ZONING COMMISSION

§ 155.320 CREATED.

   There is hereby created for the city a Zoning Commission, consisting of the City-County Planning Board, pursuant to M.C.A. § 76-1-108. The City-County Planning Board shall function as the Zoning Commission as authorized under M.C.A. § 76-2-307.

§ 155.321 POWERS AND DUTIES.

   The duties and powers of the Zoning Commission shall be to recommend the boundaries of the various original districts and appropriate regulations to be enforced therein, and to hold public meetings and make recommendations to the City Council on all requests to amend, supplement, change, modify or repeal the regulations, restrictions and boundaries in zoning districts. The City Council shall not hold its public hearing or take action until it has received a final report from such Commission.

§ 155.322 PURPOSE.

   A City Zoning Commission is established to consider and make recommendations to the Council on all petitions for a change in zone district classification.

§ 155.323 WRITTEN FINDINGS.

   In making its recommendations, the Commission shall, where applicable, submit in writing findings of fact on the following:
   (A)   The nature of the proposed use and its potential impact on adjacent properties;
   (B)   The adequacy of ingress, egress, parking, lighting, landscaping and screening;
   (C)   Whether the proposed zone change is in accordance with the comprehensive plan and the intent of this chapter;
   (D)   Protest petitions, if any; and
   (E)   Such other factors as the Commission may deem pertinent to the petition.
