaces.
(6) 
Limiting the number, size, location, type and lighting of signs.
(7) 
Requiring diking, fencing, screening, landscaping or other facilities to protect adjacent or nearby property.
(8) 
Designating sites for open space.

§ 450-51 Application for special exception.

A. 
Special exceptions as listed in this chapter shall be granted only after application by an applicant to the Zoning Hearing Board. Such application shall require individual consideration in each case because of their unique characteristics. Such requests for special exceptions may be referred to the Planning Commission in the discretion of the Zoning Hearing Board for review and recommendation and such exceptions may be permitted only upon authorization by the Zoning Hearing Board subject to certain conditions and safeguards as provided in this chapter. Such special exceptions which are authorized by the Zoning Hearing Board shall be subject to any additional conditions and safeguards established by the Zoning Hearing Board in each case which may be warranted by the character of the areas in which such uses are proposed and by other special factors which are necessary to implement the purposes and statement of community objectives in this chapter.
B. 
A special exception shall not cause substantial injury to the value of other property where it is located, shall conform with regulations applicable to the district where located, shall be compatible with adjoining development, shall provide adequate landscaping and screening to protect adjoining areas, shall provide off-street parking and loading so as to minimize interference with traffic on the local streets, and any required or permitted sign shall be compatible with adjoining development and such special exceptions shall not jeopardize the public health, safety, welfare and convenience. Special exceptions shall be granted only if appropriate to the character of the district and neighborhood in which it is proposed and with the presence of other conforming uses located in the area and also with the area which the use will serve. Applicants for special exceptions shall submit plans in sufficient detail to provide the Zoning Hearing Board with enough information to properly evaluate the proposed planned use.
