CHAPTER 1264

R-3 Multiple-Family Residential District

1264.01 PURPOSE.

   The R-3 Multiple-Family Residential District is created to provide for a variety of housing types to include garden apartments, townhouses, condominiums, or other housing facilities of a similar character and density and in those areas suitable for such developments within the Village. This district may be used only when public sewer and water services are available or when water and adequate sewage treatment plants are provided.

1264.02 PERMITTED USES.

   In an R-3 District, Multiple-Family Residential, no land or building shall be used or changed in use and no building shall be located, erected, or structurally altered, unless otherwise provided herein, except for one or more of the following:
   (a)   Two-family dwellings.
   (b)   Multiple-family dwellings.
   (c)   Zero lot line single-family dwellings. Units must be constructed in pairs which share no more than one common wall along a single side lot line.
   (d)   Churches, provided it shall be located not less than 75 feet from any lot in all Residential Districts, as set forth in Section 1256.03.
   (e)   Accessory uses clearly incidental and customary to the operation of the above uses shall be permitted.
   (f)   Home occupations as set forth in Section 1287.11.
   (g)   All other uses permitted in accordance with State and Federal laws.

1264.03 CONDITIONALLY PERMITTED USES.

   In an R-3 District, the following uses shall be classed as conditionally permitted uses, and may be permitted by the Planning Commission with the consent of Council or Council without the consent of the Planning Commission and subject to the conditions noted in Chapter 1250:
   (a)   Golf course and country club as set forth in Section 1256.03.
   (b)   Park and playgrounds as set forth in Section 1256.03.
   (c)   Professional office building or clinic for medical or dental purposes.
   (d)   Child care or adult care facilities with more than seven persons as set forth in Section 1287.10.
   (e)   Wireless telecommunication towers, wireless telecommunication facilities, and wireless telecommunication shelters as set forth in Section 1287.16.
   (f)   Any other uses similar in nature as determined by the Planning Commission with the consent of Council or Council without the consent of the Planning Commission.

1264.04 BUILDING HEIGHT LIMIT.

   No residential building shall hereafter be erected or structurally altered to a height exceeding 40 feet in height.

1264.05 EXCEPTIONS TO HEIGHT LIMITS.

   The height limitations of this chapter shall not apply to church spires, belfries, cupolas and domes not intended for human occupancy; monuments, water towers, transmission towers, chimneys, smoke stacks, derricks, conveyors, flagpoles, radio/ communication towers, masts, and aerials. Such uses shall be approved by the Board of Zoning and Building Appeals.

1264.07 REQUIRED YARDS

   (a)   Two-Family Dwelling.
      (1)   Front yard: 35 feet.
      (2)   Side yard: 10 feet.
      (3)   Rear yard: 40 feet.
   (b)   Multiple-Family Dwelling.
      (1)   Front yard: 40 feet.
      (2)   Side yard: Equal to one-half the height of the building but not less than 10 feet.
      (3)   Rear yard: 40 feet .
   (c)   Corner Lot Yards: The minimum building setback line on any street not having lots fronting upon it shall be 30 feet from the required right-of-way line or easement line. Where the street on the side of a corner lot has lots fronting upon it within the same block on the same side of the street, the building setback on the side of the corner lot shall conform to the setback requirements of such street.
   (d)   Yards for Public and Semipublic Buildings: All public and semipublic buildings, including accessory buildings, shall provide the same front yard as required for all other buildings in the district. There shall be a minimum side yard clearance for such buildings of 100 feet from any lot line.

1264.08 MINIMUM GROSS FLOOR AREA PER DWELLING UNIT.

   Within the R-3 Multiple-Family Residential District, no building shall be erected, reconstructed or converted for a dwelling use unless the following minimum gross floor area per dwelling unit is provided:

1264.09 ACCESSORY STRUCTURES.

   All accessory structures not attached to the principal structure shall be set back 20 feet from the principal building and not be located less than 5 feet from the side/rear lot lines.

1264.10 PERCENTAGE OF LOT COVERAGE.

   All buildings, including accessory buildings, shall not cover more than 30% of the area of the lot.

1264.11 MINIMUM RECREATIONAL SPACE.

   (a)   A minimum of 10% of the gross land area shall be usable recreational space. The recreational space shall be counted as a part of the required livable open space. Recreational areas shall be located a minimum distance of 20 feet from all principal buildings.
   (b)   The recreational space can include open space for both passive and active recreation. Passive recreation facilities might include common sitting areas in the form of sundecks or garden areas. Active recreation areas may include swimming pools, tennis courts, shuffleboard courts, playgrounds and play fields, or tot lots.

1264.12 DISTANCE BETWEEN BUILDINGS ON THE SAME LOT.

   No principal building shall be closer to any other principal building than the average of the heights of such buildings.

1264.13 REQUIRED COURT DIMENSIONS.

   (a)   Outer Courts. The width of any court shall be not less than the average height of the walls forming such a court. The depth of an outer court formed by walls on 3 sides shall not be greater than 11/2 times the width.
   (b)   Inner Courts. The least dimension of an inner court shall be not less than 40 feet. An open and unobstructed passageway shall be provided at the grade level of each inner court. Such passageway shall have a cross section area and sufficient headroom to permit the passage of fire fighting equipment and shall be continuous from the inner court to a yard or an unobstructed open area between buildings.

1264.15 BUFFER YARDS.

   No building shall be located closer than the height of the principal building from each side or rear property line which adjoins any other district line.

1264.16 OFF-STREET PARKING AND LOADING.

   See Chapter 1290 for off-street parking and loading requirements. The exception to this requirement shall be in the case of a senior citizen (62 years or older) development, in which case the requirement shall be one-half of the standard parking requirements.
