§ 155.260 PURPOSE.

   The purpose of the planned unit development zone (PUD) is to permit flexibility in the design and development of larger tracts of land that are in common ownership or control.

§ 155.261 STANDARDS AND REQUIREMENTS.

   Approval of request for a PUD zone is dependent upon the submission of an acceptable plan and satisfactory assurance that it will be carried out. Such a plan should accomplish substantially the same general objectives for the area as set forth by the comprehensive plan. In addition, the following standards and requirements shall apply.
   (A)   Use. A use permitted in any zone is permitted in a PUD zone.
   (B)   Area. The minimum area shall be three acres.
   (C)   Housing density. Standards for housing density shall not exceed the density indicated in the comprehensive plan.
   (D)   Performance bond. The City Council may require a performance bond to ensure that the proposed development is completed as approved and within the time limits agreed to.
   (E)   Use, setback, height. The following shall apply in any particular zoning district.
      (1)   Use. The development shall include no uses not permitted in that particular zoning district.
      (2)   Height. No structure shall exceed the height limits for the district.
      (3)   Number of units. The overall number of dwelling units shall be no greater than would have been permissible in the tract had it been divided into lots of the appropriate size.
      (4)   Setbacks. Appropriate setbacks shall be observed on the boundaries of the tract.

§ 155.262 PROCEDURE.

   The following procedure shall be followed in requesting a PUD zone.
   (A)   Submissions of plan.
      (1)   Number of copies. An applicant shall submit to the Planning Board four copies of a plan for development of the property.
      (2)   Submission deadline. The plan shall be submitted at least 30 days prior to the meeting at which time it will be considered.
      (3)   Required information. The plan shall show the following information:
         (a)   Relationship of the proposed development to the comprehensive plan;
         (b)   The relationship of the property to the surrounding area;
         (c)   The plan of subdivision or resubdivision, if any;
         (d)   Land uses, building location and number of dwelling units;
         (e)   The arrangement of streets and pedestrian-ways;
         (f)   The location of off-street parking spaces;
         (g)   The location of public or communal open spaces;
         (h)   Plans for site grading and landscaping;
         (i)   Plans for water supply, sewage disposal and stormwater drainage;
         (j)   Plans for transfer of ownership of the property, if any, and arrangements for maintenance of common areas and facilities; and
         (k)   Such additional information as the Planning Board may request.
   (B)   Review criteria. In considering the plan, the Planning Board shall determine that:
      (1)   There are special development objectives or physical conditions which justify a request for a PUD zone;
      (2)   The plan of development will be consistent with the comprehensive plan;
      (3)   The development will be in harmony with the area around it;
      (4)   The development can be completed within a reasonable period of time;
      (5)   The development will not overload adjacent streets or utilities; and
      (6)   There is a demand for the type of development proposed.
   (C)   Decision of Board. The Planning Board shall notify the applicant whether in its judgment the foregoing provisions have been satisfied and, if not, whether they can be satisfied with further revision of the plan.
