CHAPTER 10

28 SUBDIVISION AND SITE DEVELOPMENT STANDARDS

10-28-1 Purpose

The purpose of this chapter is to establish standards for the development and construction of subdivisions.

10-28-2 Scope

The provisions of this chapter shall apply to any subdivision located in the city.

10-28-4 City Standards And Specifications

  1. Departmental action. Standards for design, construction specifications, and inspection of street improvements, curbs, gutters, sidewalks, storm drainage, and flood control facilities shall be prepared by the community development department. Standards for water distribution and sewage disposal facilities shall be prepared by the health department, culinary water authority, and sanitary sewer authority, and similar standards for fire hydrants shall be prepared by the Unified Fire Authority.
  2. City council action. The city council shall approve standards and specifications for construction of infrastructure improvements within the city. Prior to implementing an amendment to adopted specifications for infrastructure improvements, the community development director shall give 30 days' mailed notice and an opportunity to comment to anyone who has requested the notice in writing.
  3. Subdivision design generally. The design of preliminary and final plats of a subdivision in relation to streets, blocks, lots, open spaces and other design factors shall be in harmony with design standards adopted by the city and shall include provisions set forth in this chapter. Where trees, groves, waterways, scenic points, historic spots, or other city assets and landmarks, as determined by the planning commission, are located within a proposed subdivision, reasonable steps should be taken to preserve these features.
  4. Compliance. Any installation, construction, alteration, repair, maintenance, or other work on infrastructure improvements within the city, or within any public right-of-way, shall comply with city standards and specifications and the requirements set forth in this chapter.
  5. Compliance with general plan. The layout of lots in a subdivision, which includes the size, placement and number of lots, and street design shall comply with the intent and purpose of the general plan.

10-28-5 Approval Process

Approval or amendment of subdivision plats shall conform to the procedures set forth in HCC chapter 10-5. No final plat of a subdivision of land shall be recorded without receiving a statement signed by the city engineer certifying that the improvements described in the applicant's plans and specifications have been completed, that they meet the minimum requirements of all ordinances of the city, that they comply with the standards and requirements of the health department, the city engineer, the planning commission and the Unified Fire Authority.

10-28-6 Commencement Of Site Development

  1. Subdivision development. Subdivision development may not begin until a final plat is recorded in the office of the county recorder except as otherwise provided in HCC chapter 10-20.
  2. Other development. Development on a lot within a recorded subdivision or on another legally created parcel of land may commence upon issuance of a land use permit for such development in accordance with the terms of the permit and applicable provisions of this title.

10-28-7 Protection Strips

The use of protection strips shall be prohibited.

10-28-8 Lots

  1. Arrangement. Lot arrangement and design shall be such that lots will provide satisfactory and desirable sites for buildings, and be properly related to topography, to the character of surrounding development and to existing requirements.
  2. Zones. All lots shown on the preliminary and final plats shall conform to the minimum requirements of the zone in which the subdivision is located, and to the minimum requirements of the health department for water supply and sewage disposal.
  3. Streets. Each lot shall abut on a street shown on the subdivision plat or on an existing publicly dedicated street which has become public by right of use and which is more than 26 feet wide. Double frontage lots shall be prohibited, except where unusual conditions make other designs undesirable.
  4. Lot lines. Side lines of lots shall be approximately at right angles, or radial to the street lines.
  5. Remnants. In general, all remnants of lots below minimum size shall be added to adjacent lots, rather than allowed to remain as unusable parcels.
  6. Flag lots. All flag lots shall meet the requirements of HCC 10-29-20.

10-28-9 Storm Sewers

Storm sewers shall be constructed throughout the entire subdivision to carry off water from all inlets and catchbasins and shall be connected to an adequate outfall. A stormwater drainage system subject to the approval of the city engineer shall be provided and shall be separate and independent of the sanitary sewer system. The final plans for the drainage system shall be prepared by a licensed engineer not in the employ of the city.

10-28-10 Sanitary Sewers

  1. Service available. Where public sewer service is available to the subdivision, a public sanitary sewer system, including main lines and laterals from the main to each lot property line, shall be constructed throughout the entire subdivision in accordance with plans and technical standards required by the governmental entity providing public sewer service to the subdivision and shall be connected to the public sewer system.
  2. Alternate systems. In cases where public sewer service is not presently available to the subdivision, alternate waste disposal systems may only be permitted and used, provided that the applicant or developer installs and constructs concurrently therewith sanitary sewer laterals and mains within the subdivision streets and to a point on the subdivision boundary where future connection with the public sewer system shall be made. Sewer laterals shall be laid from each lot property line to the main line in each street and a connection shall be available on each lot to connect from the alternate waste disposal systems to the sewer system when public sewer becomes available and operational. Such sanitary sewer system shall be capped until ready for use and shall be constructed throughout the entire subdivision in accordance with plans and technical standards required by the governmental entity, which will provide public sewer service to the subdivision in the future.
  3. Exemptions. The city council may exempt the applicant from the requirements of this section upon a finding that public sewer is unlikely to be provided to the subdivision in the future due to physical inaccessibility of the terrain. Prior to making a decision concerning a requested exemption, the city council shall request a written recommendation from the planning commission and from the public entity which will likely provide sewer service to the area in which the subdivision is located.

