It is the intent of this district to provide a limited range of retail and service oriented commercial uses in areas located along major and minor arterial streets generally located within R-1, 2, 3 and 4 Residential Districts. These neighborhood commercial areas are not associated with B-2 Highway Commercial Corridors or with the B-3 Downtown Commercial District. The regulations set forth in this subchapter, or set forth elsewhere in this chapter when referred to in this subchapter are the regulations in the B-1 Business District.

   In district B-l, no building or structure shall be hereafter erected, constructed, reconstructed, moved or altered except for 1 or more of the following uses:

   (A)   Banks;

   (B)   Receiving store for dry or steam cleaning;

   (C)   Barbershops, beauty parlors and chiropody, massage or similar personal service shops;

   (D)   Business or commercial schools or dancing or music academies;

   (E)   Hospital and clinics for animals, but not open kennels;

   (F)   Self-service laundries and dry cleaners;

   (G)   Messenger and telegraph service stations;

   (H)   Custom dressmaking, millinery, tailoring, shoe repairing, or similar trades;

   (I)   Stores or shops used to conduct a retail business, including eating establishments;

   (J)   Shopping centers, 3 acres. The following businesses are allowed only in a shopping center complex in a B-l Business District:

      (1)   Service stations;

      (2)   Shops for repair of electrical, radio and television equipment and other commodities, but not involving manufacturing on the premises;

      (3)   Carwashes;

      (4)   Bowling alleys, miniature golf courses and golf driving ranges; and

      (5)   Restaurants and drive-ins.

   (K)   Private clubs;

   (L)   (1)   Administrative services and offices;

      (2)   Governmental services and offices;

      (3)   Detention facilities and jails;

      (4)   Group care facility;

      (5)   Convalescent services;

      (6)   Educational services;

      (7)   College and university facilities;

      (8)   Religious assembly must comply with off-street parking and loading regulations;

      (9)   Social clubs;

      (10)   Recreational clubs;

      (11)   Cultural services;

      (12)   Guidance services;

      (13)   Hospital services;

      (14)   Utility services;

      (15)   Postal facilities;

      (16)   Public assembly;

      (17)   Safety services;

      (18)   Theaters;

      (19)   Playhouses; and

      (20)   Convention centers.

   (M)   Banks and detached banking facilities (ATM);

   (N)   Grocery stores;

   (O)   Mini-malls;

   (P)   Convenience store or filling station;

   (Q)   Medical clinic;

   (R)   Office buildings used only for the administration functions of companies, corporations, social or philanthropic organizations or societies;

   (S)   Professional offices limited to: accountants, architects and engineer's, brokers, planners, dentists, real estate and insurance, lawyers, landscape architects, chiropractors, doctors; and

   (T)   Service facilities limited to: mortuaries, photographic studios, schools, churches, physical therapy, counseling services for rehabilitation, treatment or therapy, and child care centers or preschools, provided they meet child care center standards in § 156.304(D)(1) through (14).

   The following conditional uses maybe located in the B-l District, subject to the provisions hereof:

   (A)   Apartments or living quarters situated in an office or business building;

   (B)   Beer parlors, taverns, bars and nightclubs;

   (C)   Towers, telecommunication facilities, antennas, subject to the provisions of § 156.305 pertaining to same;

   (D)   Establishments that provide lodging, meals, clinic for health care, thrift shop, office space, counseling services, emergency housing for short periods of time and transitional housing for extended periods of time;

   (E)   Clubs, fraternities, lodges and meeting places of a non-commercial nature;

   (F)   Accessory uses or off-street parking lots that are separated from the main use by an alley or street; and

   (G)   Crematory; an establishment with furnace for the cremation of dead animal bodies or dead human bodies.

   The following accessory buildings and uses are permitted in the B-l District:

   (A)   Use and structures clearly incidental to the permitted uses are permitted;

   (B)   Any building used primarily for any of the permitted uses may not have more than 40% of the floor area devoted to the storage purpose incidental to the primary use; and

   (C)   Signs are permitted in accordance with Chapter 154 of this code.

   Setback and height regulations in the B-l District are as follows:

   (A)   Front yard. Minimum front yard is 20 feet.

   (B)   Side yard. No side yard setback is required, provided, however, that if a side yard setback is provided it must be no less than 5 feet. If the property is adjacent to a property whose zoning requires a side yard setback, then a setback of no less than 5 feet must be provided. When property is adjacent to a public alley, the setback shall be no less than 5 feet. On the side of a lot abutting an A or R District or where the side yard adjoins a street, setbacks shall be no less than 10 feet.

   (C)   Rear yard. No rear yard is required, except where abutting an A or R District, where the rear yard shall be no less than 25 feet.

   (D)   Height. Maximum height is 2-1/2 stories or 35 feet above grade.
