SECTION 25

SPECIFIC USE PERMITS

Specific Use Permits apply to uses. A Specific Use Permit may be granted to permit a “use” in a zone, not generally permitted in that zone.

§ 25.1

All applications for specific use permits shall be submitted by the owner of said property and accompanied by:
25.1.1 
Description of “uses” to be permitted;
25.1.2 
A site plan drawn to scale and depicting general arrangement of the project, including building location(s);
25.1.3 
Detail of requirements as off-street parking facilities and traffic ingress/egress;
25.1.4 
Size, height, construction materials;
25.1.5 
Visual screening (walls, plantings, fences);
25.1.6 
Lane “uses” (zoning and approved specific use permits) for all land uses in all directions within a minimum of 200 feet.

§ 25.2

In recommending that a specific use permit for a premise under consideration be granted, all governing bodies, shall determine that:
25.2.1 
The use(s) are harmonious with and adaptable to building structures and uses of abutting property and other property in the vicinity of the premises under consideration.

§ 25.3

All governing bodies shall make recommendations as to the requirements for:
25.3.1 
Right-of-ways, easements.
25.3.2 
Paving of streets, alleys and sidewalks.
25.3.3 
Means of ingress and egress to public streets.
25.3.4 
Provision for drainage.
25.3.5 
Adequate off-street parking.
25.3.6 
Protective screening and open space.
25.3.7 
Heights of structures.
25.3.8 
Compatibility of building structure for use.

§ 25.4

The City Council, in granting of a specific use permit, may impose conditions which shall be complied with by the owner of, before a building permit (if a building permit is required), or specific use permit be issued. These conditions shall be construed as conditions precedent prior to occupancy of the property; and cannot be substituted to any other use.

§ 25.5

The zoning map will indicate each specific use permit in all districts by the use of an “S” designation.

§ 25.6

Specific use permits granted to a particular piece of property under these provisions shall remain with said property, by issuance of separate Ordinance as long as applicant owns said property; or, as long as specific use exists. If the specific use is abandoned for a period of six (6) months, then, the specific use is lifted and the property shall revert back to its original use.
