The Zoning Hearing Board shall be established pursuant to the provisions of the Pennsylvania Municipalities Planning Code, Act of 1968, P.L. 805, No. 247, as reenacted and amended.
§ 450-53 Membership.

The membership of the Board shall consist of five residents of Coudersport Borough, appointed by Borough Council. Their terms of office shall be five years and shall be fixed that the term of office of one member of the Board shall expire each year.
The Board shall promptly notify Borough Council of any vacancies which occur. Appointments to fill vacancies shall be only for the unexpired portion of the term. Members of the Board shall hold no other office in the Borough.
Borough Council shall appoint by resolution at least one but not more than three residents of the Borough to serve as alternate members of the Board. The term of office of an alternate member shall be three years.
If, by reason of absence or disqualification of a member, a quorum is not reached, the Chairperson of the Board shall designate as many alternate members as needed to provide a quorum. Any alternate member shall continue to serve on the Board in all proceedings involving the matter or case for which the alternate was initially appointed until the Board has made a final determination of the matter or case. Determination of an alternate pursuant to this section shall be made on a case-by-case basis in rotation according to descending seniority among the alternates.
§ 450-54 Hearings.

Whenever an applicant seeking a variance, special exception or other relief requiring action by the Coudersport Borough Zoning Hearing Board ("Zoning Hearing Board") shall receive notice of a hearing before the Zoning Hearing Board, said applicant shall, at applicant's cost and expense:
Cause notice of said hearing and the subject and nature of relief requested to be served upon all property owners of record within the surrounding neighbors whose property adjoins the property subject of said application not less than seven nor more than 30 days prior to the date set for hearing.
Provide proof satisfactory to the Zoning hearing Board of said notice at the time and place of the first hearing on the application. No notice shall be required as to continued or subsequent hearings thereon.
The Zoning Hearing Board shall consider as satisfactory proof of notice that service shall have been made by personal service, first class or certified mail.
§ 450-55 Costs of hearings.

In addition to the filing fee set forth in this chapter, § 450-73D, the applicant for a variance, special exception or other matter requiring action by the Coudersport Borough Zoning Hearing Board shall be responsible for and pay the following costs and expenses:
The costs of any stenographic transcript of hearing(s) when said transcript is requested by the applicant or the applicant appeals the decision of the Zoning Hearing Board.
Such other costs and expenses as are permitted to be imposed upon applicants as are authorized by or provided by current applicable law or as may be authorized or permitted by later act of the state legislature.
