52.- NONCONFORMING BUILDINGS AND USES

18.52.010 - Definitions.

A.

"Nonconforming building" includes any legally existing building which does not conform to the location and bulk regulations of this chapter for the district in which such nonconforming building is located, either at the effective date of this chapter or as a result of subsequent amendments which may be incorporated into this chapter.

B.

"Nonconforming use" includes any legally existing use, whether within a building or other structure or on a tract of land which does not conform to the use and regulation of this chapter for the district in which such nonconforming use is located, either at the effective date of this chapter or as a result of subsequent amendments which may be incorporated into this chapter.

18.52.020 - Continuation of use.

A nonconforming use may be continued and a nonconforming building may continue to be occupied, except as both of the foregoing are otherwise provided for in this chapter.

18.52.030 - Change of use.

A nonconforming use may be changed to any conforming use or to any use of a more restrictive classification.

18.52.040 - Abandonment of use.

If active and continuous operations are not carried on in a nonconforming use during a continuous period of six months, the building, other structure or tract of land where such nonconforming use previously existed shall thereafter be occupied and used only for a conforming use, with the exception of manufactured homes. Once a manufactured home is moved, the zoning reverts to conforming use. Intent to resume active operations shall not affect the foregoing. If an operation is seasonal, abandonment shall be considered to have occurred upon the failure to operate during one normal season.

18.52.050 - Restoration.

A nonconforming building or a building containing a nonconforming use which has been damaged by fire or other causes may be restored to its original condition provided:

A.

Such damage is less than 60 percent of its real cash value.

B.

Such work is started within six months of such calamity and completed within one year of the time the restoration is commenced.

18.52.060 - Enlargement of building containing nonconforming use.

A building containing a nonconforming use shall not be enlarged or extended by more than its total floor area existing at the time of adoption of the ordinance codified in this chapter.

18.52.070 - Alteration of nonconforming building.

A nonconforming building may be structurally altered, repaired, or enlarged in any way permitted by these regulations; provided, that no alterations, repairs or enlargement shall be made in a nonconforming building which would increase the degree of nonconformity with the location and bulk regulations of this chapter.
