36 - OFF-STREET PARKING AND LOADING

23.36.004 - General provisions for off-street parking areas and loading spaces.

(1)

Existing off-street parking spaces and loading spaces upon the effective date of the ordinance codified in this title shall not be reduced in number unless that number exceeds the requirements set forth herein for a similar new use.

(2)

Should a building, structure or use in existence upon the effective date of the ordinance codified in this title be damaged or destroyed by fire or other cause, it may be reestablished, according to Section 23.10.010, except that in so doing the number of off-street parking or loading spaces which existed must be retained and should plans be proposed for enlarging the floor area, seating capacity or other facilities which would affect the parking or loading requirements, the parking or loading spaces shall be enlarged accordingly.

(3)

FLOOR AREA. "Floor area" for the purpose of calculating the number of off-street parking spaces required means all of the floor area of the various floors of a structure measured to the centers of all partitions, except those areas used for dead storage, building maintenance, office of building management, toilets or rest rooms, window show cases, dressing rooms, employees' cafe, conference rooms, or for building utilities.

(4)

BENCHES IN PLACES OF PUBLIC ASSEMBLY. In stadiums, sport arenas, churches, and other places of assembly in which patrons or spectators occupy benches, pews, or other similar seating facilities, each twenty-two inches of such seating facilities shall be counted as one seat for the purpose of determining requirements for off-street parking facilities under this title.

(5)

PARKING SPACES. Each parking space shall be unobstructed and not less than nine feet wide and twenty feet in length per car and have an adequate system of access drives.

(6)

USE OF RESIDENTIAL PARKING FACILITIES. Off-street residential parking facilities may be utilized for the parking of passenger automobiles and one straight truck not to exceed twenty-five thousand GVW and truck tractors, the truck to be parked within a building.

(7)

JOINT PARKING FACILITIES. In all districts except "R-1" and "R-2," required off-street parking facilities may be combined and provided in one area provided that such facilities shall not thereby be diminished and shall be within three hundred feet of the building to be served.

(8)

Buildings or structures for which a building permit has been issued prior to the effective date of the ordinance codified in this title but for which work has not been completed shall be exempt from the hereinafter stated parking requirements if the structure or building is completed within six months after the effective date of the ordinance codified in this title.

23.36.006 - Design and maintenance of off-street parking areas.

(1)

DRAINAGE. Driveways shall not exceed a grade of four percent and all parking lots except those for less that four vehicles shall be graded according to a drainage plan which has been approved by the city engineer. Catch basins, sumps and underground storm sewers may be required and all such lots and driveways shall be surfaced with a material to control dust and drainage.

(2)

LIGHTING. Any lighting used to illuminate an off-street parking area shall be shaded or diffused so as to reflect the light away from the adjoining property and away from abutting traffic.

(3)

All off-street parking areas shall be so designed and constructed that no part of any vehicle ever parked therein shall be nearer than one foot from the parking area property line.

(4)

FENCES IN CERTAIN PARKING AREAS. When a required off-street parking area for six cars or more is located adjacent to any "R" district, there shall be constructed and maintained a fence or wall of suitable material six feet in height to capture the vehicles' light beams and muffle the vehicle noise as well as meeting the safety and visibility requirements of Chapter 23.10.

23.36.008 - Required off-street parking.

With the exception of the B-2 (central business district), located in the downtown core business area (from the north side of 5 th Street SW to the south side of 2 nd Street SW and from the east side of Illinois Avenue SW to the west side of Kansas Avenue SE), the following minimum areas shall be provided and maintained by ownership, easement, or lease for and during the life of the respective uses hereinafter set forth:

(1)

Single family dwellings shall have at least one parking space for each dwelling unit of one thousand two hundred square feet or less and two parking spaces for each dwelling unit of over one thousand two hundred square feet, plus one additional parking space for each two boarders accommodated. A garage will fulfill this requirement. However, a building permit shall not be granted to convert a garage to living space unless other acceptable provisions are made to provide the required parking space.

(2)

Two family dwellings shall have at least one parking space per dwelling unit, but not more than one two car garage per unit.

(3)

Boarding houses shall have at least one parking space for each two beds.

(4)

Multiple dwellings shall have at least one and one-half parking spaces per unit in the "R-3", "R-4", and "R-5" residential districts. In the "B-2" district, one parking space per unit is required.

(5)

Hotels, apartment hotels, motels, tourist homes, or motor hotels shall have at least one parking space for each rental unit or lodging room provided in the design of the building, plus five additional parking spaces.

(6)

Schools, elementary and junior high, shall have at least one space for each classroom plus five additional spaces.

