165.46 INDUSTRIAL

DISTRICT.

In the M District, the regulations set forth in this section shall apply, except as otherwise provided in this Zoning Ordinance.
   1.   Principal Permitted Uses. The following principal uses are permitted in the M District:
      A.   Uses permitted in the C District, provided that no dwelling or dwelling unit is permitted except those for employees having duties in connection with any premises requiring them to live on the premises, including families of such employees when living with them;
      B.   Any of the following uses:
         (1)   Grain elevators, feed mixing and grinding
         (2)   Storage of junk or non-operable motor vehicles, but only within a painted-type fence or masonry wall not less than eight feet in height
         (3)    Automobile assembly and major repair
         (4)    Creamery, bottling, ice manufacturing and cold storage plants
         (5)   Manufacturing, compounding, processing, packaging or treatment of cosmetics, pharmaceuticals and food products, except fish and meat products, sauerkraut, vinegar, yeast, and the rendering or refining of fats and oils
         (6)   Manufacturing, compounding, assembling or treatment of articles of merchandise from previously prepared materials such as bone or cloth, cork, fiber, leather, paper, plastics, metals or stones, tobacco, wax, yarns, and wood
         (7)   Manufacture of musical instruments, novelties and molded rubber products
         (8)   Manufacture or assembly of electrical appliances, instruments and devices
         (9)   Manufacture of pottery or other similar ceramic products using only previously pulverized clay and kilns fired only by electricity or gas
         (10)   Laboratories – experimental, film or testing
         (11)   Manufacture and repair of electric signs, advertising structures, light sheet metal products, including heating and ventilating equipment
         (12)   Blacksmith, welding or other metal shops
         (13)   Foundries
         (14)   Bag, carpet and rug cleaning; provided necessary equipment is installed and operated for the effective precipitation or recovery of dust
         (15)   Enameling, lacquering or japanning
         (16)   Crematories, if located not less than 200 feet from an R District
         (17)   Concrete mixing plants, gravel, sand and concrete storage and sales, concrete products manufacture
         (18)   Sawmills, planing mills; including manufacture of wood products not involving chemical treatment; building material sales yards, lumber yard, contractor’s equipment storage yard or plant or rental of equipment commonly used by contractors and storage yards for vehicles of a delivery or draying service
         (19)   Inflammable liquids storage
         (20)   Truck terminals or yards, including repair
         (21)   Milk processing and canning factories
         (22)   Hatcheries of all kinds.
      C.   Any other use not otherwise prohibited by law; provided, however, the following uses shall be permitted subject to approval by the Council after public hearing and after report and recommendation by the Commission:
         (1)   Garbage, offal or dead animal reduction or dumping
         (2)   Acid manufacture
         (3)   Cement, lime, gypsum, or plaster of paris manufacture
         (4)   Distillation of bones, coal, tar, petroleum, refuse, grain or wood
         (5)   Drilling for or removal of oil, gas or other hydrocarbon substance
         (6)   Explosives manufacture or storage
         (7)   Fat rendering
         (8)   Fertilizer manufacture
         (9)   Gas manufacture
         (10)   Glue manufacture
         (11)   Hog ranches
         (12)   Mineral extraction, including sand and gravel
         (13)   Petroleum or petroleum products refining
         (14)   Rubber goods manufacture
         (15)   Salvage yards, including auto wrecking and salvage, used part sales and junk, iron or rags, storage or baling. No portion of the front yard is to be used for the conduct of business in any manner whatsoever except for parking of customer or employee vehicles. Any premises on which such activities are carried on shall be wholly enclosed within a building or by a wooden, metal or masonry fence or wall not less than eight feet in height and so constructed that it completely obscures the view of the operations on the premises from surrounding streets or private property.
         (16)   Smelting of ores
         (17)   Stockyards or slaughter of animals, except poultry or rabbits
         (18)   Tanneries
         (19)   Livestock buying stations
         (20)   Any other use which is objectionable by reason of emission of odor, dust, smoke, gas, vibration or noise or may impose hazard to health or property.
   2.   Required Conditions. The following conditions are required in the M District:
      A.   The best practical means known for the disposal of refuse matter or water carried waste, and abatement of obnoxious or offensive odor, dust, smoke, gas, noise or similar nuisance shall be employed.
      B.   All principal buildings and all accessory buildings or structures, including loading and unloading facilities shall be located at least 100 feet from an R District boundary, except where adjoining a railroad right-of-way.
   3.   Building Height. The building height limit in the M District is three stories, but not more than 50 feet.
   4.   Minimum Lot Area. There is no minimum lot area requirement in the M District.
   5.   Minimum Lot Width. There is no minimum lot width requirement in the M District.
   6.   Minimum Front Yard Depth. The required minimum front yard depth in the M District is 30 feet. When fronting on the right-of-way of a major thoroughfare shown on the official major thoroughfare plan, the front yard shall be measured from the proposed right-of-way line.
   7.   Minimum Side Yard. No minimum side yard is required in the M District, except adjacent to the R District, in which case, not less than 100 feet is required except where adjoining a railroad right-of-way.
   8.   Minimum Rear Yard Depth. The minimum rear yard depth required in the M District is 40 feet, unless the rear lot line adjoins a railroad right-of-way, in which case, none is required.
   9.   Fences, Walls and Plantings. For provisions on fences, walls and plantings, see Section 165.44(5) of this chapter.
   10.   Exceptions. For exceptions to the provisions of this section, see Sections 165.36 through 165.41 of this Zoning Ordinance.
