38 - AA AIRPORT APPROACH ZONE

19.38.010 - Purpose.

The purpose and function of the airport approach zone is to safeguard the public safety and welfare and properties in, adjacent to, and surrounding aircraft landing fields by placing height restrictions and other regulations thereon. The airport approach zone shall be superimposed upon the zoning district applied and in effect for the land upon which is located the aircraft landing field and for adjacent and surrounding land coming under the regulations of this chapter. The zone shall regulate the various types of air space obstructions and other hazards which may interfere with safe landing and taking off of aircraft, including:

A.

The height of structures and objects of natural growth;

B.

Conditions or activities which may cause electronic interference with air navigation communication systems;

C.

Lights which may interfere with airport lighting systems;

D.

Conditions or activities which produce levels of smoke, dust and glare that would interfere with safe operations;

E.

Conditions or activities creating bird strike hazards.

19.38.020 - Permitted uses.

Principal uses permitted outright in an airport approach zone are as follows:

A.

Any use permitted outright or as an accessory use, or as a conditional exception in the zoning district on which is superimposed an airport approach zone and the adjacent and surrounding land coming under the regulations imposed by this chapter;

B.

Aircraft landing field.

19.38.030 - Area of jurisdiction.

The area(s) of jurisdiction for this title lies within the boundaries of all general aviation airports in the county, existing or future, and all of the area adjacent and surrounding the same, with any and all additions thereto and extensions thereof, hereby is established as within the boundaries of the zone described as follows:

AA Airport Approach Zones. One foot in height for each twenty feet in horizontal distance beginning at a point two hundred feet from and at the centerline elevation of the end of the runway and extending to a point five thousand two hundred feet from the end of the runway; the AA approach zone is two hundred fifty feet wide at the point of beginning (two hundred feet past the end of the runway), broadening to seven hundred feet wide at a distance of two thousand two hundred fifty feet from the point of beginning, continuing at seven hundred feet wide therefrom to the end of the zone, this zone being bisected by the centerline of the runway.

All of the foregoing zoning distances, elevations, and details being set forth upon the drawing and map thereof which is on file in the offices of the auditor and planning department and expressly incorporated herein by reference.

19.38.040 - Restrictions.

A.

No building, pipe, chimney, tower, steeple, stand, platform, pole, wire or structure or erection or object of natural growth, or obstruction of any kind or nature whatsoever, shall be built, placed, hung, or permitted to grow or allowed to be built, placed or hung, which shall at any point or part thereof exceed the heights as provided in the zone area so established. Said restrictions shall apply to the area surrounding all runways and approaches situate to any utility airport open to public use.

B.

No searchlight, beacon light, or other glaring light shall be used, maintained, or operated within one-half mile of said airport, so that the same shall reflect, glare, or shine upon or in the direction of said airports.

C.

No glare producing materials shall be used on the exterior of any structure located within the airport approach district.

D.

Any electromagnetic radiation that would interfere with normal aircraft communication is prohibited.

E.

Any land use or activity that produces smoke or haze to a degree that would interfere with normal aircraft operations is prohibited.

F.

Any land use or activity that produces excessive bird strike hazard in the air space zones designated in Section 19.38.030 is prohibited.

G.

All new airports, heliports, or landing fields shall be designed so that the incidence of aircraft passing in the vicinity of dwellings or places of public assembly is minimized. They shall be located so that air traffic shall not constitute a nuisance to neighboring uses. The proponents shall show that adequate controls or measures will be taken to reduce noise levels, vibrations, dust, or bright lights.

19.38.050 - Application.

This designation may be superimposed over any of the zone districts and its restrictions shall take precedence.