(7)

Schools, high schools through college, shall have at least one parking space for each three students based on design capacity, plus one additional space for each classroom.

(8)

Churches and clubs shall have at least one parking space for each three seats based on the design capacity of the main assembly hall.

(9)

Theaters, ballfields and stadiums shall have at least one parking space for each four seats of design capacity.

(10)

Hospitals shall have at least one and one-half parking spaces for each patient bed.

(11)

Nursing facilities or rest homes shall have at least one parking space for each two and one-half beds for which accommodations are offered; assisted living centers or continuing care retirement communities shall have at least one parking space for each five beds for which accommodations are offered, plus one additional space for each employee on the largest shift at said facility.

(12)

Medical or dental clinics shall have at least three parking spaces for each staff doctor or dentist, or one space for each one hundred fifty square feet of gross floor area, whichever is greater.

(13)

Drive-in food establishments shall have at least one parking space for each three seats or one hundred square feet of gross floor area in the building allocated to the drive-in operation, whichever is greater.

(14)

Bowling alleys shall have at least five parking spaces for each alley, plus additional spaces as may be required herein for related uses such as a restaurant.

(15)

Retail stores or service shops shall have at least one off-street parking space for each two hundred square feet of floor area.

(16)

Restaurants, cafes, bars, taverns and night clubs shall have at least one space for each three seats based on capacity design or where there is no design layout, one space for each thirty-five square feet of gross floor area.

(17)

Banks, offices and/or public office buildings shall have at least one parking space for each two hundred fifty square feet of gross floor area.

(18)

Undertaking establishments shall have one parking space for each five seats or thirty-five square feet of seating area where there are no fixed seats, plus one parking space for each two hundred fifty square feet of floor area not used for seating.

(19)

Furniture stores, appliance stores, wholesale and warehouses shall have at least one parking space for each four hundred square feet of gross floor area.

(20)

Open sales lots, lumber yards, auto sales and auto leasing shall have one parking space for each two thousand square feet of land up to the first eight thousand square feet plus one parking space for each four thousand square feet of land up to a parcel of twenty-four thousand square feet, plus one parking space for each six thousand square feet thereafter.

(21)

Auto repair, boat and marine sales, garden stores, carpenter shops shall have four parking spaces plus one for each eight hundred square feet of floor area over the first one thousand square feet.

(22)

Skating, dance hall, miniature golf, ice arena and clubs shall have ten parking spaces plus one additional space for each two hundred square feet of floor area devoted to the principal use.

(23)

Manufacturing, fabricating or processing of a product or material shall have four off-street parking spaces plus one for each five hundred square feet of floor area or one space for each employee on the largest shift, whichever is greater.

(24)

Warehouse, storage, handling of bulk goods in structures over six thousand square feet shall have at least one space for each two thousand square feet of gross floor area.

23.36.010 - Off-street loading and unloading areas.

(1)

LOCATION. All required loading berths shall be off-street and shall be located on the same lot as the building or use to be served. A loading berth shall not be located less than twenty-five feet from the intersection of two street rights-of-way; nor less than fifty feet from a residential unless within a building. Loading berths shall not occupy the required front yard set-back space.

(2)

SIZE. Unless otherwise specified in this title, a required loading berth shall not be less than ten feet in width, twenty-five feet in length and fourteen feet in height, exclusive of aisle and maneuvering space.

(3)

ACCESS. Each required loading berth shall be located with appropriate means of vehicular access to a street or public alley and shall be designed so that the vehicle being loaded or unloaded will not have to park in the public right of way.

(4)

SURFACING. All loading berths and accessways shall be improved with a durable material to control the dust and drainage according to a plan approved by the city engineer.

(5)

ACCESSORY USE. Any space allocated as a loading berth or access drive so as to comply with the terms of this title shall not be used for the storage of goods, inoperable vehicles or be included as a part of the space requirements necessary to meet the off-street parking area.

23.36.012 - Required loading berths.

(1)

Retail sales, office, public administration buildings, hospitals, schools, hotels and similar uses having five thousand to ten thousand square feet of floor area shall require one off-street loading berth; for each additional ten thousand square feet of floor area or fraction thereof above one-fourth, one additional loading berth.

(2)

Manufacturing, fabrication, warehousing, storing, servicing, and similar establishments having five thousand to thirty thousand square feet of floor area shall require one loading berth fifty feet in length.

(3)

Manufacturing, fabrication, processing and warehousing buildings having over thirty thousand square feet, loading facilities shall be provided at the ratio of one loading berth fifty feet long for each fifty thousand additional square feet plus one loading berth twenty-five feet in length for each one hundred thousand square feet.
