Highway Commercial "H-C" District Route 6 Corridor

§ 450-31 Purpose.

The purpose of the H-C Highway Commercial District is to establish reasonable standards for the development of a commercial district oriented to use by shoppers arriving and leaving by means of automobile. Permitted uses should reflect transient services. Standards are designed to minimize traffic congestion and promote the health, safety and welfare of the public.

§ 450-32 Permitted and accessory uses.

A. 
Permitted uses.
(1) 
Automobile service stations, automobile show rooms and sales lots, hotels, motels, restaurants, drive-in restaurants, supermarkets, theaters, laundromats, and drugstores.
(2) 
Other uses similar in character to those enumerated above.
(3) 
The above specified stores, shops and businesses shall be retail establishments exclusively and shall be permitted only under the following conditions:
(a) 
Such uses, operations and products shall not be objectionable due to odor, dust, smoke, noise, vibration or other similar causes.
(b) 
There shall be no manufacture, compounding, processing or treatment of products other than that which is clearly incidental and essential to a retail store or business and when all such products are sold at retail on the premises.
(4) 
Residential uses are permitted when in compliance with Article IV of this chapter, with the exception of § 450-16.
B. 
Accessory uses. Accessory uses and buildings customarily incidental to the above permitted uses.

§ 450-33 Requirements.

The following standards shall be applicable to the Highway Commercial District:
A. 
Setback requirements shall be as follows:
(1) 
A setback of 27 feet from the edge of the right-of-way of the existing highway (U.S. Route 6), when parking will be provided in front of the business.
(2) 
A setback of 17 feet from the edge of the right-of-way of the existing highway (U.S. Route 6), when parking will be provided in the back of the business.
B. 
Landscaping. The frontage between the existing highway and parking lots shall be landscaped and maintained with grass, trees and shrubs.
C. 
Parking.
(1) 
Parking areas shall be laid out in a uniform pattern but not less than 12 feet from the edge of the highway.
(2) 
Parking areas shall be curbed for their entire perimeter excepting access drives. In no case shall parking lots be permitted which allow patrons to back their vehicles onto a highway.
D. 
Driveways.
(1) 
Access shall be by not more than two driveways for each 100 feet of street frontage.
(2) 
Driveways shall not cross the street right-of-way within five feet of a fire hydrant, catch basin or drain inlet.
(3) 
Driveways shall not cross the street right-of-way within 40 feet of another driveway on the same lot; excepting, in the case where dual access drives are deemed necessary to permit safe ingress and egress, these dimensions may be reduced to not less than 12 feet between two access drives.
(4) 
Driveways shall not cross the street right-of-way in this district within 20 feet of a property line unless two adjoining property owners mutually agree in a legally recorded instrument to a common driveway.
(5) 
Visibility at driveway entrances shall not be restricted by the placement of signs or landscaping.
E. 
Submission of plan. A scale drawing of proposed off-street parking and loading areas, access drives, walks and landscaping shall be submitted as part of the required site plan. Any plan requiring access onto a highway shall be approved by the Pennsylvania Department of Transportation in addition to the Borough Council's approval.
