§ 12-5.6

Fence Regulations.

Any fences erected in the borough shall adhere to the following:
a. 
Before a fence of over three feet in height shall be erected a zoning permit must be obtained from the zoning officer. A request for a permit shall be accompanied by a sketch, drawn to scale, showing the height and location of the fence in relation to all other adjacent structures and buildings and in relation to all adjoining streets, lot property lines and yards. Such fence shall not cause undue loss of light and air to adjoining properties.
b. 
Fences may be erected, altered or reconstructed to a height not to exceed three feet above ground level when located within 25 feet of the street.
c. 
Fences may be erected, altered or reconstructed to a height not to exceed six feet above ground level when located more than 25 feet from the street line.
d. 
These restrictions shall not be applied so as to restrict the erection of a wall for the purpose of retaining earth.
e. 
These restrictions shall not be applied so as to restrict the erection, alteration or reconstruction of fences used in connection with farms or farm operations, except insofar as such fences might affect the public safety.
