R-1 ONE-FAMILY

RESIDENTIAL DISTRICT

§ 155.060 PERMITTED USES.

   In R-1 One-Family Residential Districts, no buildings or premises shall be used and no building shall be hereafter erected or structurally altered except for one of the following purposes:
   (A)   Accessory buildings and uses customarily incident to the uses permitted in this district;
   (B)   Domestic animals, provided such animals are household pets and noncommercial kennels;
   (C)   Fences, hedges and walls, provided such uses are located where they will not obstruct motorists’ vision at street intersections, and subject to requirements set forth in §§ 155.240 through 155.245;
   (D)   Home occupations, provided that not more than 25% of the dwelling is used for such purposes;
   (E)   One-family dwellings; and
   (F)   Public parks and playgrounds, community centers only if owned by a public agency or a neighborhood or homeowners’ association, public golf courses, public schools, private educational institutions having the same curriculum as ordinarily given in public schools and other public buildings and other recreational facilities.

§ 155.061 CONDITIONAL USES.

   The following uses are permitted in the R-1 One-Family Residential District after a finding by the Zoning Commission that their mode of conduct and location will not hinder the enjoyment and use of nearby properties and will not disrupt the appropriate use of land and resources:
   (A)   Cemeteries;
   (B)   Churches;
   (C)   Colleges;
   (D)   Electric substations, provided:
      (1)   For each electric substation where transformers are exposed, there shall be an enclosing, nonclimbable, sight obscuring fence at least six feet high; and
      (2)   The height requirements may be exceeded, provided that for each additional one foot of height an additional one foot of front, rear and side yard shall be required.
   (E)   Fire stations and police stations;
   (F)   Nursing homes and hospitals, provided the state and local health jurisdictions approve the locations;
   (G)   Signs subject to requirements set forth in §§ 155.240 through 155.245; and
   (H)   Water reservoirs, water storage tanks, water pumping stations and sewer lift stations, provided:
      (1)   For each instance, the applicant shall provide the Board of Adjustment with plot plans showing the proposed installation and its relationship to any nearby property; and
      (2)   The Board of Adjustment shall prescribe conditions as to setbacks and the like for each installation.

§ 155.062 BUILDING HEIGHT LIMIT.

   Except as provided in §§ 155.240 through 155.245, the height regulations are as follows.
   (A)   No dwelling shall exceed two and one-half stories or 35 feet in height.
   (B)   No other structure shall exceed three stories or 45 feet in height.

§ 155.063 AREA REGULATIONS.

   Subject to the modifications set forth in §§ 155.240 through 155.245, the area regulations are as follows.
   (A)   Minimum lot area.
      (1)   A lot upon which there is erected a structure shall not contain less than 7,500 square feet unless it is not served by public sewer or water, in which case the minimum shall be 20,000 square feet if served by one central system.
      (2)   A lot having an area less than herein required which was recorded under separate ownership from adjoining lots at the effective date hereof may be occupied by a one-family dwelling or by any nonresidential use permitted in this district.
   (B)   Minimum lot frontage. There shall be a minimum lot frontage of not less than 50 feet for one-family dwellings and 75 feet for other principal structures.
   (C)   Minimum front yard. Measured from the front property line, there shall be a front yard of not less than 20 feet. If more than 40% of the block is developed existing frontages can be used.
   (D)   Minimum rear yard. Measured from the real property line, every principal structure shall have a rear yard of not less than 20 feet and for every accessory building there shall be a rear yard of not less than five feet.
   (E)   Minimum side yards. Measured from the side property line there shall be side yards of not less than five feet on each side of a lot.

§ 155.064 RESTRICTIONS.

   (A)   Structures.
      (1)   No accessory building permitted without a one-family residence existing, if the residence is dismantled and accessory buildings exist the penalty shall be as prescribed in § 10.99; and
      (2)   After 90 days of notice by city of this violation or until the accessory buildings are dismantled or a new residence has been restored to the property.
   (B)   Minimum size structure. A new residence must be a minimum of 800 square feet.
