§ 28-25.4

Procedure for Appeal.

a. 
Upon receipt of an appeal, the Board shall fix a reasonable time for a hearing, giving the notice thereof to the appellant.
b. 
Within 30 days of the filing of an appeal, the Board shall publish a notice of the time and place of a public hearing of such appeal or application in a local newspaper of general circulation in the Town.
c. 
At least 10 days prior to the date set for the hearing, the Board of Adjustment shall post on the land or building involved in any appeal for a variance or application for a special permit, a notice of said hearing and a statement indicating clearly both the property affected and the nature of the proposal.
d. 
At least 10 days prior to the date set for the hearing, the appellant shall give personal notice to all owners of property situated within 200 feet of the property affected by such appeal.
1. 
If the owners are the occupants of the property affected by the appeal, such notice may be either by registered mail or by personal service at their usual place of abode.
2. 
If the owners are not residents of the Town, such notice may be given by sending written notice by registered mail to the last known address of the owner or owners as shown on the most recent tax list of the Town.
3. 
Where an owner is a partnership, service upon any partner shall be sufficient, and where the owner is a corporation, service on any officer shall be sufficient.
4. 
The appellant shall by affidavit present proof to the Board of Adjustment at the time of the hearing that said notices have been duly served as aforesaid.
5. 
Any party may appear at the hearing in person, by agent or by attorney.
