CHAPTER 18

04.- GENERAL PROVISIONS

18.04.010 - Purpose.

A.

The town council of the town of Greybull finds that the health, safety and general welfare of the citizens of Greybull will be best served by the regulation of construction and building in order to accomplish the statutorily authorized (Wyoming Statutes 15-1-103) purposes of:

1.

Lessening congestion in the streets;

2.

Securing safety from fire, panic, and other dangers;

3.

Providing adequate light and air;

4.

Preventing the overcrowding of land;

5.

Avoiding undue concentration of population; and

6.

Facilitating the provision of public services and facilities.

B.

The town council further finds that the Greybull Community Development Plan of April 10, 2006, serves as a sufficient basis for the ordinance codified in this division under the provisions of Section 15-1-503 of the Wyoming Statutes and that the public hearings required in Section 15-1-503 have been held, giving all parties at interest and citizens an opportunity for involvement in the formulation of the ordinance codified in this division.

18.04.015 - Composition.

The zoning commission is to consist of not less than three members or nor more than five members who are not officials or employees of the town. The members shall be appointed by the mayor with the consent of the council. In the event there are not enough members of the public who wish to serve on the zoning commission the town council will act as the zoning commission. In the event the town council is acting as the zoning board all references in the code to the zoning commission shall be deemed to be the town council.

18.04.020 - Statutory authority.

The zoning ordinance codified in this division is adopted pursuant to the authority contained in Wyoming Statutes 15-1-701 to 15-1-709.

18.04.030 - Falsification of information.

Any person who intentionally falsifies or distorts information required by this division shall be subject to the penalties provided for in this chapter.

18.04.040 - Burden of proof.

Burden of proof shall in all instances be assigned to the applicant in proceedings under this division.

18.04.050 - Relationship to other ordinances or regulations.

Where other town and/or state regulations apply concurrently with this division, the more restrictive shall govern.

18.04.060 - Construction.

The provisions of this division shall be liberally construed in favor of the public interest.

18.04.070 - Violation—Penalty.

Any person who willfully violates any provision of this division shall be deemed guilty of a misdemeanor and shall be fined not more than $750.00 and costs. Each calendar day in which the violation continues shall be deemed a separate offense.
