25 - "R-6" MOBILE HOME/MANUFACTURED HOME DISTRICT3

23.25.002 - Permitted principal uses.

Within any "R-6" mobile home/manufactured home district, no structure or land shall be used except for one or more of the following uses:

(1)

Mobile homes shall not exceed twenty (20) years of age from the date of manufacture;

(2)

Mobile homes or manufactured homes within mobile home/manufactured home parks and as regulated in Chapter 5.40;

(3)

Mobile homes, manufactured homes, or modular homes as defined in Section 23.08.119 and 23.08.125 within subdivided areas on individually platted lots owned or under the control of either the homeowner or the mobile home/manufacture home park;

(4)

Public or private parks and playgrounds subject to Section 23.10.026(2)(g);

(5)

Child care facilities, Class I.

23.25.004 - Conditional uses.

Within the "R-6" mobile home/manufactured home district, no structure or land shall be used for the additional following uses except by conditional use permit:

(1)

Public utility structure;

(2)

Child care facilities, Class II.

23.25.006 - Permitted accessory uses.

Within any "R-6" mobile home/manufactured home district, the following uses shall be permitted accessory uses:

(1)

Private garages on individually owned lots;

(2)

Accessory buildings other than private garages not to exceed one hundred sixty square feet;

(3)

Any use permitted in Section 23.16.006(3) through (10) and as regulated therein.

23.25.008 - Lot area, height, lot width and yard requirements for individually owned lots.

Lot area, height, lot width and yard requirements for individually owned lots shall be as follows:

(1)

No accessory building shall exceed fifteen feet in height.

(2)

The following minimum requirements shall be observed on individually owned lots within mobile home/manufactured home subdivisions subject to the additional requirements, set forth in Chapter 23.38.010:

(b)

Within the mobile home subdivision bounded by 24th Street S.W. on the north, 27th Street S.W. on the south, Highway 37 on the east and Wisconsin Avenue S.W. on the west, the following special yard requirements shall be observed:

(i)

On lots numbered 10, 11, 12, 13, 22, 23, 24, 25, Block 1, South Terrace Addition, front yard minimum setback shall be that which is left after taking into consideration the rear yard minimum requirement of ten feet plus the maximum length of the mobile home which is seventy-five feet.

(ii)

Maximum length of homes shall be seventy-five feet exclusive of the tongue; except Lot 13, Block 1, South Terrace Addition, where the maximum length of the home shall be sixty-five feet, exclusive of the tongue.

(3)

In no case may any structure except for fences be constructed in utility easement areas along front, side or rear property lines.

(4)

If a detached accessory building is constructed three feet (or less by variance) from the property line, the roof overhang on the building will be limited to one foot including stormwater gutters.

23.25.010 - Location, space and general layout of mobile home/manufactured home parks established prior to August 29, 2000.

(1)

MOBILE HOME/MANUFACTURED HOME PARK AREA. The area for a mobile home/manufactured home park shall be not less than eight acres. There shall be no mobile home/manufactured home or structures located closer than ten feet from the perimeter of the mobile home/manufactured home park. An existing licensed mobile home/manufactured home park may be extended or expanded in tracts of less than the eight-acre minimum required by this chapter but the total mobile home/manufactured home park must then be in compliance with all of the other minimum requirements of this section.

(2)

YARD REQUIREMENTS. Front, rear, and side yards shall be not less than fifteen, ten and ten feet respectively, and not less than fifteen feet on the main entrance side. Use of the front yard areas shall be limited to landscaping, fencing, and uncovered vehicular parking. Trees and shrubs may be planted in this area but not closer than twenty-five feet from the intersection of street right-of-way lines at corners.

(3)

EXCEPTIONS TO YARD REQUIREMENTS. A detached garage, canopy, enclosed or open porch, carport, deck, or detached accessory building may project into a required side or rear yard provided it is located no closer than five feet to the edge of the mobile home/manufactured home space.

(4)

DENSITY.

(a)

Eight units per net acre shall be the maximum density.

(b)

Net acre shall be the area remaining after deduction of the area set forth for setbacks, streets and recreation and other common areas.

(c)

Minimum mobile home/manufactured home space size shall be five thousand square feet.

(d)

Every mobile home/manufactured home space shall abut on a driveway or other clear area with unobstructed access to a public street. Such spaces shall be defined.

(e)

It is unlawful to locate a mobile home/manufactured home so that any part of such mobile home/manufactured home will obstruct any roadway or walkway in a mobile home/manufactured home park.

(f)

It is unlawful to allow any mobile home/manufactured home to be occupied in a mobile home/manufactured home park unless the mobile home/manufactured home is situated on a mobile home/manufactured home space.