10-28-11 Storm Drainage

No ditch or canal shall be approved as suitable for the use of storm drainage water without the written permission of the appropriate ditch or canal company or of the water users for such use. No ditch or canal shall be used for stormwater unless adequately improved to handle such water as might be reasonably expected to flow from canal and ditch water, subdivision runoff water, and other water expected to reach such canal or ditch. No ditch, canal or other waterway shall be permitted within property dedicated or to be dedicated for public use. The applicant shall remove such waterways from property to be so dedicated prior to the construction of required off-site improvements.

10-28-12 Street Improvements

  1. Preparation of plans and profiles. The applicant shall submit a complete set of construction plans and profiles of all streets, existing and proposed, within the subdivision to the city engineer. Plans and profiles shall be prepared by a licensed professional engineer not in the employ of the city and shall be accompanied by the final plat. The city engineer shall, within a reasonable time not to exceed 20 days from the receipt of the plans and profiles, notify the applicant of approval, and in case of disapproval, the reasons therefor.
  2. Submission of approved plans and profiles. At least ten days prior to the commencement of construction, the applicant shall furnish to the community development department three complete sets of approved construction plans and profiles of all streets, existing and proposed. Such plans and profiles shall conform to city standards and specifications and shall include the following additional information:
    1. The designation of limits of work to be done;
    2. The location of the benchmark and its true elevation according to city datum, all profiles to be referred to that datum;
    3. Profiles which indicate the finished and existing grades for each side of the street. Separate profiles, clearly designated, shall be made for each side of the street;
    4. Construction plans which include the details of curb and gutter and street cross sections, location and elevation of manholes, catchbasins and storm sewers, elevations and location of fire hydrants and any other details necessary to simplify construction;
    5. Completion date for field layout and office checking;
    6. On curb returns, at least two additional control points for elevation besides those at points of curvature. Control points shall be staked in the field to ensure drainage at intersection; and
    7. The street address of the project.
  3. Dedication of streets. When development is proposed, the applicant shall dedicate and improve any street, or portion thereof, which is planned in or necessitated by the development and that is rationally related to the development's impact on the city's transportation system. Improvements that are not rationally related to the development do not need to be completed or no fee in lieu is necessary.

10-28-13 Arrangement Of Streets

The arrangement of streets in new subdivisions shall provide for the continuation of the existing streets in adjoining areas and shall provide access to unsubdivided adjoining areas insofar as such continuation or access is necessary as reasonably determined by the planning commission. Before final plat approval, all planned new streets shall connect with existing public streets.

10-28-14 Pavement Requirements

  1. Improvements. All streets within the city shall be improved with pavement bounded by integral concrete curbs and gutters to an overall width in accordance with city standards and specifications.
  2. Construction. Pavement shall be constructed in accordance with city standards and specifications.

10-28-15 Curbs, Gutters, Sidewalks, And Park Strips

  1. Type; thickness. Curbs and gutters on all streets shall be concrete of the standard high back type unit, not less than two feet six inches in overall width, and not less than seven inches thick where the curb abuts the street pavement.
  2. Curb corners. All curb corners shall have a radius of not less than 25 feet.
  3. Installation required. Curbs, gutters, and sidewalks on existing and proposed streets shall be installed in a subdivision by the applicant.
    1. The improvements required by this section shall not apply to those properties within the area shown on the curb and gutter exception map approved by the city. Modified improvements shall be installed on these properties as found in city standards and specifications. This exception applies to those properties which front along existing, paved, public roads.
    2. This exception shall not apply to property that fronts 6000 West, Main Street, or 6400 West.
  4. Landscaping required. The applicant shall install landscaping in the area between the curb and sidewalks. The type and amount of landscaping required shall be as required in HCC chapter 10-23.
  5. Dedication of additional rights-of-way. All applicants shall dedicate additional rights-of-way to the extent that may be lawfully required as shown in the city transportation master plan.

10-28-16 Street Name Signs

Street name signs, conforming to the design and specifications and in the number provided by city standards and specifications, shall be provided by the applicant at all street intersections. Installation shall be made by the city to ensure uniformity.

10-28-17 Trails

  1. When required. Trails may be required within a subdivision so long as the need for the trail is roughly proportional, both in nature and extent, to the impact of the subdivision.
  2. Location. Trails shall be located so that the route is feasible for both construction and long-term maintenance; insurmountable physical obstructions shall be avoided. The specific location of the trail right-of-way shall be verified on the ground before approval of the subdivision.

10-28-18 Fire Hydrants

Fire hydrants shall be installed in all subdivisions in accordance with the regulations of the Unified Fire Authority.

