ARTICLE XXI

AMENDMENTS

Section 1. - Authority for amendments.

The regulations, restrictions and boundaries established in this ordinance may, from time to time, be amended, supplemented, changed or modified, or repealed, by a majority vote of the city council; provided, however, in case of a protest against any such proposed change signed by the owners of 20 percent or more either of the area within the boundaries of such proposed change or of the area of any lots or tracts, any part of which lies within 300 feet of such boundaries, such change or amendment shall not become effective except by the favorable vote of three-fourths of all the members of the city council; and further provided:

Public hearing required. A public hearing shall be held in relation thereto at which parties in interest and citizens shall have an opportunity to be heard.

Notice. Notice shall be given of the time and place of such hearing as provided in Code of Virginia, § 15.2-2204.

Referral to commission. No change shall be made by the city council to the zoning ordinance or the zoning map until such change has been referred to the commission for a report thereon, and no action shall be taken by the city council until a report has been received from the commission, unless a period of 30 days has elapsed after the date of reference to the commission, after which time it may be assumed the commission has approved the change or amendment.

Time requirement before refiling for change. When any application for a proposed change in the zoning ordinance has been denied by the city council, no subsequent application for the same, or substantially the same, change in whole or in part shall be filed with or accepted by the administrative official, or any proceeding therefor commenced or maintained, within one year next succeeding the date of the action of the council denying said proposed change.

Section 2. - Changes in comprehensive plan, adopted.

At such time as the comprehensive plan may be amended and officially reviewed in accordance with the Code of Virginia, § 15.2-2230, the planning commission shall review said document to determine if it is advisable to amend the plan. Corresponding amendments to the zoning ordinance might be proposed if made necessary by the character of amendments or changes in the comprehensive plan.
