CHAPTER 1270

CB Central Business District

1270.01 PURPOSE.

   It is the intention of Council that by the creation of the Central Business District (CB) and its appurtenant regulations, further expansion and renewal as the historical core business area will be encouraged in such a manner that it is pleasant, convenient, and efficient to use.

1270.02 PERMITTED USES.

   The following uses shall be permitted in the Central Business District (CB):
   (a)   Retail Store. Specialized retail uses and shops including furriers, milliners, shops dealing with women's and men's wearing apparel including shoe shops, antique shops, jewelry stores, gift shops, bookstores (other than adult book stores), florist shops, photographer or artist studios, barber shops, beauty parlors, and drug stores.
   (b)   Parking. Off-street parking lots.
   (c)   General Merchandise. Hardware stores, department stores, mail order houses, variety stores, locksmiths.
   (d)   Food. Grocery stores, meat and fish (seafood) markets, fruit stores and vegetable markets, candy, nut, and confectionery stores, dairy products stores, retail bakeries, miscellaneous food stores, delicatessens.
   (e)   Apparel. Men's and boy's clothing and furnishings stores, women's accessory and specialty stores, women's ready-to-wear stores, children's and infant's wear stores, family clothing stores, shoe stores, custom tailors, furriers and fur shops, miscellaneous apparel and accessory stores.
   (f)   Home Furnishings. Furniture, home furnishings, and equipment stores, household appliance stores, radio, television and music stores.
   (g)   Eating and Drinking. Eating and drinking places.
   (h)   Miscellaneous Retail. Drugstores and proprietary stores, liquor stores, antique stores and secondhand stores, book and stationary stores, sporting goods stores and bicycle shops, jewelry stores, florists, cigar stores and stands, news dealers and newsstands, camera and photographic supply stores, gift, novelty, and souvenir shops, optical goods stores, bicycle repair shop.
   (i)   Administrative, Business, and Professional Offices. Administrative offices primarily engaged in general administration, supervision, purchasing, accounting, and other management functions; business offices carrying on no retail trade with the general public and having no stock of goods maintained for sale to customers; professional offices engaged in providing tangible and intangible services to the general public, involving both persons and possessions.
   (j)   Finance. Commercial and stock savings banks, mutual savings banks, trust companies not engaged in deposit banking, establishments performing functions closely related to banking, savings and loan associations, agricultural and credit institutions, personal credit institutions, business credit institutions, loan correspondents and brokers, holding companies, investment companies, trusts, miscellaneous investing institutions.
   (k)   Real Estate Offices. Accessory buildings or uses subordinate to those permitted therein.
   (l)   Other. Accessory uses and structures incidental to the above uses.

1270.03 CONDITIONALLY PERMITTED USES.

   In the CB District, the following uses may be permitted as conditional uses by the Planning Commission with the consent of Council or Council without the consent of the Planning Commission and subject to the general conditions as set forth in Chapter 1250:
   (a)   Dwelling units.
   (b)   Service stations; automobile repair garages; automobile, truck travel- trailer sales lots; vehicle parking lots.
   (c)   Amusement arcades.
   (d)   Theaters and concert halls.
   (e)   Child care or elderly adult day care facilities with more than seven persons (see Chapter 1287).
   (f)   Outdoor vending machines.
   (g)   Churches and other places of worship and their associated residences.
   (h)   Private or nonprofit clubs or lodges.
   (i)   Lawn mower service.
   (j)   Pocket park. A small park located within the Central Business District (CB) which shall be accessible to the general public, unless it is created as part of the public space requirement of a larger building project or complex. A pocket park shall meet the following conditions:
      (1)   Size of pocket park shall not exceed 0.25 acre or 10,890 square feet.
      (2)   Pocket park shall not border any residentially zoned district (R-1A, R-1B, R-2, R-3, Manufactured Home Park District (MHP) or Planned Unit Development District (PUD)).
      (3)   Design plans of any landscaped areas within pocket park are subject to Planning Commission approval.
      (4)   Yard, lot coverage, and height restrictions of pocket park shall conform to the table set forth in Section 1286.01 of the Codified Ordinances.
      (5)   Pocket park shall maintain adequate access points and pathways.
      (6)   No playground equipment shall be permitted within pocket park.
      (7)   Accessory structures located within pocket park shall be permitted only as open structures (no solid walls).
      (8)   Landscaped areas within pocket park shall be maintained by property owner or property owner’s agent.
      (9)   All lighting fixtures located within pocket park shall be shielded and subject to (0.5) foot-candles at property lot line.
      (10)   No permanent sound equipment shall be permitted within a pocket park.
      (11)   No food or carbonated beverages shall be prepared or served within pocket park without prior permission of Council.
   (k)   Any other uses similar in nature as determined by the Planning Commission with the consent of Council or Council without the consent of the Planning Commission.

1270.04 DEVELOPMENT STANDARDS.
