24 - "R-5" MULTIPLE FAMILY RESIDENTIAL DISTRICT
Within any "R-5" multiple family use district, no structure or land shall be used except for one or more of the following uses:
(1)
Any use permitted in Section 23.22.002 and as regulated therein except as herein amended;
(2)
Clinics for human care or nursing facility provided the site shall contain not less than three hundred square feet of lot area for each person to be accommodated;
(3)
Offices for persons engaged in one of the recognized professions, finance, insurance, real estate, religious or philanthropic organizations provided that no single floor of a building shall contain both resident and nonresident uses.

Within the "R-5" multiple family use district, no structure or land shall be used for the additional following uses except by conditional use permit:
(1)
Funeral homes and mortuaries;
(2)
Motels and motor hotels provided the site shall contain not less than six hundred square feet of lot area per rental unit;
(3)
Offices of general nature provided the net square footage of the floor area when located in a building having other permitted uses is not greater than five thousand square feet and twelve thousand square feet when located in a separate building;
(4)
Child care facilities, Class II.

Within any "R-5" multiple family district, the following uses shall be permitted accessory uses:
(1)
Any use permitted in Section 23.22.006 and as regulated therein except as herein amended.

The following minimum requirements shall be observed subject to the additional requirements, exceptions and modifications as set forth in Chapter 23.38:
(1)
No limit on height of primary structure;
(2)
Any lot platted prior to March 1, 2002 may be grandfathered in with a minimum lot width of fifty feet. Any lot platted after March 1, 2002 shall have a minimum lot width of one hundred feet;
(3)
Front yard shall be twenty feet or more;
(4)
A side yard shall be one-fourth the height of the building or ten feet, whichever is greater;
(5)
A side yard abutting a street shall not be less than twenty feet in width;
(6)
Courts (inner or outer) and light wells shall be a minimum width of one-half the sum of the heights of the two tallest abutting wings of the building;
(7)
Rear yard shall be twenty feet;
(8)
Any lot platted prior to March 1, 2002 may be grandfathered in with a minimum lot area of six thousand square feet. Any lot platted after March 1, 2002 shall have a minimum lot size of ten thousand square feet;
(9)
Lot area per dwelling unit:
(a)
If one through two stories, then two times the minimum floor area required,
(b)
If three through six stories, then one and one-half times the minimum floor area required,
(c)
If seven stories or more, then one times the minimum floor area required;
(10)
For all uses other than residential, the floor area ratio factor within the "R-5" district shall not exceed 1.0;
(11)
In no case may any structure except for fences be constructed in utility easement areas along front, side or rear property lines;
(12)
If a detached accessory building is constructed three feet (or less by variance) from the property line, the roof overhang on the building will be limited to one foot including stormwater gutters.

Area requirements for dwelling units shall be as follows:
(1)
Each efficiency apartment shall have not less than four hundred square feet of floor area;
(2)
Each apartment having one bedroom shall have not less than five hundred square feet of floor area;
(3)
Each apartment having two bedrooms shall have not less than six hundred square feet of floor area;
(4)
Any apartment having more than two bedrooms shall have six hundred square feet of floor area plus at least one hundred twenty square feet in addition thereto for each bedroom in excess of two;
(5)
Floor area shall be that area for exclusive use of the occupant.
