AG AGRICULTURAL

DISTRICT

§ 155.030 PERMITTED USES.

   In AG Agricultural Districts, no building or premises shall be used and no building shall be hereafter erected or structurally altered except for one of the following purposes:
   (A)   Churches, schools, colleges, convalescent homes, nursing homes, retirement homes, hospitals and similar facilities, but not to include apartment houses;
   (B)   Commercial mines, quarries, sand and gravel pits;
   (C)   Facilities necessary for the provision of transportation, communication, water, sewerage, electrical energy and natural gas pipelines and their necessary appurtenances;
   (D)   Home occupations;
   (E)   Living quarters for persons employed on the premises;
   (F)   Recreation facilities, including campgrounds owned or operated by either public or private sectors of the economy;
   (G)   Roadside stands for the sale of products grown on the premises;
   (H)   Rodeo grounds, fairgrounds, riding academies, dude ranches and other farm and ranch-type recreational enterprises, golf courses, country clubs, but not including automotive race tracks or driving tracks, golf driving ranges, outdoor theaters and similar commercial recreation enterprises;
   (I)   Signs identifying the property or the activity engaged in or on the property;
   (J)   Wells; and
   (K)   Accessory buildings and uses customarily incident to the uses permitted in this district.

§ 155.031 CONDITIONAL USES.

   The following uses are permitted in the AG Agricultural District after a finding by the Board of Adjustment that their mode of conduct and location will not hinder the enjoyment and use of nearby properties and will not disrupt the appropriate use of land and resources and will not be contrary to the public interest:
   (A)   Airport or landing strips, provided:
      (1)   They do not endanger the immediate area; and
      (2)   They meet all state and federal regulations.
   (B)   Amusement parks, carnivals, circuses;
   (C)   Cemeteries, crematories, mausoleums; and
   (D)   Race tracks or driving tracks.

§ 155.032 BUILDING HEIGHT LIMIT.

   There shall be no height regulations except as may be set forth for airport zoning.

§ 155.033 AREA REGULATIONS.

   Subject to the modifications set forth in §§ 155.240 through 155.245, the area regulations are as follows.
   (A)   Minimum site area.
      (1)   There shall be a lot of not less than five acres.
      (2)   A lot having an area less than herein required which was recorded under separate ownership from adjoining lots at the effective date hereof may be occupied by a one-family dwelling or by any nonresidential use permitted in this district.
   (B)   Minimum front yard. Measured from the edge of the right-of-way of each and every road, there shall be a front yard setback of not less than 50 feet.
   (C)   Minimum rear yard. Measured from the rear property line, every principal building shall be set back from the property lines one foot for each foot of height of the structure, but in no event less than ten feet.
   (D)   Minimum side yards. Measured from the side property lines, every principal building shall be set back from the property lines one foot for each foot of height of the structure, but in no event less than ten feet.
   (E)   Accessory structures. All accessory structures used for the purpose of housing, keeping or sheltering livestock or fowl shall be set back a distance of 100 feet from any property line and 50 feet from any dwelling.
