PLANNING AND ZONING COMMISSION - DUTIES, POWERS, AND RULES

§ 32.1 Planning and Zoning Commission Created.

The City of Pottsboro established the Planning and Zoning Commission by Ordinance No. 81-8-9; set the number of members and terms for members; described duties of the Commission; and prescribed procedures for Commission actions.

§ 32.2 Purpose of P and Z Creation.

The City of Pottsboro created the Planning and Zoning Commission in order to:
32.2.1 
Promote and protect the welfare of the residents and property owners of the City;
32.2.2 
Encourage the orderly growth and development of the community;
32.2.3 
Design a systematic and orderly procedure for identifying and protecting different land uses and their associated interests that is necessary to protect the welfare of the City's residents and the value of public and private property within the City;
32.2.4 
Assist the City Council in encouraging orderly growth and development and protecting the welfare of residents and property owners.

§ 32.3 Membership and Appointment.

The Planning and Zoning Commission shall be composed of five (5) persons who shall be real property owners and residents of the City. All vacancies occurring shall be filled by appointment by a majority vote of the Council and such appointment shall complete the term of the person whose resignation or removal has created the vacancy. No member of the City Council shall be appointed to this Commission. The Council may, at its discretion, add up to two (2) alternate members to the P and Z Commission. Alternate members must be real property owners and residents of the City, and may fill in for absent members.

§ 32.4 Terms of Office.

The Planning and Zoning Commission appointment will be for two years and no member may serve more than three consecutive full terms.
The terms of two (2) of the members shall expire on June 1 of each even-numbered year and the terms of three (3) of the members shall expire on June 1 of each odd-numbered year. The members of the Commission shall be identified by place numbers, one (1) through five (5). The even-numbered places shall expire in the even-numbered years and the odd-numbered places shall expire in the odd-numbered years. Newly-appointed members shall be installed at the first regular Commission meeting after their appointment.

§ 32.5 Organization.

In June of each year the Commission shall elect a Chairman and Vice-Chairman from among its members. The Commission shall meet at lease [sic] four (4) times each year and/or at such other times as necessary. The Commission shall hold their scheduled meetings at the Pottsboro City Hall, on the last Tuesday of the month, and keep a record of its proceedings consistent with the provisions of this ordinance and the requirements of the laws of the State of Texas. Each such meeting shall be held at least seven (7) days before the City Council meets in order that minutes and recommendations be available for Council's consideration.

§ 32.6 Powers and Duties.

The Commission shall:
32.6.1 
At the request of the City Council, or on its own initiative, conduct studies of the city over which it has jurisdiction and prepare reports to advise the City Council about the boundaries of the original zoned districts and changes to those districts or regulations.
32.6.2 
Initialize action to force a property owner to submit to the zoning processes described within this ordinance for lands currently being developed without requests for zoning changes, specific use permits, or variances. This action will be coordinated through the City's Planning and Zoning Coordinator.
32.6.3 
Consider and may grant or deny approval of any site plan required by this ordinance.
32.6.4 
Hold public hearings and make recommendations to the City Council, on any of the following:
32.6.4.1 
Any change or amendment to any provisions or regulations contained in this ordinance.
32.6.4.2 
Any zoning change or amendment to the zoning districts map, or any change in any zoning district boundary.
32.6.4.3 
Any request for a specific use permit.
32.6.5 
Formulate and recommend to the City Council for its adoption, a city plan for the orderly growth and development of the city and its environment and from time to time recommend such changes in the plan as it finds will facilitate the movement of people and goods, and the health, recreation, safety, and general welfare of the citizens of the city. The City's Comprehensive City Plan shall consist of a proposed zoning plan map and written report supporting the map.
32.6.6 
Recommend annexations to support the orderly and strategic growth of the City. Annexation recommendations may also be generated from City Council or city staff.
32.6.7 
Perform all functions related to the review and approval of subdivision plans.

§ 32.7 Quorum.

Three (3) members of the Commission shall constitute a quorum. However, no portion of the comprehensive plan shall be recommended for change by less than the affirmative vote of a majority of the Commission.

§ 32.8 Records and Reports.

The Commission shall maintain a record of its meetings and shall report to the City Council at least once each quarter concerning its activities for the past year.

§ 32.9 Removal From Commission.

Any member of the Planning and Zoning Commission may be removed by the City Council for a lack of confidence with a majority vote.
