GENERAL ZONING

DISTRICT PROVISIONS

§ 153.045.- DESIGNATION OF DISTRICTS.

(A)

The zoning districts are so designed as to assist in carrying out the intents and purposes of the comprehensive plan and are based upon the comprehensive plan which has the purpose of protecting the public health, safety, convenience and general welfare.

(B)

For the purposes of this chapter, the city is hereby divided into the following zoning districts:

(1)

AG, agricultural;

(2)

R-1, suburban residential;

(3)

R-2, urban residential;

(4)

R-3, multi-family district-low density;

(5)

B-1, central business district;

(6)

B-1-1, transitional central business district;

(7)

B-2, highway commercial;

(8)

I-1, light industrial; and

(9)

FP, flood hazard.

(C)

In any zoning district, accessary buildings shall not be constructed prior to or in lieu of the principal buildings.

§ 153.046. - ZONING MAP.

(A)

The location and boundaries of the districts established by this chapter are set forth on the official zoning map which is hereby incorporated as part of this chapter and which is on file at the office of the Clerk-Administrator.

(B)

District boundary lines recorded on the city zoning map are intended to follow lot lines, the centerlines of streets or alleys, the centerlines of streets or alleys projected, railroad rights-of-way lines, the center of watercourses or the corporate limit lines as they exist at the time of the enactment of this chapter.

(C)

Whenever any street, alley or other public way is vacated, the zoning district adjoining that of the vacated street, alley or public way shall be automatically extended to the center of the vacated area and all streets included therein shall be then and henceforth subject to all regulations of the extended district.

(D)

All territory which may hereafter be annexed to the city shall be considered zoned in the same manner as the contiguous territory inside the previous city limits until otherwise classified.

(E)

It shall be the responsibility of the Zoning Administrator to maintain and amend the zoning map. The Zoning Administrator shall make or cause to have had any corrections or amendments to the map after all of the procedures outlined in this chapter for the making of the revisions or amendments shall have been followed by the Planning Commission and the City Council.

(F)

Amendments to this zoning map shall be recorded on the map within 15 days after adoption by the Council. The copy of the official zoning map shall be kept on file in the office of the City Clerk-Administrator and shall be open to public inspection at all times during which the office of the Planning Administrator is customarily open.

(G)

The zoning map and all amendments to it shall be filed with the County Recorder.
