CHAPTER 17

02 - PURPOSE AND INTENT

17.02.010 - Title.

The provisions of this title shall be referred to as the "zoning code."

17.02.020 - Purpose.

The purpose of the regulations contained in this title that classify, designate, regulate and restrict the use of buildings, land and structures, is to permit the most compatible use of land within the city, consistent with the needs of residential, commercial and industrial developments, and the promotion of the public health, safety, welfare and general prosperity of the city and its residents.

17.02.030 - Applicability of provisions to city owned or leased property.

The regulations contained in this title shall not apply to city owned or leased property, when actually in use by the city.

17.02.040 - Regulations deemed minimum standards.

In applying these regulations to uses within the city, the same shall be deemed to be the minimum standards required for the promotion of the public health, safety, interest and welfare, unless the context of a specific regulation provides otherwise.

17.02.050 - Reference to other laws—Applicability to amendments.

Whenever reference is made to other provisions of this or any other law, the reference shall apply to present and future amendments unless otherwise stated.

17.02.060 - Continuations of existing permits.

Any zone variances, zone exceptions, conditional or special use permits, unclassified use permits and/or precise plans (hereafter "zoning device") issued by the city, or by the county, shall remain in full force and effect; provided, that each zoning device is subject to provisions of Chapter 17.54 of this code. Notwithstanding any other provisions, no use authorized by such previously granted zoning device, which is in compliance with all conditions of approval, shall be deemed nonconforming for any purpose, except as specifically set forth herein.

17.02.070 - Process regarding pending proceedings.

If, as of the effective date of these regulations, legislative or administrative action is pending involving the former zoning regulations of the city, such action shall be taken according to the provisions of this title, and shall be finally processed, as far as possible, in accordance with the provisions hereof, except that any project for which a valid building permit application has been received, such project may proceed as provided for by the Uniform Building Code.

17.02.080 - Effective date.

The effective date of each of the regulations shall be the date of the city council ordinance which adopted such regulations unless a later date is specified in a particular regulation.
