§ 4.20

FENCES.

   1.   General Requirements.
      a.   A Building Permit is required for the construction of all fences.
      b.   Fence, walls, or landscaping shall not be erected, constructed, or maintained in conflict with the corner lot vision clearance requirements established in Section 4.06.8. of this Ordinance.
      c.   No fence of shrubbery may be erected, constructed or maintained to impede natural stormwater run-off on any portion of a lot or any adjoining lot or land.
      d.   Where there is a change in grade between adjoining lots, the height of fences shall be measured from the average grade within six (6) feet on either side of the line where the fence is to be erected. If the grade change is greater than one (1) foot within this twelve (12) foot area, it will be necessary to provide a detail showing the cross section of the terrain at the fence line. This detail shall be reviewed by the Building Commissioner to determine the average grade height.
      e.   All fences shall be installed so that the finished side faces out.
      f.   All structural supports shall be installed on the inside of the fencing material (i.e., fence panel, chain-link mesh, etc.). Exception shall be provided for fences where the fence material is installed at the center-point of each post.
   2.   Required Fences: The following fences are required and shall be constructed as follows:
      a.   A minimum six (6) foot solid fence is required along the lot line of lots in districts zone business and manufacturing where such lot line abuts a lot in the Residence District when the residential use predates the business or manufacturing use. Maximum height of the fence permitted shall be eight (8) feet.
      b.   A minimum six (6) foot high solid fence shall be erected along the lot line of lots in R-3 Residence Districts which are being developed with multi-family swelling units as described under Section 3.01 where such lot lines abut a lot in R-1 or R-2 Single-Family Residence Districts. Maximum height of the fence permitted shall be eight (8) feet.
      c.   A minimum seven (7) foot high solid fence solid fence shall be erected to enclose and provide screening of all trash/garbage receptacles for non-residential uses. Maximum height of the fence enclosure shall be eight (8) foot high.
      d.   Security and Silt Fencing must be installed prior construction beginning as required by the permit issued and the Village. All security and silt fencing must be maintained and kept in good working condition throughout the entire construction period. All security and silt fencing must be removed within ten (10) days after final inspections have been passed.
   3.   Swimming Pools: Swimming pools shall be accompanied by adequate enclosure, compliant with regulations identified in Chapter 150: Building Code of the Village of Itasca, IL Code of Ordinances.
   4.   Prohibited Fences and Gates: The following fences are hereby prohibited:
      a.   Barbed wire, chicken wire (unless used to enclose a rear or side yard garden), pig wire, rope, cable and electrically charged wire, and other similar materials except on fences enclosing property owned by a tax levying body.
      b.   Snow fences, except those erected for the sole purpose of controlling drifting snow between November 1 and March 31, installed only on that portion of a lot which faces or abuts a road, street or highway.
      c.   Chain link fences with barbed ends up.
      d.   No gate or fence is permitted across a driveway in the front or corner side-yard setback or past the front- or corner-wall of the principal structure in any Residence District.
   5.   Fence Locations:
      a.   All fences shall be properly constructed on the fence owner's property.
      b.   All fences shall be permanent except for garden fences which enclose a garden in a side- or rear-yard and does not exceed three (3) feet in height.
      c.   All fences shall be constructed on the property line, except for the following circumstances:
         (1)   When the fence returns to the existing building or structure to enclose a yard;
         (2)   When the privacy fence screens the patio in R-3, General Residence District;
         (3)   When dog enclosures or runs enclosing less than twenty percent (20%) of the lot size and setback a minimum of five (5) feet from all property lines.
   6.   Fence Bulk Standards:
      a.   Residence Districts (R-1, R-2, R-3):
         (1)   Solid (Privacy Fences): Maximum height of four (4) feet with an optional one (1) foot open top.
         (2)   Solid (Privacy Fences) which are located on the common property line with a non-residential use are permitted to be a maximum height of six (6) feet.
         (3)   Open Fences: Maximum height of six (6) feet.
         (4)   Open Fences enclosing an approved regulation size tennis court are permitted to be a maximum height of ten (10) feet.
         (5)   Open fences at public baseball fields, basketball courts, or other parks and fields operated by a tax levying body.
         (6)   Patio Screening Fences: Maximum height of six (6) feet and maximum length of thirty-six (36) lineal feet in the R-3, General Residence District. The fence shall be abutting the rear wall of the principal structure and shall not enclose the rear-yard.
      b.   Business Districts (B-1, B-2, B-3, B-4, B-5, B-6): 
         (1)   Garbage/Trash Enclosures as required per Sec. 4.20.2.c.
         (2)   Solid (Privacy Fences) as required per Sec. 4.20.2.a.
      c.   Office-Research District (O-R): 
         (1)   Garbage/Trash Enclosures as required per Sec. 4.20.2.c.
         (2)   Solid (Privacy Fences) as required per Sec. 4.20.2.a.
      d.   Regional Office Center District (ROC): 
         (1)   Garbage/Trash Enclosures as required per Sec. 4.20.2.c.
         (2)   Solid (Privacy Fences) as required per Sec. 4.20.2.a.
      e.   Limited Manufacturing District (M-1): 
         (1)   Garbage/Trash Enclosures as required per Sec. 4.20.2.c.
         (2)   Solid (Privacy Fences) as required per Sec. 4.20.2.a.
         (3)   Solid (Privacy Fences): Maximum height of eight (8) feet.
         (4)   Open Fences: Maximum height of twelve (12) feet.
   7.   Non-Conforming Fences: Non-Conforming Fences shall follow the provisions stated in Sec. 5.00 - Non-Conforming Buildings, Structures, and Uses.
