CHAPTER 18

96 P-S PUBLIC SAFETY COMBINING DISTRICT

§ 18.96.010 Intent.

The regulations of this chapter shall be applied to protect life and property in areas which may be unsafe for human habitation because of natural conditions such as rough topography, possible inundation, geologic hazards and fire hazards, or because of close proximity to places of storage of explosives or inflammable materials including highways or other roads giving access to such places of storage, or because of other hazardous conditions. Close proximity is defined as any area within a radius of one mile outside any point on the boundary line of such places of storage, or one mile from any point on the centerline of such highways or other roads giving access to such places of storage.

§ 18.96.020 Applicability.

The regulations set out in this chapter shall apply in all districts with which are combined P-S districts in addition to the regulations specified in this title, and shall be subject to the provisions of Chapters 18.102 through 18.108 of this title; provided, however, that if any of the regulations specified in this chapter differ from any corresponding regulation specified in this title for any district with which a P-S district is combined, then in such case the provisions of this chapter shall apply.

§ 18.96.030 Special provisions.

Special provisions for a P-S district shall be as follows:
(1) 
No residence, or building or structure designed or intended for human habitation shall be permitted unless a use permit shall first have been secured in each particular case.
(2) 
No use permit shall be approved for any use in any district with which is combined a P-S district until an investigation is conducted and a report is submitted to the planning commission by a competent authority in each particular case. Such authority shall be a public official having jurisdiction over lands within the district and shall be designated by the planning director to be the competent authority for the particular case.
