CHAPTER 18

32.- MEDIUM DENSITY RESIDENTIAL DISTRICT MRD

18.32.010 - Purpose.

It is the purpose of the medium density residential district to provide a more diversified style of housing, including manufactured homes 15 years old or less and in apparent good condition and multiple-family dwellings.

18.32.020 - Uses of right.

Uses of right shall be single-family dwellings, duplexes, home occupations, and public uses compatible with a residential environment.

18.32.030 - Conditional uses.

Conditional uses shall be manufactured home parks, multiple-family dwellings, townhouses, churches, and home occupations.

A.

Permitted Accessory Use.

Camper trailers or RVs (not to include manufactured homes) may be used as temporary living facilities during construction or remodeling of a primary residence on the same property. Duration of use of the temporary living facility shall not exceed six months from the date of approval of the conditional use—permitted accessory use permit by planning and zoning. If a time extension is required, prior to the expiration of the conditional use—permitted accessory use permit the permitee shall approach planning and zoning and request an additional six-month permit. Only one additional six-month permit shall be issued (a maximum of one year of occupancy in a temporary living facility is allowed on a property). Temporary living facilities must meet all code requirements for dwellings regarding water and sanitary sewer service. All connections to town utilities must be approved by the town public works and comply with all regulations as described in this Code. Preventing the freezing of utility lines must be considered (through skirting and/or heat trace) when developing and presenting the plan in the permit application to planning and zoning. All other applicable utility fees and tap fees for the property must be paid as described in this Code, and taps fees will be applied to the permanent residence on the property. Temporary living facilities must be on the property (not on the street or alley) and meet all setback requirements.

18.32.040 - Relationship to building codes.

The medium density residential district is included within fire zone No. 3 established in the International Building Code.

18.32.050 - Performance standards.

The performance standards set forth in Sections 18.32.060 through 18.32.090 shall apply in the medium density residential district.

18.32.060 - Manufactured home parks.

A.

Manufactured home parks shall be subject to the requirements of the town's subdivision regulations and to the additional requirements imposed in this division.

B.

Manufactured home unit spaces shall be a minimum of 3,500 square feet and have a minimum width of 35 feet and spaces for double wide manufactured homes shall be a minimum of 3,500 square feet and have a minimum width of 50 feet.

C.

Manufactured homes in parks shall be set back at least 15 feet from any internal street, at least 25 feet from any external street, and at least ten feet from the manufactured home park's boundary. Manufactured homes in parks shall be set a minimum of 15 feet apart side to side or 15 feet apart end to end.

D.

Manufactured home parks shall provide adequate all-weather, off-street parking at the rate of two spaces per unit.

E.

In addition to each unit space all manufactured home parks must provide an internal recreation area of at least 100 square feet for each unit space. The recreation area must be adequately landscaped, lighted and equipped.

F.

Manufactured homes in parks must be skirted within 90 days of their placement and cannot be skirted with straw or hay bales. Structures may not be added to or over manufactured homes in parks except open landing steps with 12 or less square feet per landing.

G.

An adequately maintained solid waste container shall be provided for each unit or for groups of units where the container is accessible by all-weather walkways and adequately sized for the potential loading. All containers shall conform to town standards.

H.

Manufactured home parks shall provide a landscaped buffer area for any LD of at least 30 feet. The mobile park's recreational area may occupy all or a portion of this buffer area.

18.32.070 - Multiple-family dwellings.

A.

Multiple-family dwellings shall be located on a minimum parcel size of 6,000 square feet with an additional 1,500 square feet being provided for each unit over three.

B.

Multiple-family dwellings shall be set back 20 feet from the property line of any public street and ten feet from any alley. No multiple-family dwelling structure shall occupy more than 60 percent of the open area or shall be occupied by parking. The open area shall be properly landscaped and maintained.

C.

All multiple-family dwellings shall provide adequate all-weather off-street parking at the rate of one and one-half spaces per unit. Such parking shall be adequately lighted and drained and shall have safe access to public streets.

D.

All multiple-family dwellings shall provide adequate solid waste collection containers, accessible by all-weather walkways from the dwelling units, and conforming to all standards for such containers set by the town.

E.

Dwellings, duplexes or other buildings on corner lots shall be set back 20 feet from the property line of any public street and five feet from the property line and the structures shall line up with existing buildings in the same block. Any garage or outbuilding constructed on a corner lot shall be set back a minimum of ten feet from the property line of any public street, however, the building may be placed closer than ten feet to the alley if the eaves of the building do not overhang onto the alley way.

18.32.080 - Single-family dwellings and duplexes.

A.

Single-family dwellings and duplexes shall be located on a minimum parcel size of 5,000 square feet.

B.

Single-family dwellings and duplexes shall be set back 20 feet from the property line of any public street.

C.

Single-family dwellings, duplexes, and accompanying accessory buildings shall occupy no more than 60 percent of the parcel on which they are located.

D.

Manufactured homes, not in parks, shall be placed on permanent foundations of concrete block or poured concrete with concrete and/or masonry curtain wall under perimeter of home and their water, sewerage, and electrical connections shall be permanently emplaced and meet all town standards and codes.

E.

No single-family dwelling or duplex shall exceed 35 feet in height.

18.32.090 - Home occupations.

A.

Home occupations may display a single sign covering a maximum of four square feet attached to the dwelling in which the home occupation is conducted and having no moving or lighted parts.

B.

Home occupations shall employ no more than one full-time employee equivalent outside the resident family.

C.

Home occupations shall have no open storage or sales area.
