In the R District, the regulations set forth in this section shall apply except as otherwise provided in this Zoning Ordinance.
1. Principal Permitted Uses. The following principal uses are permitted in the “R” District:
A. One-family, two-family, and single-family semidetached dwellings.
B. Multi-family, condominiums and town home dwellings (see Sections 165.36 through 165.41 of these zoning regulations).
2. Accessory Uses. The following accessory uses are permitted in the R District:
A. Customary accessory uses and structures incidental to the permitted principal uses;
B. On-site signs, as provided in subsection 3 of this section.
D. Satellite receiving antennae, as provided in subsection 4 of this section.
E. Fences, walls and plantings, as provided in subsection 5 of this section.
3. On-Site Signs. In the R District there shall be permitted one only sign not exceeding eight square feet in area, appertaining only to the lease, hire or sale of the building or premises on which such sign is located, and one only sign appurtenant to a dwelling and property occupation or a permitted use, not exceeding two square feet in area; provided, however, no such sign or nameplate shall emit any flickering, flashing or glaring light; and provided further, these signs shall conform to the setback line required of any principal building. Also, there shall be permitted outdoor signs or bulletin boards for churches, schools and other public buildings, not exceeding 16 square feet and not erected within 25 feet of a street line.
4. Satellite Receiving Antennae. In the R District there shall be permitted an accessory structure, often called a “dish” or “earth station antenna,” the purpose of which is to receive communication including but not limited to radio and television or other signals from satellite and other extraterrestrial sources, whether affixed to the ground as a permanent structure or a mobile unit such as a trailer or vehicle, subject to the following:
A. Any satellite receiving antenna constructed in a residential zoning district that is mounted on the ground shall have a height no greater than the peak of the roof of the residence located on the lot on which the antenna is to be located. If there is no residence on the lot in which the antenna is to be located, the height shall be controlled by the residence on the lot nearest to the lot on which the antenna will be located. In no event shall the height be greater than 15 feet. The height of the antenna shall be measured vertically from the highest point of the signal receiving apparatus, when positioned for operation, to the bottom of the base which supports the antenna.
B. No satellite receiving antenna shall be mounted, located or placed permanently or temporarily in any residential zoning districts in any front yard and the portion of the side yard that is adjacent to the principal structure of the lot, and not within five feet of the lot lines in the remaining side yard and rear yards.
C. No satellite receiving antenna in residential districts shall be greater than 12 feet in diameter.
D. Satellite receiving antennae mounted on trailers or vehicles may be allowed for a period not to exceed 15 days. All others shall be permanently placed.
E. Notwithstanding the provisions of this section, a satellite receiving antenna may be mounted to a residential dwelling so long as any and all structural requirements of the Uniform Building Code are adhered to and followed. However, the top of the building mounted antenna shall not be higher than the peak of the roof of such building, and the antenna shall not be located on the side or front of the residence.
5. Fences, Walls and Plantings.
A. Permit Required. No person shall erect, alter or relocate any fence, wall or other vision barrier in the R District without first obtaining a building permit, the fee for which shall be provided for in Section 165.18 of this Zoning Ordinance. A copy of this section and of Figure A attached to the ordinance codified in this chapter shall be provided the applicant for such permit. Said Figure A is by this reference made a part of this chapter.
B. Residential fences shall be permitted in any yard in residential zoning districts or residential use areas except that fences or walls shall not in any case exceed eight feet in height in side and rear yards and shall not exceed 42 inches in height in front yards. Fences may be erected upon a lot line agreed between adjacent property owners. In case of disagreement, the fence shall be erected two feet within the assumed property line. If the property line is surveyed, the fence may be erected as near as possible to the property line as desired, staying, however, entirely within the property boundaries. The finished side of the fence must face outward. Privacy fences on corner lots shall meet the same setback in front and side yards as principal buildings. Front yard fence materials shall provide a minimum of 50 percent visibility.
C. Double Frontage Lots: In the case of double frontage lots with an arterial street forming the rear property line, fences may be permitted a minimum of fifteen (15) feet from the property line of the secondary front yard. Such fences may be up to six (6) feet in height. The finished surface of the fence shall face outside the property. Similar fences on abutting properties must be in alignment to form a row. For the purposes of this chapter, arterial streets within the City are defined as North Chestnut Avenue, from Sixth Street to the north city limits, and other streets as determined from time to time by the City Council.
D. No hedge, landscape planting or other vegetation shall be permitted in any district which impedes vision greater than 50 percent of an imaginary plane, perpendicular to the street, extending the full depth of the front yard and vertically from a height of 42 inches to 10 feet. Hedges, trees or plantings shall be pruned so as not to infringe upon the adjoining property.
E. Fences of any height shall be permitted in connection with any agricultural use, provided that the requirements of traffic visibility at intersections are observed.
F. Nothing in this section shall be deemed to apply to public tennis courts, public pools, public baseball fields, and any other public recreational use facility accessible to the public, except where traffic visibility is impaired.
G. No fence, wall, shrubbery, earthen berm, sign, billboard or other obstruction to vision shall be permitted which serves to obstruct vision between a height of 30 inches and 10 feet on any corner lot within a triangle of 30 feet formed by intersecting street right-of-way lines, or in the case of interior lots within a triangle of 20 feet by intersecting driveway edge and right-of-way lines.

6. Building Height. Building height in the R District is limited to two and one-half stories, but not exceeding 35 feet in height; and no accessory structure shall exceed one story or 18 feet in height.
7. Minimum Lot Area. Minimum lot area in the R District shall be as provided in the following schedule:

9. Minimum Front Yard Depth. Minimum front yard depth in the R District is 30 feet.
10. Minimum Side Yard Width.
A. Minimum side yard width in the R District is eight feet on each side for a dwelling, and 20 feet on each side for any other principal building.
B. On lots of record on February 3, 1969, or at the time of amendment of this chapter having a width less than 65 feet, the side yards may be reduced for single-family dwellings only as follows:
(1) Each side yard may be reduced to not less than 10 percent of the lot width, but in no case less than five feet.
(2) On corner lots, only the interior side yard may be reduced below eight feet.
11. Minimum Rear Yard Depth. Minimum rear yard depth in the R District is 35 feet for a dwelling, and 45 feet for any other building.
