CHAPTER 6

MULTIPLE-FAMILY RESIDENTIAL DISTRICTS

10-6-1: PURPOSE:

The RM-1 and RM-2 Multiple-Family Residential Districts are designed to provide sites for multiple dwelling structures which will generally serve as zones of transition between the nonresidential districts and lower density single-family districts. The multiple dwelling is further provided to serve the limited needs for the apartment type of unit in an otherwise single-family residential community. (Ord. 482, 4-7-1982)

10-6-2: PRINCIPAL USES PERMITTED:

In a Multiple-Family District, no building or land shall be used and no building shall be erected except for one or more of the following specified uses, unless otherwise provided in this Title: (Ord. 482, 4-7-1982)
   (A)   All principal uses permitted and as regulated in the R-1 through R-4 Residential Districts with the lot area, yards and floor area requirements equal to the requirements of the immediately abutting residential district. (Ord. 482-O, 8-14-1996)
   (B)   Multiple-family dwellings.
      Row Houses
      Terraces
      Apartments
   (C)   Accessory buildings and uses customarily incident to any of the above permitted uses. (Ord. 482, 4-7-1982)

10-6-3: SPECIAL USES:

The following uses may be permitted subject to the conditions herein imposed and subject to the review and approval of the site plan and the use by the Village Board after a hearing and recommendation is received from the Zoning Board for each use:
   (A)   Nursery schools, day nurseries, and child care centers (not including dormitories); provided that for each child so cared for there is provided and maintained a minimum of one hundred (100) square feet of outdoor play area. Such play space shall have a total minimum area of at least one thousand (1,000) square feet, and shall be screened from adjoining residential land with an obscuring wall or fence six feet (6') in height. Any use permitted shall not be permitted in the interior of any residential block.
   (B)   General hospitals, except those for criminals and those solely for the treatment of persons who are mentally ill or have a contagious disease, when the following conditions are met:
      1.   A site plan layout showing the hospital site with building location, drives, service areas, parking, landscape screening, and other physical features shall be submitted for review.
      2.   All such hospitals shall be developed only on sites consisting of at least two (2) acres in area.
      3.   The proposed site shall have at least one property line abutting a major thoroughfare.
      4.   The minimum distance of any main or accessory building from bordering lot lines or streets shall be at least fifty feet (50') for front, rear, and side yards for all two (2) story structures. Where a street borders a yard, one-half (1/2) the street width may be used in computing the yard setback bordering such street; however, in no instance shall a yard setback of less than thirty feet (30') be provided. For every story above two (2) the minimum yard distance shall be increased by at least five feet (5') for each additional story.
      5.   Ambulance and delivery areas shall be obscured from all residential view with an obscuring wall or fence six feet (6') in height. Ingress and egress to the site shall be directly from a major thoroughfare.
      6.   All ingress and egress to the off-street parking area, for guests, employees, staff, as well as any other uses of the facilities, shall be directly from a major thoroughfare.
   (C)   Housing for the elderly, when the following conditions are met:
      1.   All housing for the elderly shall be provided as a planned development and shall provide for the following:
         (a)   Cottage type dwellings and/or apartment type dwelling units.
         (b)   Common services containing, but not limited to, central dining rooms, recreational rooms, central lounge, and workshops.
      2.   All dwellings shall consist of at least two hundred fifty (250) square feet per unit.
      3.   The minimum requirements of the "Schedule of Regulations 1 " for the district in which such use is located shall control lot coverage, yard setbacks, and other site aspects.
   (D)   Convalescent homes when the following conditions are met:
      1.   The site shall consist of at least one acre.
      2.   The maximum coverage shall not exceed twenty five percent (25%) for all buildings including principal structures and those incident to the principal structure.
      3.   The minimum requirements of the "Schedule of Regulations 2 " for the district in which such use is located shall control lot coverage, yard setbacks and other site aspects.
   (E)   Multiple-family dwellings exceeding two and one-half (21/2) stories or twenty five feet (25') in height in the RM-2 District only, when the following conditions are met:
      1.   The building will meet the fire safety requirements of the fire protection code and life safety code.
      2.   The Creve Coeur Fire Department, after reviewing the plans, certifies to the Village Board that it can provide a reasonable level of fire fighting and rescue capability, considering the location, construction and height of structure.
      3.   Village sewer and water facilities at the proposed location are adequate to meet the needs of existing uses served by those facilities as well as the needs generated by the proposed high-rise structure.
   (F)   Accessory buildings and uses customarily incident to any of the above uses.
   (G)   Modular dwellings. (Ord. 482, 4-7-82; amd. Ord. 550, 5-10-95; Ord. 955, 2-23-2022)

10-6-4: AREA AND BULK REQUIREMENTS:

See Section 10-12-3 of this Title, Schedule of Regulations, limiting the height and bulk of buildings, the minimum size of lot permitted by land use, and the maximum density permitted. (Ord. 482, 4-7-82)

10-6-5: SITE PLAN REVIEW:

All principal uses permitted and involving more than one building on a parcel to be developed and all special uses in this Chapter shall be permitted only after review and approval of the site plans for such uses by the Zoning Board. Subsequent development of the site shall comply with the approved site plan. Such review of the site plan is required in order to minimize the possibility of adverse effects upon adjacent property; and furthermore to develop proper relationships between development features as they relate to traffic, safety, driveways, and parking areas, and also to properly relate principal buildings, accessory buildings and uses, and open spaces to one another, and to the traffic pattern within and surrounding such development.
