SECTION 15

I - MANUFACTURING/INDUSTRIAL DISTRICT

§ 15.1 General Purpose and Description.

The Manufacturing/Industrial District is established to accommodate those uses which are of a non-nuisance type located in relative proximity to residential areas, and to preserve and protect lands designated on the Comprehensive Plan for industrial development and use from the intrusion of certain incompatible uses which might impede the development and use of lands for industrial purposes. Development in the I District is limited primarily to certain storage, wholesale, and industrial uses, such as the fabrication of materials, and specialized manufacturing and research institutions, all of a non-nuisance type.
Uses permitted in the I District are subject to the following conditions:
15.1.1 
All business, servicing, or processing, except for off-street parking, off-street loading, display of merchandise for sale to the public, and establishments of the "drive-in" type, shall be conducted within completely enclosed areas.
15.1.2 
All storage within one hundred (100) feet of a residential district, except for motor vehicles in operable condition, shall be within completely enclosed buildings or effectively screened with screening not less than six (6) feet nor more than eight (8) feet in height, provided no storage located within fifty (50) feet of such screening shall exceed the maximum height of such screening.
15.1.3 
Permitted uses in the I District shall not disseminate dust, fumes, gas, noxious odor, smoke, glare, or other atmospheric influence.
15.1.4 
Permitted uses in the I District shall produce no noise exceeding in intensity, at the boundary of the property, the average intensity of the ambient noise of created by street traffic and other noise sources, or 75 decibels, whichever is greatest.
15.1.4.1 
Ambient Noise means noise from all sources other than the noise under specific consideration, including traffic operating on public streets, and is established by measuring the noise level over an eight-minute period of time, which period of time shall be selected to obtain, to the fullest extent possible, a representative sample of average ambient noise.
15.1.4.2 
An "A" scale sound level meter that meets the standards of the American Standards Association must be used to determine whether the level of noise violates Section 15.1.4. A calibration check shall be made performed prior to and following any noise investigation. Measurements shall be taken by a Certified Safety Specialist, an Industrial Hygienist, or other person trained and qualified in the operation of sound measuring devices.
15.1.4.3 
For determining compliance, noise shall be measured every two hundred feet (200') along the bounding property line, for eight minute intervals at each location.
15.1.5 
Permitted uses in the I District shall not create fire hazards on surrounding property.

§ 15.2 Permitted Uses.

A building or premise shall be used only for the following purposes:
15.2.1 
Asphalt storage.
15.2.2 
Auction sales.
15.2.3 
Bag and Bagging.
15.2.4 
Cotton baling, compressing, and storage.
15.2.5 
Feed grinding and processing.
15.2.6 
Liquefied petroleum gas sales and service.
15.2.7 
Machine shop.
15.2.8 
Go Cart track.
15.2.9 
Railroad yards.
15.2.10 
Rock crusher.
15.2.11 
Sand blasting.
15.2.12 
Scrap paper or rag storage.
15.2.13 
Septic tank service.
15.2.14 
Stone cutting.
15.2.15 
Tank manufacture.
15.2.16 
Welding shop, equipment and supplies.
15.2.17 
Zoo, commercial.
15.2.18 
Building materials, sales/warehouses.
15.2.19 
Utility sub-stations.
15.2.20 
Uses as listed in Section 18 of this ordinance.

§ 15.3 Permitted Specific Uses.

The following specific uses shall be permitted in the I District when granted in accordance with Section 25:
15.3.1 
Machine shops and fabrication of metal not more than ten (10) gauge in thickness.
15.3.2 
Accessory uses, including but not limited to temporary buildings for construction purpose for a period not to exceed the duration of such construction.
15.3.3 
Factory outlet retail or wholesale store for the sales and servicing of goods or materials on the same premises as the manufacturing company to which they are related, including sales and service in a separate building or buildings.
15.3.4 
Railroad freight terminals, railroad switching and classification yards, repair shops, and roundhouses.
15.3.5 
Wrecking or salvage yards;
15.3.6 
Other uses as listed in Section 18 of this ordinance.

§ 15.4 Height and Area Regulations.

15.4.1 
Intensity of Use Regulations:
15.4.1.1 
Building structure or use, allowed in this district, may occupy all that portion of the lot except for that area required for off-street parking and off-street loading and their access roads;
15.4.1.2 
When a building or a structure is located within one hundred fifty (150) feet from a residential district zone, said building structure shall not exceed fifty (50) feet in height.
15.4.2 
Yard Regulations:
Front yard - No front yard shall be required for uses permitted in this district except as necessary to accommodate future street rights-of-way, in which cases, the building shall be set back according to the adopted Street Master Plan and Streets Rights-of-Way. Further, in cases when the front yard is adjacent to a more restrictive zoning district, the landscape buffer strip or the fencing requirements for side and rear yards may apply.
Side and rear yards - No side or rear yard shall be required, except where such yards are adjacent to a more restrictive zone district in which case there shall be required:
A side yard and/or rear yard of fifteen (15) feet;
Landscaped buffer strip six (6) feet in height containing a shrub border to serve as a screen between the more restrictive zoned property and the proposed use shall be provided and adequately maintained by the property owner at a height of six feet; or
A six foot solid fence or wall to be provided and maintained by property owner.

§ 15.5 Parking Regulations.

Off-street parking requirements shall be provided in accordance with the specific uses set forth in Section 20.

§ 15.6 Gas Well Regulations.

All oil, gas and mineral extraction activities allowed in the I District by specific use permit shall comply with the City of Pottsboro's Gas Well Regulations Ordinance.
