C-1 LOCAL

COMMERCIAL DISTRICT

§ 154.155 PURPOSE.

   The purpose of this district is to provide for uses principally to accommodate the sale of convenience retail goods and personal services purchased frequently for daily or weekly needs and general commercial uses. The district is intended to serve families living within the surrounding area. Since slightly over 50% of the patrons of such a district are multipurpose shoppers, it is intended that the design of this district will encourage groupings of establishments located on a unified site providing adequate off-street parking facilities as well as an efficient and safe method of handling vehicular and pedestrian traffic.

§ 154.156 PERMITTED USES.

   (A)   Establishments engaged in the following retail uses:
      (1)   Art, photo, stationery, notion, toy and gift sales.
      (2)   Drugstore.
      (3)   Clothing, apparel and variety stores.
      (4)   Florist shop and garden supply sales.
      (5)   Food sales, including supermarket.
      (6)   Hardware and paint sales.
      (7)   Sporting goods.
      (8)   Preparation and processing of food and drink to be retailed on premises, including bakery, delicatessen, meat market, confectionery, restaurant, ice cream parlor, soda fountain, tavern.
      (9)   General retail uses, including but not limited to, apparel, antiques, jewelry, optical goods, furniture, office supplies, and furnishings.
      (10)   Other uses which are determined by the Planning Commission to be clearly similar in character which are customarily consumed, used and stored within a dwelling.
   (B)   Establishments engaged primarily in the field of finance, insurance and real estate as follows:
      (1)   Bank.
      (2)   Credit agency other than a bank.
      (3)   Investment firm.
      (4)   Insurance carrier.
      (5)   Real estate agency.
      (6)   Other uses which are determined by the Planning Commission to be clearly similar in character to those listed in this section.
   (C)   Establishments engaged in providing a variety of services to individuals and business establishments such as:
      (1)   Personal services, including barber and beauty shops, shoe repair shops, laundries and dry cleaning, provided that all services are provided in the main structure.
      (2)   Miscellaneous business services such as advertising, news syndicates and employment agencies.
      (3)   Architectural and engineering services.
      (4)   Legal services.
      (5)   Medical and health services.
      (6)   Accounting, auditing and bookkeeping services.
      (7)   Other uses which are determined by the Planning Commission to be clearly similar in character to those listed in this section.
   (D)   Signs, subject to §§ 154.470 through 154.486.

§ 154.157 AREA AND HEIGHT REGULATIONS.

   (A)   Minimum lot area: 20,000 square feet.
   (B)   Minimum lot width at front building line: 100 feet.
   (C)   Minimum lot depth: 150 feet.
   (D)   Minimum lot frontage: 75 feet.
   (E)   Minimum front yard depth: 50 feet.
   (F)   Minimum rear yard depth: 40 feet.
   (G)   Minimum side yard width: 10 feet.
   (H)   Maximum floor area ratio: Proportion of floor area of all structures to total lot area shall not exceed 25%.
   (I)   Height regulations: No structure shall exceed 35 feet.
   (J)   Adjacent to residential: Yards adjacent to residential districts shall meet the front and side yardrequirements of the adjacent residential district but shall not be less than 25 feet.
   (K)   Parking and loading requirements: As required in §§ 154.405 through 154.409 of this code.

§ 154.158 LANDSCAPE PLAN.

   Landscape plan shall be as required in § 154.069.

§ 154.159 SITE PLAN REVIEW AND CONFORMANCE.

   (A)   All uses permitted by § 154.156 shall be permitted only after the review and approval of the site plans by the Planning Commission according to § 154.070 and upon a finding by the Commission that the requirements of that section as well as all other applicable regulations of the Code of Ordinances will be met.
   (B)   Planned commercial development provisions of § 154.072 may be enforced by the Commission if:
      (1)   The proposed development is located in an undeveloped area of the C-1 District, which has 150 feet or more of street frontage on any one street; or
      (2)   The proposed development is larger than one acre; or
      (3)   The Commission determines that the provisions must be enforced to provide for orderly development of the area and to prevent undue traffic hazards.

§ 154.160 ARCHITECTURAL DESIGN REVIEW.

   Architectural design review is required for all uses permitted under § 154.156 according to procedures detailed in § 154.071.
