ARTICLE VI

RESIDENTIAL DISTRICT R-3

Section 1. - Statement of intent.

Residential District R-3 is established as a residential district that provides a higher density of dwellings than residential districts R-1 and R-2. The primary purpose is to allow land for single-family dwellings on small lots, two-family, and multifamily.

Section 2. - Permitted uses.

In Residential District R-3, no building or land shall be used and no building shall be erected which is arranged, intended or designed to be used for other than one or more of the following uses:

(2-1)

Any use permitted, and in the same manner permitted, in residential districts R-1 and R-2.

(2-2)

Multifamily units, subject to the provisions of article XVI, section (3-1).

(2-3)

Garage apartments, subject to the provisions of article XVI, section (3-1).

(2-4)

Accessory buildings, except that they must be at least five feet from the main building or structure and they are not permitted within any required front or side yard or within 15 feet of any street line or within three feet of any lot line not a street line.

Mobile home parks, subject to the provisions of article XVI, section (3-2).

Section 3. - Uses permitted by special exception.

The following uses are permitted upon application to the city council and subject to conditions established by it as outlined in article XVIII, section 8:

(3-1)

Family day home serving more than five children, exclusive of the provider's own children and any children who reside in the home.

Section 4. - Sign regulations.

Sign regulations shall conform to article XV of this ordinance.

Section 5. - Minimum lot regulations.

For residential dwellings served by public water and sewer, the following minimum lot areas shall apply:

For permitted uses utilizing individual water and/or sewage disposal systems, the required lot area for any such use shall be determined by the health official, but shall not be less than set forth above in section (5-1) of this article.

Section 6. - Setback regulations.

Setback regulations shall conform to the provisions of article V, section 6 of this ordinance.

Section 7. - Yard regulations.

(7-1)

For one- and two-story dwellings:

(7-1.1)

Front. The minimum front yard shall be 25 feet. Frontage requirements shall refer to article IV, section (5-3) of this ordinance.

(7-1.2)

Side. The minimum side yard shall be five feet, and the total width of the two required side yards shall be ten feet or more.

Rear. Each principal building shall have a rear yard of 25 feet or more.

For buildings greater than two stories in height:

(7-2.1)

The front and rear yard requirements shall be the same as set forth in section 7-1 above.

Five feet shall be added to the minimum requirement for each side yard.

(7-3)

For corner lots:

(7-3.1)

Yard requirements for corner lots shall be the same as set forth in sections 7-1 or 7-2 as applicable, except that a ten-foot side yard is required on any side facing an existing or proposed street.

For accessory buildings:

(7-4.1)

Accessory buildings shall conform to the provisions stated in section 2 of this article.

Section 8. - Height regulations.

(8-1)

No building shall be erected to contain more than 3½ stories, not to exceed 45 feet in height from grade, except that:

(8-1.1)

Churches, schools, hospitals, sanitariums, and other public and semipublic buildings may be built to a height of 55 feet, or four stories if the minimum depth of front and rear yards and the minimum width of side yards required in the district are increased by one foot for each foot by which the height of such public or semipublic structure exceeds the height limit in feet prescribed for other structures in the district.

These limitations shall not apply to church spires, belfries, cupolas, monuments, water towers, chimneys, flues, flagpoles, television antennae, and radio aerials. Parapet walls shall not exceed four feet above the limited height of the building on which the walls rest.

No accessory building which is within one foot of any party lot line shall be more than one story high. No accessory building shall exceed the main building in height.

Section 9. - Parking regulations.

Off-street parking is required and on premises parking is regulated with open space required. Refer to article XIV of this article for requirements.
