CHAPTER 10

8 ZONES, MAPS, AND ZONE BOUNDARIES

10-8-1 Zones Established

In order to accomplish the purposes of the city general plan and this title, the following zones, along with their accompanying zoning map designations, are hereby established as follows:

  1. Agricultural zones.
    1. A-1-10 Single-Family Agricultural Zone.
    2. A-1-21 Single-Family Agricultural Zone.
    3. A-1-43 Agricultural Zone.
  2. Residential zones.
    1. R-1-10 Single-Family Residential Zone.
    2. R-1-15 Single-Family Residential Zone.
    3. R-1-21 Single-Family Residential Zone.
    4. R-1-43 Single-Family Residential Zone.
    5. R-2-10 Multifamily Residential Zone.
    6. R-2-15 Multifamily Residential Zone.
    7. R-20-43 Multifamily Residential Zone.
    8. R-M Zone.
  3. Recreational zones.
    1. FR-1 Forestry Recreation Zone.

10-8-2 Definitions

Certain words and phrases in this chapter are defined in HCC chapter 10-3.

10-8-3 Official Zoning Map

  1. Zones. The location and boundaries of the zones described in this chapter, including subsequent amendments, shall be shown on the city's official zoning map as provided in this section.
    1. The zones established by this chapter are intended to further the goals and policies of the general plan. Accordingly, not every zone established by this chapter may be shown on the official zoning map unless and until the city council, in the exercise of its legislative discretion, determines that placing a particular property in a particular zone will further the goals and policies of the general plan.
    2. Each lot or parcel within the city shall be subject to the requirements of the zone in which the lot or parcel is located as shown on the official zoning map.
    3. The official zoning map, including all boundaries, notations, and other data shown thereon, is hereby adopted by this reference.
  2. Amendments. Amendments to the boundaries of a specific zone shown on the official zoning map shall be accomplished in accordance with state law and the provisions set forth in HCC 10-5-8.
  3. Map updates. The community development director shall update the official zoning map as soon as possible after amendments are adopted by the city council. Upon entering any such amendment on the map, the community development director shall note on the map the date of the revision.
  4. Filing of zoning ordinance and map. The official copy of the ordinance from which this title is derived and the official zoning map shall be filed in the office of the city recorder and may be examined by the public in accordance with the Utah Governmental Records Management Act, U.C.A. 1953, § 63G-2-101 et seq.

10-8-4 Zone Boundary Location Rules.

  1. Applicability. The community development director shall apply the provisions of this section to determine the location of any boundary shown on the official zoning map when the boundary is uncertain. This section shall apply only when uncertainty exists.
  2. Centerlines and property lines. When a zone boundary is not definitely indicated as being approximately upon the centerline of a street, alley, block, or along a property line, the centerline of the street, alley, block, or such property line shall be deemed to be the zone boundary.
  3. Waterways and public lands. When a zone boundary is indicated as being approximately at the line of a river, irrigation canal, or other waterway; railroad right-of-way; public park or other public land; or any section line, the center of the stream, canal, waterway, or railroad right-of-way, or the boundary line of such public land or such section line shall be deemed to be the zone boundary.
  4. Street vacations. When a public road, street, or alley is officially vacated, such property shall have the same zoning as the adjacent property. If vacated property is adjacent to two zones, each zone shall extend to the centerline of the vacated road, street, or alley.
  5. Uncertainties. When a physical or cultural feature existing on the ground is at variance with a feature shown on the official zoning map, or in the event any other uncertainty with respect to a zone boundary, the community development director shall determine the boundary location.

10-8-5 Clarification Of Zoning

  1. Ambiguous zone. Any property in the city which is not clearly zoned on the official zoning map shall be deemed to be in the A-1-43 zone.
  2. Ambiguous use. If ambiguity arises concerning the classification of a particular use within the meaning and intent of this title, or with respect to matters such as height, yard requirements, area requirements, and other property development standards, the community development director shall make an administrative interpretation to determine the proper use or development standard pursuant to the requirements in HCC 10-5-23.

10-8-6 Newly Annexed Areas

The city council shall assign a land use zone or a variety thereof to territory annexed to the city at the time the territory is annexed. If the city council fails to assign a land use zone at the time the territory is annexed, the annexed territory shall be deemed to be in the A-1-43 zone immediately upon annexation, unless the property is located adjacent to the hillside overlay zone, in which case it shall be zoned FR-5.
