CHAPTER 6

ZONING DISTRICTS

6.1 - Establishment of zoning districts.

For the purposes of this Ordinance, the Village of North Aurora is divided into the following zoning districts:

A.

Residence Districts:

R-1 Single-Family Residence District

R-1A Single-Family Residence District

R-2 Single-Family Residence District

R-2A Two-Family Residence District

R-3 General Residence District

R-4 General Residence District

E-R Estate Rural Residence District

E-1 Estate One-Acre Residence District

E-3 Estate Standard District

B.

Business Districts:

B-1 Community Business District

B-2 General Commercial District

B-3 Central Business District

C.

Industrial Districts:

I-1 Limited Industrial District

I-2 General Industrial District

D.

Special Districts:

O-R Office and Research District

O-R-I Office Research and Light Industrial District

6.2 - Zoning map.

A.

Location of Districts. The location and boundaries of the districts established by this Ordinance are set forth on the zoning map entitled "Zoning District Map," which is periodically updated, incorporated and made a part of this Ordinance. The map, together with all notations, references and other information shown thereon, and all amendments to it, shall be a part of this Ordinance and shall have the same force and effect as though fully set forth and described in this Ordinance. When there is a conflict between the Zoning District Map and any zoning map amendment thereto, the amendment shall control.

B.

Interpretation of Boundary Lines.

District boundary lines are the center lines of highways, streets, alleys, and easements, or rights-of-way lines of railroads, toll roads, and expressways, or section, division of section, tract and lot lines, or such lines extended, unless otherwise indicated.

In areas not subdivided into lots and blocks, wherever a district is indicated as a strip adjacent to and paralleling a street or highway, the depth of such strip shall be in accordance with dimensions shown on the map measured at right angles from the center line of the street or highway, and the length of frontage shall be in accordance with dimensions shown on the map from section, quarter section, or division lines, or center lines of streets and highways, or railroad rights-of-way, unless otherwise indicated.

Where a district boundary line divides a lot in single ownership on the effective date of this Ordinance, the Plan Commission, after due hearing per Section 4.1 (Zoning Text and Map Amendment), may extend the regulations for the more intensively zoned land to include the less intensively zoned portion provided that the less intensively zoned portion is less than six thousand (6,000) square feet in area.

All streets, alleys, public-ways, and rail rights-of-way, if not otherwise specifically designated, shall be deemed to be in the same zoning use district as the property immediately abutting it or to the middle of it where different zoning districts adjoin.

6.3 - Annexed land.

Any territory hereafter annexed into the Village of North Aurora shall automatically, upon annexation, be classified in the E-R Estate Rural Residence District. Such land shall be subject to the requirements of this E-R Estate Rural Residence District, unless otherwise provided for in the annexation agreement or until such territory is rezoned.

6.4 - Exemptions for public utilities.

The following essential services and utilities are permitted to be erected, constructed, altered, and/or maintained in any zoning district:

A.

Traffic signals, fire hydrants, and similar equipment and accessories.

B.

Elevated or underground water storage tanks.

C.

Storm and sanitary sewer collection and disposal systems.

D.

Underground utility poles, wires, mains, drains, pipes, conduits and cables reasonably necessary for the furnishing of adequate service by public utilities, municipal or other governmental agencies for the public health, safety, convenience, comfort, and general welfare, provided that the facilities are properly located in a lawfully granted easement for the purpose of providing such service.

6.5 - Uses not specifically identified.

Any use that is not specifically identified herein as a permitted or special use in the Residential, Business, Industrial or Specific Use Districts shall be allowed only as a special use in the I-2 General Industrial District.
