CHAPTER 1280

IP Industrial Park District

1280.01 PURPOSE.

   The purpose of the IP Industrial Park District is to encourage in appropriate locations the development of industrial subdivisions which will be characterized by a park-like openness with attractive modern buildings set in an appropriate landscaped environment. Industries located therein shall be harmoniously integrated with each other and compatible to that portion of the Village within which the industrial park is located. Area requirements for the District are designed to promote the concentration of these desirable industries so that necessary common facilities may be provided and used in order that problems of utilities, access, fire control, traffic control, and other services may be more easily solved.

1280.02 PERMITTED USES.

   The following uses are permitted in the IP District:
   (a)   Public utilities, whether owned publicly or privately.
   (b)   Research laboratories and facilities.
   (c)   Heliports.
   (d)   The assembly, manufacturing, compounding, processing, packaging, treatment, or fabrication of bakery goods, candy, ceramics, cosmetics, clothing, electrical and electronic equipment, jewelry, instruments, optical goods, pharmaceuticals, toiletries and food products, except fish and meat products, sauerkraut, vinegar, yeast, and rendering or refining of fats and oils.
   (e)   The manufacturing, compounding, assembling, treatment or distribution of articles of merchandise from the following prepared materials: bone, cellophane, canvas, cloth, cork, feathers, felt, fiber, fur, glass, hair, horn, leather, paper, plastics, metals or stones, shell, textiles, tobacco, wood (except planning mills), yarns and those substances or compounds which are not combustible, flammable, explosive or likely to create fire, radiation or explosive hazards to surrounding property. Except the foregoing, other articles, substances or compounds may be stored and used in reasonable quantities provided such storage and use are permitted and subject to such conditions as the Planning Commission, with the advice and recommendation of the Fire Chief, may deem necessary in the interests of public safety.
   (f)   Customary accessory uses to any of the foregoing not in conflict with any other provisions of this Zoning Code.
   (g)   Other uses similar in nature as determined by the Planning Commission and are not harmful to the health, safety, and welfare of the public shall be permitted.

1280.03 CONDITIONALLY PERMITTED USES.

   The following conditional uses shall be permitted in an IP Industrial Park District, provided that buildings and accessory buildings and uses comply with all requirements of this District, and that such uses not involving buildings or accessory buildings shall have the prior written approval of the Planning Commission with the consent of Council or Council without the consent of the Planning Commission. The facilities and associated uses shall comply with all requirements of this chapter with respect to front yard, side yard, and rear yard clearances. If lighted, they shall be shielded away from any thoroughfares and residential districts.
   (a)   Cafeterias or restaurants specifically designed and primarily intended for use by employees and management of uses permitted in the Industrial Park District, but not necessarily exclusively for their use.
   (b)   Bowling alleys, auditoriums, meeting rooms, or other buildings intended for the mutual use of the permitted uses located within the District for meetings, programs, displays, training, recreation, and such other uses as the industrial uses of the District may deem necessary or appropriate. These facilities shall be prohibited for uses by organizations, clubs, and fraternities not specifically a part of the industrial uses of the district.
   (c)   Outdoor recreational facilities designed and intended for use by employees and management of those industries within the District.
   (d)   Wireless telecommunication towers, wireless telecommunication facilities, and wireless telecommunication shelters as set forth in Section 1287.16.
   (e)   Any other use deemed to be of a similar nature as those listed above by the Planning Commission with the consent of Council or Council without the consent of the Planning Commission.

1280.04 DEVELOPMENT STANDARDS.

   Refer to Chapter 1287 for yard, lot coverage, and height restrictions for this district.

1280.05 OUTSIDE STORAGE AND EQUIPMENT.

   No materials, supplies, equipment, or products shall be stored or permitted to remain on any portion of the properties outside a permanent structure without prior written approval of the Board of Zoning and Building Appeals or the Planning Commission. Outdoor storage (that is, materials, supplies, equipment, waste containers) shall be permitted only where screened from view by a permanent wall, mounding, or other appropriate screen and confined to approved locations. This provision shall not be applicable to the materials, equipment, and supplies stored in relation to and as or part of the construction of permanent structures upon a parcel, which materials, equipment, and supplies shall be removed immediately upon completion of construction.

1280.06 FIRE LANES.

   Each site plan shall be reviewed by the Fire Chief, whose duty it is to determine location and dimension of necessary fire lanes to provide access for fire equipment and to provide safe separation of buildings and other structures. Fire lanes shall be plainly designated by appropriate signs and markers and shall be kept open and free of obstruction at all times.

1280.07 HAZARDOUS SUBSTANCES.

   (a)   All toxic or hazardous substances which are stored, used, manufactured, or discharged at the site shall be approved by the Planning Commission upon recommendation of the Fire Chief prior to any such storage, use, manufacture, or discharge.
   (b)   The Village utilities shall monitor and restrict any such use of toxic or hazardous substances and shall require pretreatment of same where necessary prior to discharge into any Village sewer system so as to prevent contamination of the system.
   (c)   Refer also to the performance standards in Section 1276.06(f).

1280.08 MAINTENANCE.

   (a)   The grounds of each parcel shall be maintained in a neat, presentable manner. The owners, lessees, sub-lessees, and occupants of each and every parcel shall keep the weeds and grass cut in their respective portions unless currently leased for agricultural purposes and planted with crops.
   (b)   All owners, lessees, sub-lessees, and occupants shall carefully maintain their parcels and any improvements, placed thereon in a safe, clean and wholesome manner and excellent condition and repair at all times. All exterior painted surfaces shall be maintained in excellent condition.

1280.09 PERMITTED SIGNS.

   The provisions of Chapter 1288 shall be in full force and effect in this District.

1280.10 OFF-STREET PARKING AND LOADING.

   The provisions of Chapter 1290 shall be in full force and effect in this District.

1280.11 STREETS, SIDEWALKS, SEWERS, AND WATER LINES.

   All streets, sidewalks, sewers, and water lines in any Industrial Park District shall meet Village standards. As a condition precedent to the issuance of a zoning certificate, streets, sidewalks, sewers, and water lines shall be installed or performance guaranteed in an approved manner and at grades and locations in streets abutting lot lines as approved by the Village Engineer. However, where not all or substantially all of a plot is to be utilized initially, the Planning Commission may authorize the postponement, until further improvements are to be made of as much of the installation of streets, sidewalks, sewers, and water lines or other improvements as is reasonable under the circumstances with due regard to the use to be made of the lot or lots, the drainage and traffic problems of the area.