10-28-19 Stormwater Inlets And Catchbasins

Stormwater inlets and catchbasins shall be provided within street improvements at points specified by the community development department.

10-28-20 Open Ditches And Canals

  1. Prohibited. Open ditches or canals shall not be allowed within or adjoining a subdivision, except along rear or side lot lines.
  2. Provisions. The applicant shall work with irrigation, drainage, or ditch companies as to:
    1. Methods of covering, realigning or eliminating ditches or canals within or adjoining the subdivision;
    2. The size of pipes and culverts required; and
    3. The responsibility for the periodic inspection, cleaning and maintenance of such ditches, pipes, and culverts. In cases where canals or ditches cross public roads or proposed public roads, specifications and grades for pipes or culverts shall be approved by the city engineer.

10-28-21 Fencing Requirements

  1. Areas where fencing required. The applicant shall install a six-foot non-climbable chain-link fence, or its equivalent, in conformance with the standards and rules and regulations as provided in HCC chapter 10-21, along all open ditches, canals, or waterways, non-access streets, open reservoirs or bodies of water, railroad rights-of-way, and other such features of potentially hazardous nature on, crossing, or contiguous to the property being subdivided, except along those features which the planning commission shall determine would not be a hazard to life, or where the conforming structure would create a hazard to the safety of the public.
  2. Non-access streets. Fencing and landscaping along non-access streets shall be reviewed and approved by the planning commission to provide a uniform and aesthetically pleasing streetscape.
  3. Lots on a private right-of-way. All lots on a private right-of-way shall have a six-foot solid vinyl fence along both sides of the private right-of-way.

10-28-22 Street Lighting

  1. Required. The applicant shall install streetlights on all public and private streets located within the subdivision. All lights shall meet the city streetlight standards. A 70 watt (5,600 lumens) high-pressure sodium vapor luminaire with photocell shall be installed on streets that are 66 feet or less in width. A light pole shall be installed at all intersections. A 150 watt (16,000 lumens) high-pressure sodium vapor luminaire with photocell shall be used on streets that are greater than 66 feet in width.
  2. Design. Streetlight fixtures shall be refractive globe acorn or a similar lighting fixture for local streets, and Herriman teardrop on streets that are more than 66 feet in width. Electrical power for streetlights shall be installed underground.
  3. Location. Streetlights, including streetlights located near intersections, shall be no more than 150 feet apart and shall be placed according to an engineered lighting plan.
    1. The lights shall be installed in the space between the curb and sidewalks. In situations where the sidewalk is integral, the streetlight shall be placed within two feet of the sidewalk in a public utility easement.
    2. Placement shall alternate from one side of the street to the other and shall be placed on side property lines. At intersections, the streetlight shall be located near the intersection. The spacing for streetlights on streets that are greater than 66 feet in width shall be 125 feet apart on both sides of the street and placed in an alternating or soldiered pattern to allow for even lighting that meets national standards.
    3. Final placement and type of streetlights shall be approved in writing by the city or its designee.

10-28-23 Public Utilities

  1. Approved public utilities. The city engineer may approve the following public utilities in any zone:
    1. Electric power transmission and distribution lines with a capacity of less than 69 kilovolts;
    2. Gas transmission and distribution lines with a design pressure of less than 600 psi and pipe diameter of less than 16 inches;
    3. Canals and water transmission and distribution lines with a capacity of less than 200 second feet;
    4. Motor vehicle rights-of-ways and driveways;
    5. Telephone lines;
    6. Cable television or communication lines; and
    7. Easements, rights-of-way, service driveways or accessory structures which are appurtenant to the above uses.
  2. Utilities requiring conditional use permit. The following large scale public utilities may be allowed in all zones, subject to the granting of a conditional permit:
    1. Electric power transmission lines with a capacity of 69 kilovolts or greater;
    2. Gas transmission lines with a design pressure of 600 psi or greater and pipe diameter of 16 inches or larger;
    3. Communication towers; and
    4. Any easements, rights-of-way, service driveways or accessory structures which are appurtenant to the above uses.
  3. Zone standards. Public facilities shall be subject to all of the height, bulk, location, and other standards for the zone in which they are located except:
    1. There shall be no minimum lot size required; and
    2. Only walled and/or roofed structures shall be required to meet the yard requirements (setbacks) of the zone. Otherwise, the public facilities listed in this section shall have no minimum yard requirements.
  4. Underground lines, structures; exception. In new developments, all utility lines and structures shall be installed underground in properly recorded easements according to city standards and specifications. Junction boxes, monitoring and pump stations, and other aboveground utility structures not listed above in excess of 30 square feet in area or over four feet in height shall require conditional use permit approval prior to installation.

10-28-24 Other Applicable Regulations

To the extent that use and development of land subject to this chapter includes any matter governed by other applicable regulations set forth in this title, such regulations shall apply in addition to the requirements of this chapter.
