B-2 HIGHWAY

COMMERCIAL DISTRICT

§ 156.195 GENERALLY.

   The B-2 Highway Commercial District is intended for the purpose of servicing highway travelers and local residents with automotive related uses or commercial uses at higher densities generally accessed by motor vehicles. The regulations set forth in this subchapter, or set forth elsewhere in this chapter when referred to in this subchapter are the regulations in the B-2 Business District.

§ 156.196 PERMITTED USES.

   In District B-2, no building or structure shall be hereafter erected, constructed, reconstructed, moved or altered except for 1 or more of the following uses:
   (A)   Any use permitted in the B-l Business District;
   (B)   New and used vehicle dealers, garages or service stations; provided that, none of the activities of a junk dealer, auto wrecking or salvage shall be carried on in this classification;
   (C)   Bowling alleys, miniature golf courses or driving ranges;
   (D)   Motels or hotels;
   (E)   Restaurants;
   (F)   Drive-in establishments;
   (G)   Farm and industrial equipment sales and services as an automatically allowed use in a B-2 zone; provided that none of the activities of a junk dealer, equipment wrecking or salvage shall be carried on in this classification;
   (H)   Printing and publishing establishments;
   (I)   Car wash facilities;
   (J)   Commercial operations and businesses, intended for the purpose of servicing travel and recreational users;
   (K)   Garden centers and landscaping nurseries;
   (L)   Mobile homes sales;
   (M)   Service stations;
   (N)   Shopping centers; and
   (O)   Child care centers or preschools, provided they meet child care center standards in § 156.304(D)(1) through (14).

§ 156.197 CONDITIONAL USES.

   (A)   The following conditional uses may be located in the B-2 District, subject to the provisions hereof:
      (1)   Any conditional use permitted in the B-1 Commercial District;
      (2)   Enclosed manufacturing, provided the uses are not obnoxious or offensive by reason of emission of odor, dust, smoke, gas or noise;
      (3)   Lumberyards;
      (4)   Truck terminals and truck wash facilities;
      (5)   Apartments or living quarters situated in an office or business building;
      (6)   Beer parlors, taverns, bars and nightclubs;
      (7)   Miniwarehouses;
      (8)   Towers, telecommunication facilities, antennas, subject to the provisions of § 156.305 pertaining to same;
      (9)   Campgrounds and RV parks;
      (10)   Recycling centers, with enclosed storage areas;
      (11)   Cargo containers storage; and
      (12)   Building contractor's office with storage facilities.
      (13)   Aboveground storage of LNG (liquid natural gas), subject to the provisions of § 156.308(D).
   (B)   In authorizing any of the permitted or conditional uses in this District, it shall be required that all storage of materials, products or equipment, except that which is displayed for sale, shall be within an enclosed building or in an open yard so screened that the stored items are not visible at human eye level within 300 feet of the property line.

§ 156.198 ACCESSORY USES.

   The following accessory buildings and uses are permitted in the B-2 District:
   (A)   Use and structures clearly incidental to the permitted and conditional uses; and
   (B)   Billboards and advertising signs, subject to the provisions of Chapter 154 of this code.

§ 156.199 SETBACK AND HEIGHT REGULATIONS.

   Setback and height regulations for the B-2 District are as follows:
   (A)   Front yard. The minimum front yard setback shall be no less than 20 feet. Where lots have a double frontage, the required front yard shall be provided on both streets.
   (B)   Side yard. No side yard setback is required, but if a side yard setback is provided, it must be no less than 5 feet. If the property is adjacent to a property whose zoning requires a side yard setback, then no less than a 5-foot setback must be provided. When property is adjacent to a public alley, the setback shall be 5 feet. The side yard shall be no less than 10 feet where the side yard adjoins a street.
   (C)   Rear yard. No rear yard is required, except for a lot abutting an A or R district, where the rear yard shall be 20 feet.
   (D)   Height. Maximum height is 75 feet above grade.

§ 156.200 PARKING REGULATIONS.

   Off-street parking spaces shall be provided in the B-2 District in accordance with §§ 156.350 et seq.