(5)

REQUIRED RECREATION AREAS.

(a)

In all parks accommodating or designed to accommodate twenty-five or more mobile homes/manufactured homes, there shall be one or more recreation areas which shall be easily accessible to all park residents.

(b)

The size of such recreation areas shall be based upon a minimum of one hundred square feet for each mobile home/manufactured home space. No outdoor recreation area shall contain less than two thousand five hundred square feet.

(c)

Recreation areas shall be so located as to be free of traffic hazards and should, where the topography permits, be centrally located.

(d)

All playground equipment shall be of such construction, so as not to be less than the recommended standards as established by the National Recreation and Parks Association.

(6)

MOBILE HOME/MANUFACTURED HOME PARK INTERNAL STREET SYSTEM AND CAR PARKING.

(a)

General Requirements. All mobile home/manufactured home parks shall be provided with safe and convenient vehicular access from abutting public streets on internal streets. Such access shall be provided by street, driveways or other means.

(b)

Park Entrances. Entrances to mobile home/manufactured home parks shall be designed to minimize congestion and hazards and allow free movement of traffic on adjacent streets. No parking shall be permitted within fifty feet of the public street on the park entrance streets, which shall be at least thirty-six feet wide. One entrance is required for each twenty-five mobile home/manufactured homes.

(c)

Internal Streets. Surfaced roadways shall be of adequate width to accommodate anticipated traffic and in any case shall meet the following minimum requirements:

(i)

All street rights-of-way shall be fifty-two feet; including four-foot wide sidewalks, a four-foot boulevard between sidewalk and curb, and a street width of thirty-six feet from back of curb to back of curb;

(ii)

Dead-end streets shall be limited in length to five hundred feet and shall be provided at the closed end with a turn-around having an outside roadway diameter of at least sixty feet.

(d)

Car Parking. Off-street parking areas shall be provided for the use of park occupants and guests. Such areas shall be furnished at a rate of at least two car spaces for each mobile home/manufactured home space and located on that space. Parking areas shall be constructed of all weather material such as gravel, asphalt, or concrete. Designated car parking spaces shall not obstruct the common walk system.

(e)

Required Illumination of Park Street Systems. All parks shall be furnished with lighting units so spaced and equipped with luminaries placed at such mounting heights as will provide the following average maintained levels of illumination for the safe movement of pedestrians and vehicles at night:

(i)

All parts of the park street systems: 0.3 footcandle;

(ii)

Potentially hazardous locations, such as major street intersections and steps or stepped ramps shall be individually illuminated, with a minimum of 0.6 footcandle.

(f)

Street Construction and Design Standards.

(i)

Surface. All streets shall have curb and gutter and be hard surfaced and be durable and well drained under normal use and weather conditions. Street surfaces shall be maintained free of cracks, holes and other hazards.

(ii)

Grades. Grades of all streets shall be sufficient to ensure adequate surface drainage.

(iii)

Intersections. Within one hundred feet of an intersection, streets shall be at approximately right angles. A distance of at least one hundred fifty feet shall be maintained between center-lines of offset intersecting streets. Intersections of more than two streets at one point shall be avoided.

(7)

WALKS.

(a)

General Requirements. All parks shall be provided with safe, convenient, all-season pedestrian access of adequate width for intended use, durable and convenient to maintain, between individual mobile home/manufactured homes, the park streets and all community facilities provided for park residents. Sudden changes in alignments and gradient shall be avoided.

(b)

Common Walk System. A common walk system shall be provided and maintained on both sides of all internal streets and along the perimeter of the park adjacent to street or highway rights-of-way. Such common walks shall have a minimum width of four feet and shall be set back four feet from the line of the street curb. The interior and perimeter sidewalk system shall be constructed of concrete.

(c)

Individual Walks. All mobile home/manufactured homes shall be connected to the common walk system. Such individual walks shall have a minimum width of thirty inches.

23.25.012 - Location, space and general layout of mobile home/manufactured home parks established after August 29, 2000.

Figure 23.25.012 shall illustrate some of the provisions of this section.

(1)

MOBILE HOME/MANUFACTURED HOME PARK AREA. The area for a mobile home/manufactured home park shall be not less than eight acres. An existing licensed mobile home/manufactured home park may be extended or expanded in tracts of less than an eight acre minimum required by this chapter but the total mobile home/manufactured home park must then be in compliance with all of the other minimum requirements of this section.

