SECTION 30

BUILDING PERMITS

§ 30.1

Any person owning property on which any construction, in the city limits of Pottsboro, involving changes to the exterior features or dimensions of a structure shall secure a building permit prior to commencing such construction. Construction includes driveway approaches, storage buildings, swimming pools, primary residential construction, commercial structures, and subdivision surface work as grading land for lot and/or street definition.

§ 30.2

Permits will be secured through the Pottsboro building permits department. The Building Official will verify that the request meets all city requirements and that any change in regards to zoning, variances, specific use permits is applied for and the application is processed through required processes as detailed by this ordinance before a building permit is granted.

§ 30.3

The applicant must submit a site plan detailing the lot dimensions, location of the proposed construction on the property, location of all utilities (water, sewer, gas, electrical, phone), driveway approaches, and culverts and other drainage structures.

§ 30.4

The Building Official may add additional construction stipulations to any building permit that must be complied with by the applicant. These stipulations will be in writing to the applicant.

§ 30.5

Fees for building permits will be listed in fee schedule in Appendix A Fee Schedule Article 3.000 Building Fees Sec. 3.600 Building Code Fees.

§ 30.6

The permit is null and void if work or construction authorized is not commenced within 6 months, or if construction or work is suspended or abandoned for a period of 1 year at anytime after work is commenced.

§ 30.7

All construction will comply with Pottsboro’s general ordinance “Building and Construction” defining standards of construction, permits required, inspections, and substandard buildings. Further, all state mandated requirements must be fully met.

§ 30.8

The Planning and Zoning Commission will review all business site plans with lot size exceeding ten thousand (10,000) square feet, for compliance with parking, ingress/egress, fire protection, etc. as they would any subdivision. The P and Z Commission will have final determination unless an applicant appeals for a review by the Zoning Board of Adjustment.

§ 30.9

All lot line and area requirements must comply as defined in the zoning districts regulations.

§ 30.10

At least two (2) on-site inspections of the construction for which the permit is being granted by the building inspector. The first will be to insure that lot line and area requirements are in compliance and the second will be at the end of the construction to sure that all requirements have been fully met.

§ 30.11

No permit is to be issued for construction seeking to use a septic tank unless such septic system use is authorized by a majority vote of the city council and a valid permit has been issued by the Grayson County Health Department.

§ 30.12

Changes to drainage structures must be installed by the applicant and inspected by the city prior to any building construction.

§ 30.13 Water/Sewer Taps.

All individual residences or businesses shall have separate water taps (meters) and sewer taps with the only exception being multi-family housing. This stipulation applies to each business even though multiple businesses are located in a single building. Water and sewer taps are the responsibility of the requestor/developer to install at requestor/developer’s cost. The water and sewer tap fees shall be paid at the time of when the building permit is requested and issued; and this shall be paid for by the requestor. It will be the responsibility of the builder to make known when he wants the taps to be made and should allow the maintenance personnel ten (10) days lead time for the purpose of scheduling. Taps will be made on a first come, first serve basis.

§ 30.14

Any deviation from the above building permit requirements will require a majority approval vote of the City Council.

§ 30.15 Building Permit Flow Chart.

Retains records of requests.

Adds stipulations or comments.
3.
Determines utilities impact.
4.
Approves or denies building permit.
5.
Inspects work.
