R-2 DWELLING

DISTRICT

§ 156.100 INTENT.

   This district is intended to provide for residential uses consisting primarily of single- and 2-family dwellings and accessory structures, but also including the permitted and conditionally permitted uses set forth in this district. The regulations set forth in this subchapter, or set forth elsewhere in this chapter when referred to in this subchapter, are the district regulations in the R-2 Dwelling District.

§ 156.101 PERMITTED USES.

   Permitted uses are allowed outright provided the uses and/or structure meet the minimum requirements of the district. Permitted uses are shown in § 156.150.

§ 156.102 CONDITIONAL USES.

   The uses are subject to any conditions listed in this section as well as any conditions relating to the placement of said use on a specific tract of ground in the R-2 District as recommended by the Planning Commission and approved by the City Council. Conditional uses are shown in § 156.150.

§ 156.103 TEMPORARY USES.

   Temporary uses may be permitted provided a temporary use permit is obtained and said temporary use is eliminated at the expiration of the permit (see § 156.297). Temporary uses are shown in § 156.150.

§ 156.105 HEIGHT AND LOT REQUIREMENTS.

   (A)   The height and minimum lot requirements shall be as follows:

Notes:
(1)   The side yard along the common wall shall be 0 feet. The common wall shall be along the adjoining lot line.
(2)   The side yard setback shall be 10 feet if the structure is over 30 feet in height.
(3)   See § 156.026.
(4)   The total lot coverage shall not exceed 55%.
(5)   On corner lots the following criteria apply to setbacks. In existing developed areas, the street side yard setback may conform to existing setbacks of existing single-family structures, two family structures and multiple family structures along that street. In new developments, the street side yard setback shall be equal to the front yard setback.
(6)   The maximum height may be increased through the conditional use permit process.
(7)   All interior units may be a minimum of 20 feet wide per unit; while, all exterior units shall have a minimum of 30 feet of width per unit.
(8)   On lots less than 75 feet in width, the side yard setback may be reduced to 5 feet.
 
   Example of Different Yard Requirements:
 
   (B)   Supplemental residential regulations.
      (1)   Single-family attached/townhouses.
         (a)   Common wall shall have a zero-lot line setback and be located on the property line separating both dwellings.
         (b)   Each unit is separated by a by a fire rated wall from the lowest level and continuing to the roof deck. Rating specified in the IRC (International Residential Code) or IBC (International Building Code).
         (c)   Each unit shall be serviced by separate facilities.
         (d)   When each unit is in separate ownership, the accompanying lot shall not be in common ownership with any other unit.
         (e)   The structure shall be limited to a maximum of 6 attached units.