(2)

PARK BUFFER STRIP. The mobile home/manufactured home park shall be surrounded by a forty-foot landscaped area along the street frontage of an arterial street, twenty-five feet along other street frontages and fifteen feet along other park boundaries. The buffer strip(s) shall be located on park property not including any public street right of way. The buffer strip(s) shall be exclusive of individual mobile home/manufactured home space setbacks. Refer to Figure 23.25.012 for illustration.

(3)

YARD REQUIREMENTS. Front, rear, and side yards shall be not less than twenty, ten and ten feet respectively. (4)

(6)

(b)

The size of such recreation areas shall be based upon a minimum of two hundred fifty square feet for each mobile home/manufactured home space. No outdoor recreation area shall contain less than six thousand two hundred fifty square feet. Required buffer strips shall not be counted toward total amount of recreation area.

(c)

Recreation areas shall be so located as to be free of traffic hazards and should, where the topography permits, be centrally located.

(d)

All playground equipment shall be of such construction, so as not to be less than the recommended standards as established by the National Recreation and Parks Association.

(7)

WIND RESISTANT STRUCTURE. A minimum of seven square feet per mobile home/manufactured home space of wind resistant structure shall be provided. The structure shall be constructed in accordance with the most current edition of the ICC Residential Building Code adopted by local resolution and with an occupancy classification of an essential facility.

(8)

MOBILE HOME/MANUFACTURED HOME PARK INTERNAL STREET SYSTEM AND CAR PARKING.

(a)

General Requirements. All mobile home/manufactured home parks shall be provided with safe and convenient vehicular access from abutting public streets on internal streets. Such access shall be provided by street, driveways or other means.

(b)

Park Entrances. Entrances to mobile home/manufactured home parks shall be designed to minimize congestion and hazards and allow free movement of traffic on adjacent streets. No parking shall be permitted within fifty feet of the public street on park entrance streets, which shall be at least thirty-six feet wide. One entrance is required for each twenty-five mobile home/manufactured homes.

(c)

Driveways. Every mobile home/manufactured home space shall abut on a driveway or other clear area with unobstructed access to an internal street. Such driveway surfaces shall be constructed of all weather material, such as gravel, asphalt, or concrete.

(i)

Driveways shall be a minimum width of twenty feet and a maximum width of twenty-four feet.

(ii)

No individual mobile home/manufactured home driveway shall enter/exit onto a city/county/state street/road or highway.

(d)

Internal Streets. Surfaced roadways shall be of adequate width to accommodate anticipated traffic and in any case shall meet the following minimum requirements:

(i)

All street rights-of-way shall be fifty-two feet; including four-foot wide sidewalks, a four-foot boulevard between sidewalk and curb, and a street width of thirty-six feet from back of curb to back of curb;

(ii)

Dead-end streets shall be limited in length to five hundred feet and shall be provided at the closed end with a turn-around having an outside roadway diameter of at least eighty feet.

(e)

Car Parking. Off-street parking areas shall be provided for the use of park occupants and guests. (9)

WALKS.

(a)

General Requirements. All parks shall be provided with safe, convenient, all-season pedestrian access of adequate width for intended use, durable and convenient to maintain, between individual mobile home/manufactured homes, the park streets and all community facilities provided for park residents. Sudden changes in alignments and gradient shall be avoided.

(b)

Common Walk System. A common walk system shall be provided and maintained on both sides of all internal streets and along the perimeter of the park adjacent to street or highway rights-of-way. Such common walks shall have a minimum width of four feet and shall be set back four feet from the line of the street curb. The interior and perimeter sidewalk system shall be constructed of concrete.

(c)

Individual Walks. All mobile home/manufactured homes shall be connected to the common walk system. Such individual walks shall have a minimum width of thirty inches.

23.25.014 - Alterations and additions to homes in a mobile home/manufactured home park.

(1)

All plumbing and electrical alterations or repairs in the mobile home/manufactured home park shall be made in accordance with applicable state and local regulations.

(2)

Skirting of mobile homes/manufactured homes with approved materials is required within thirty days after placement of the mobile home/manufactured home. Skirting shall be prefabricated, factory-designed plastic or polystyrene. The use of any other materials shall require written approval by the building inspector prior to installation. Areas enclosed by such skirting shall be maintained so as not to provide a harborage for rodents, or create a fire hazard.

(3)

No permanent additions shall be built onto or become a part of any mobile home/manufactured home except that temporary entryways or additions are authorized. Entryways and/or additions shall not exceed ten feet in width by sixteen feet in length. Any entryway and/or additions must meet the required yard setbacks. Only one door of the mobile home/manufactured home may be enclosed in an entryway. Any addition shall comply with all other applicable codes and regulations.
